Consumer Complaint: At time share meeting XXXX XX/XX/XXXX, American Express XXXX XXXX XXXX application included for payment of downpayment on property. I applied for card at that time, and was approved, but did not use the account. Card arrived to my home in CA but was never activated. I was billed XXXX $ annual membership fee despite never activating or using account. I notified Am Ex in writing to cancel account, XX/XX/XXXX, but bill continued to come. In XX/XX/XXXX, I called agent who stated I was obligated to pay only XXXX $ for 1 month of membership prior to written cancellation. I tried to do this on phone that day but it took too long, as account had been cancelled and he could not easily find. I sent XXXX $ check in billing envelope with Am Ex receipt that same day. It has not yet been cashed. This account has been sent to collections, damaging my credit report and preventing my home refinance. When called againXX/XX/XXXX, Am Ex XXXX, stated that by applying for card I was obligated to pay the whole annual fee, whether or not card was ever activated or used and this was in the agreement I signed. I have subsequently found that agreement and see no indication of this. It states obligation begins when card is " used or activated ''.

Consumer Complaint: * Systemic issues and policy issues for the CFPB! 1. I have had an American Express prepaid debit card / Serve account for a couple years. Serve provides a checking acct. and routing number to receive direct deposits. 2. On XX/XX/2021 I received a direct deposit from XXXX XXXX in the amount of XXXX dollars. The funds are reflecting of a PPP loan for which I was approved by the U.S. Small Business Administration for XXXX XXXX XXXX ( sole proprietor ). 3. On XX/XX/2021, I received an email from Serve stating that they had permanently suspended my account : # # # # Hi XXXX XXXX, During our recent review of your Serve Prepaid Debit Account, we identified Account activity that we believe violates the terms of the Consumer User Agreement. As a result of such activity, and pursuant to Section 15 ( d ) of the Consumer User Agreement, your Account and your Account privileges have been permanently suspended. If you have any questions or would like to inquire further, you may write to us at the following address : XXXX Customer Care XXXX. XXXX XXXX XXXX, GA XXXX Thanks, The XXXX Team # # # # 4. They suspended my access to all online account services, including balance, statements, and transaction history. 5. On XX/XX/2021, I immediately called XXXX Customer Service at XXXX XXXX XXXX XXXX and am routed to Acct. Protection Services. They say they can provide no more information, including the status of my funds and what would happen to the funds, and that I should send a letter to the XXXX XXXX if I have any questions. I ask for a supervisor. 6. I speak with XXXX XXXX, XXXX, XXXX Acct. XXXX Services. He states the balance at the time of closure was {$15000.00}. He says a suspended acct. may be reinstated ( there is a chance ). This acct. is not closed, but is suspended, he said. Funds are still in the acct., but is suspended status, he said. He said that they are requesting an indemnity letter from XXXX XXXX that would state that I am the owner of the direct deposit / that I was supposed to these funds. He says the letter should be addressed to American Express, and emailed to XXXX ( payment investigations team for XXXX, a third party vendor for Amex ). 7. On XX/XX/2021, I call and email XXXX XXXX at XXXX, who originally processed my XXXX loan application with the XXXX. They referred me to XXXX XXXX for the letter. 8. On XX/XX/2021, I call XXXXXXXX XXXX and request the letter from a representative, who says that I will receive an email or call from a supervisor within two to three business days. XXXX. On XX/XX/2021, I call XXXX XXXX to check on the status of my request, and I am referred to the Corporate Office at ( XXXX ) XXXX. 10. On XX/XX/2021, I speak with XXXX XXXX, who asks me to email him a copy of the email I received from Amex, along with information about where to send the letter. 11. On XX/XX/2021, XXXX XXXX forwards my request to XXXX XXXX, and asks me to be in touch with her. 12. On XX/XX/2021, XXXX XXXX tells XXXX XXXX that she is conferring with a supervisor regarding the request. 13. On XX/XX/2021, I email XXXX XXXX directly to follow up on my request. 14. On XX/XX/2021, I learn that two refunds are being sent from a merchant to the prepaid debit card ending in XXXX, which is connected to the suspended account. The refunds are in the amounts of {$510.00} and {$620.00}. 15. On XX/XX/2021, I call Amex / Serve to find out about the refunds, whether they were processed or will returned to the merchant. I spoke with " XXXX '' in Acct. Protection, and asked for supervisor. XXXX, Supervisor, said " We do not have information regarding whether receiving credit. '' He said he had no access to the current balance or transaction history and that I would have to send a letter to the P.O. Box to access my transaction history. I stated I would be filing a CFPB Complaint. He said, Thats pretty unrelenting on your part. '' and then, all of a sudden, pretended could not hear and then disconnected call. 16. On XX/XX/2021, I call back and speak with " XXXX '' in Acct. Protection, and asked for supervisor. Spoke with XXXX, id XXXX, XXXX, who said that once the letter was received, that the remaining funds would be sent back to XXXXXXXX XXXX, who would then need to get the funds to me another way. 17. On XX/XX/2021, I sent a follow-up email to XXXX at XXXX XXXX, copying XXXX, clarifying that the funds would be returned to Customers Bank, and asking if I could open a checking acct. for the Sole Proprietorship with XXXXXXXX XXXX 18. To date I have not heard back from XXXX regarding the letter.

Their customer service team has been very dismissive of my request despite repeated calls and attempts to locate my money. Consumer Complaint: I purchased items for our business when the pandemic started. The items were not delivered in the time frame they said. I canceled order. Months later the items arrived. - The items that were delivered did NOT match the description of items that we ordered. - The photos on the product page were completely different than the products we received We tried to contact company, phone number not working, I emailed them and they answered my email with a response that had nothing to do with my problem. We tried contacting them several more times via email and telephone. Each time were were denied a response I then called American Express. American Express assured me that I was in the right and they would take care of it. I wanted to send back the faulty items but they said not to worry because the company wasn't responding to american express, and again, I was in the right. We then received a letter from American Express stating that we were being re-billed for the items because they found the merchant to be in the right. How? we asked American Express again. The representative stated it was a mistake and asked us to send more information including photos of the product. We did as American Express asked. American Express placed the charge on hold and said we were not responsible for the charge until the matter is resolved. We were assured that our claim was absolutely legitimate and to rest assured that American Express would take care of the matter About two weeks later we received another letter form American Express stating, ponce again, that the charge has been re-billed to our account. After almost a year and about a dozen calls to American Express we are no closer to resolving the issue. American Express continues to disregard all of our information and simply denies our claim. We are continually told by American Express representatives " I don't understand what happened ... let 's try this again ... you are absolutely in the right ... I'm not sure why this is happening ... I'll make sure this gets to the right person ... I'll make sure this gets resolved ... '' ( I'd like to hear the playback of the conversation that they have recorded " for quality assurance '' ) However, nothing gets resolved. I don't know what the terms and conditions are of the agreement between American Express and their merchants, but, as a cardholder who is protected against such fraudulent practices, I insist my consumer rights be upheld and respected.

I've applied twice and both times I've been declined and when I request to see the details related to the declination all I receive is the message below. My applications were over 2 weeks apart so I find it untruthful that their systems have been updating for over 2 weeks. I've tried back after 24, 48 and 72 hours and I still receive the same message so the basically decline my application and do not provide the reason why. HOWEVER THE ACTUAL DOCUMENTS FOR THE CORPORATE CARD APPLICATION AND CORPORATE CARD AGREEMENT DO EXIST AND THEY DO NOT WANT TO PRODUCE THEM SINCE PRODUCING THEM WOULD BE INCRIMINATING AND SHOW CRIMINAL CONDUCT FOR KNOWLINGLY ADVANCING A FALSE CLAIM SINCE THE DEBTOR IS NOT XXXX XXXX, THE AUTHORIZED PERSON FOR THE CORPORATION BUT A CORPORATION WITH ITS OWN TAX ID, DULY FORMED, INCORPORATED AND GOVERNED BY CORPORATE LAW AND IS A LEGAL PERSON SEPARATE AND DISCTINT THAT ITS OFFICERS AND OR SHAREHOLDERS..
