Consumer Complaint: Thank you for your attention : I have been an American Express Serve Cardholder for, I believe, about 5 years. This is a prepaid card that I use for mail order and travel for better security. I have been very pleased with their services to date. On XX/XX/2022 I used my card.to purchase a hotel room from XXXX XXXX XXXX, XXXX. I purchased my room via XXXX, thus, my hotel stay was prepaid. On check in, I was told that there would be a security hold put on my account, which is customary, and usually lasts for no longer than 1 week. The hold put on my account was for {$170.00}. Weeks later, I noticed those fund were still on hold, and I inquired with the hotel the last days of XXXX. I was told by the hotel that those funds were released by the hotel to American Express the next day, XX/XX/XXXX at XXXX pm. The reference number they gave me was XXXX. The hotel phone number is XXXX. The customer service representative is XXXX. I called American Express Serve today to inquire, was sent to the " escalation '' desk around XXXX am. There, I explained the situation, including the release information, and was told that American Express Serve " always '' holds funds for 30 days ( meaning a XXXX release ) regardless of the merchant releasing funds at any date. Really?? This seems exceptionally unfair to the card holder, and fabulous for American Express. I would expect this to be front page news in the XXXX pages of national newspapers ( I worked for the XXXX XXXX for 7 years ). So before I kick this issue up to the media, and to put this department on record, can you please confirm or deny that this policy is legal and acceptable to your department, and why? Consumer Complaint: After learning my rights as a consumer I sent a letter to the cfo and ceo of American Express explaining the rights they violated, how I dont owe any debt and how they are illegally reporting information such as late payments and utilization in my report. I told them I need to get paid $ XXXX each late payment, utilization posted and also each violation I found on the statement. A person named XXXX sent me a letter stating that I am bound to the card ember agreements to make payments and if I dont then they will be reporting my account as delinquent to the consumer reporting agencies. 15 USC 1681 states how no one cant report anything or share information without my written consent and also how transactions and experiences are excluded for a consumer report. 15USC 1666b basically explains how there is no such thing as a late payment, there isnt no such thing as a late payment because the debt is already paid for law 18 USC 8 states how The United States is accountable for all obligations. I am a living soul from God and can not and will not enter a contract with a corporation. I am not a fictional limited liability entity otherwise known as a corporation. Also in the transactions I see it states I was charged a finance charge but according to 15USC 1605 finance charge means the sum of all charges, why is American Express changing the definition of a finance charge. In the statement that came in the mail I saw a lot of violations about payments American Express thinks I have to pay, a fictitious name and address that belongs to my trust estate and not me and according to 18 USC 1342 any fictious name or address and not the proper name or address can result in 5 years in Prison and fined. Also them saying I still need to make payments and how they are going to report my account as delinquent to the consumer reporting agencies can result them in 20 years in prison and fined according to the law 18 USC 894. I am a loving soul created by god and not the state u am not an employee so there is no contract between me and American Express. American Express needs to act as the role of a trustee not benefiary. I am the beneficiary of my trust estate not American Express.

Additionally, these misstatements are punishable as perjury under 18ll U.S.C 1621. The items found within my credit report that I listed on the following pages are not related to any transaction that I made. I am alleging that a person or company -without my authorization- used my personal identifying information to apply for goods, services, or money ; and, was successful in creating some accounts. I have filed a formal report with the federal trade commission which I have attached to this letter. In addition, I have also corresponded with the agencies and Creditors listed. The respective agencies have been very cooperative with me and guided me to the point of taking this step to write you directly. I, XXXX XXXX XXXX, consumer, sentient sovereign and original creditor of an open-end credit plan was denied my right of credit by American Express Company doing business as American Express XXXX I was notified of this transgression of my rights specifically 15 USC 1601- the Truth in Lending Act by American Express Company doing business as American Express on XX/XX/2021 via EMAIL. According to 15 USC 1602 definitions of the Truth in Lending Act, I, as a natural sentient possessing an open-end credit plan was harmed by American Express Company doing business as American Express adverse action was taken against me denying my rights, of which the civil damages pursuant to 15 USC 1640 ( a ) ( 2 ) ( A ) ( iii ) are up to {$5000.00}. American Express Company doing business as American Express is now civilly liable to pay me for the damages.

Consumer Complaint: My company purchased a {$150.00} American Express gift card and provided it to me as a gift. However, when I went to use the card I discovered that someone had already used the card fraudulently to purchase {$120.00} worth of items from XXXX this past Saturday. When I contacted American Express, they said there was nothing they could do about it because their Card Member Agreement states they won't reimburse fraudulent charges because the card is treated as cash and that my only recourse is to file a complaint with XXXX ( where the card was fraudulently used ). I could understand this if the card had been stolen from my possession or opened before I received it. But, I received the card in it's original unopened cardboard packaging which covered up the card number, expiration date, and security code. None of that information was visible until I personally opened the packaging which means that information could NOT have been stolen by someone at the store that sold the card. The card also never left my possession or even my house. Therefore, the card number and related information could have only been stolen when the card was printed or packaged, which makes it an inside job. I did contact XXXX where the card was used fraudulently, but they insist that they can not issue a refund unless American Express registers a dispute over the charges. They claim that if American Express would do that, they will refund the charges to the card. However, American Express refuses to do that claiming they have no way to register a dispute because it's a gift card and not a credit card. I call XXXX. If they can issue a fraud dispute for credit card charges then they can issue them for gift cards because they both use the same XXXX system.
