Under the Fair Debt Collections Practices Act ( FDCPA ), I have the right to request validation of the debt you say I owe you. I have given you 30 days to remedy the situation, which is a very reasonable period. I have received no reply from you, though I did receive confirmation via mail that you did receive my letter. Since you are still reporting this account on my credit report, you are now in violation of the FCPDA, and are now subject to fines of {$1000.00}, which I may collect from you by filing a claim in small claims court. I intend to follow through with the suit if I do not hear back from you within 15 days. You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. Consumer Complaint: I am writing with reference to my XXXX XXXX from XXXX with XXXX XXXX serviced by University Accounting Service LLC, XXXX XXXX XXXX, XXXX, WI XXXX. This loan is being incorrectly reported by XXXX. I have tried to resolve this with XXXX, UAS and XXXX without success. This loan became delinquent in XX/XX/XXXX ( 19 years ago ). About 1.5 years ago, UAS took over servicing of this loan during a merger/acquisition with another student loan servicing entity. In the process, UAS changed the account number on this loan and began to report it as having become delinquent in XXXX. Thus far, XXXX has not responded to my correspondence, while XXXX and UAS responded in form only. When I call to follow up on my written complaints, XXXX insists that they can not do anything and it is all in the hands of UAS. UAS tells me that only the designated account representative can address my concerns, refuses to provide the individual 's contact details, and advises that the individual will contact me directly ( no one has done this over the course of several months ). My most recent written dispute in this matter with XXXX was filed on XX/XX/XXXX. The most recent phone call with them was today, XX/XX/XXXX and I was again informed that UAS continues to maintain on behalf of XXXX XXXX that the reported information concerning the loan 's delinquency status is correct. The original loan amount on this account was {$7500.00}. The outstanding principal since XX/XX/XXXX was unchanged at {$2200.00}. The loan was transferred through consolidation to XXXX on XX/XX/XXXX and is now current. It is my belief that UAS purposely " re-aged '' this loan as a tactic for collecting payment and now does not want to address this, because they have been paid in full through the loan consolidation with XXXX and because they are aware that they have committed an unlawful act by re-aging the loan.

Consumer Complaint: I am an identity theft victim. An identity thief used my personal information without my permission to open XXXX XXXX utility account XXXX XXXX XXXX - XXXX in XXXX, Texas ( please see Discount XXXX Invoice # XXXX on page 3 of the attached XXXX XXXX Police Department Identity Theft Police Report ). Though I have requested it several times, both verbally and in writing, Transworld Systems , Inc. ( TSI, a debt collection agency XXXX has so far neglected to respond to me and to provide me with the records I requested of them relating to an identity-theft-related fraud that was committed in my name. This conduct by TSI is in violation of both the Fair Debt Collection Practices Act and my consumer 's rights under the Fair Credit Reporting Act. I request the CFPB to please contact Transworld Systems , Inc. on my behalf and have TSI perform the actions, and provide me with the records, I am entitled to by law and that I have so far requested of TSI numerous times, both verbally and in writing, to no avail. Chronologically : On XX/XX/XXXX, Transworld Systems , Inc. called me at my home phone number to collect a {$390.00} bill from XXXX XXXX ( a Texas utility company ) alleging that I had incurred this debt while living in XXXX, TX in XX/XX/XXXX. I explained that I have never resided in Texas or even ever been to Texas. I asked, during that call, and on two additional subsequent calls I made to TSI, that TSI please provide me with a validation notice, so that I could use the information provided by it to file a proper police report about this identity-theft-related fraud, and to also be provided with a TSI address where to send my communications and documents required to prove my identity and the identity theft. The TSI representatives I spoke to assured me they would mail me the requested validation notice. However, they never did. As stated at the Office of the Attorney General 's website ( https : //oag.ca.gov/consumers/general/debt-collectors ), the law pertinent to this aspect of debt collection is : " Within five days after a debt collector first contacts you, it must send you a written notice, called a " validation notice, '' that tells you ( 1 ) the amount it thinks you owe, ( 2 ) the name of the creditor, and ( 3 ) how to dispute the debt in writing. '' However, TSI, to this day, has never sent me a validation notice. It should be noted that TSI has placed this fraudulent debt as an overdue collection item on my credit reports at various credit reporting agencies, thus ruining my credit, but so far TSI has never sent me anything at all in written form, and this is not only unethical but also against the law. As a result of this conduct by TSI, I have experienced a very great deal of anxiety ( this is my first time being a victim of identity theft ) and several sleepless nights. On XX/XX/XXXX, I filed a Better Business Bureau complaint against TSI for withholding information needed to properly report this case of ID theft and fraud to law enforcement ( BBB Complaint ID XXXX ). On XX/XX/XXXX, the XXXX XXXXnformed me that TSI had provided XXXX with a copy of the fraudulent bill and with a TSI address where to send my communications to, which were in turn provided to me by the XXXX analyst handling my complaint, so that I could finally file a proper identity theft police report. However, it is to be noted that TSI never responded to me directly or to my complaint at the BBB website, but has so far elected to communicate privately with the BBB analyst handling my complaint. To this day, I have not received a single word in writing that was addressed to me from TSI, despite my numerous requests. On XX/XX/XXXX, XXXX XXXX, the defrauded Texas company, contacted me over the phone and informed me they are dismissing all charges against me, acknowledging this debt a result of identity-theft-related fraud. On XX/XX/XXXX, I sent a certified-mail letter to TSI at the address TSI had provided to the XXXX analyst. According to XXXX tracking information, my letter was received by TSI on XX/XX/XXXX. However, I have so far not received a response to it. In that letter I stated once more that I am a victim of identity theft and provided TSI with copies of : my Federal Trade Commission Identity Theft Report # XXXX, my California driver 's license as proof of identity and the invoice pertinent to the fraudulent utility account. In that letter, I requested TSI, in accordance with the Fair Debt Collection Practices Act, to immediately stop all collection activities about this debt, including reports to credit reporting agencies, and to also inform the business where the account was opened that this debt is the result of identity theft. In that letter, I also enclosed a copy of the Federal Trade Commission 's Notice to Furnishers of Information and stated that this document explains TSI 's responsibilities under the Fair Credit Reporting Act ( FCRA ), and that the FCRA requires that debt collectors give an identity theft victim documents related to an account if the victim asks. I requested TSI to please send me copies of all records relating to the fraudulent account, including : - Account applications made on paper, online, or by telephone - Account statements or invoices - Records of payment or charge slips - Delivery addresses associated with the account - Records of phone numbers used to activate or access the account - Signatures on applications and accounts - Investigators reports I also asked TSI to please send me a letter explaining what TSI has done to : - Inform the business where the account was opened that the debt is the result of identity theft - Stop collection activities against me - Stop reporting information about the debt to credit reporting agencies - If you've already reported the debt to credit reporting agencies, notify them that the debt is the result of identity theft - Provide me with the records I request This letter, which is a standard letter that was provided to me by the Federal Trade Commission as a step to be taken in their Identity Theft Recovery plan, just like my other numerous attempts to communicate with TSI, was never responded to.

I contacted all three credit bureaus for verification and also the collection agency XXXX XXXX XXXX XXXX XXXX about the debt, in return the collection agency sent a list of my medical procedures which they did not have permission to have, nor did they provide a HIPAA release form. Which was a violation of my HIPAA rights, I sent a second letter to the three credit bureaus and the debt collector to notify them of the HIPAA violation, and all three bureaus have past the FCRA 30 day window. Consumer Complaint: I had take a student loan out through my local credit union which was routed through University Accounting Services referred to as UAS from here. I have experience in loans and finance and believe their tactics are predatory. Although through UAS they have several companies like XXXX XXXX and XXXX XXXX. I updated my address with UAS and checked the balances to ensure I was not past due which made sense given I just graduated. After this my father and I received a delequincy notification from the provider. Trying to make this right I called UAS which was the company on the bill saying past due. They informed me that everything was fine and it was likely an issue on the credit scoring company. A month later I get a second delinquency notification. After calling back I found out they weren't looking at both companies they owned and had two separate portals for their loans. Because of this despite calling and trying to pay I was not getting bills to the right address, and it showed now balance in my portal. Having two separate portals and treating them as two separate services is very deceptive in my opinion. As a consumer I am still dealing with this and now have had my credit score dropped over 100 points and have waited 15 days for a response after being told to email the company and complete aforebance form despite multiple follow-ups. The worst part is I have stated multiple times I am fine paying them if I owe money on my loan and set-up monthly payments to ensure there is no issue but I have been meeting with hostility. The company has framed it as my fault I didn't understand they own two separate loan providers despite both being owned by there company. Once XXXX comes if they have not fixed it I will have had a triple month delinquency. This is affecting both my father and I and could very well likely delay my ability to purchase a home due to the massive credit score drop.

On XX/XX/2021 I called Transworld Systems Inc. who is the company that sent this communication to my family member 's address. I spoke to XXXX XXXX, a supervisor. I asked them who consented to them contacting my family member and who authorized them to send them an entire account history? XXXX was unable to find out where they got my family members address from. I notified her that XXXX XXXX XXXX XXXX which is the original creditor has my current information due to a current and pending legal matter I have with them regarding this same debt they are attempting to collect. On XX/XX/2021 I gave Transworld Systems a cease and decist notice and they continued to contact me but this time they sent the communication to a relatives house and not mine.

XX/XX/XXXX - I sent a Verification of Debt letter to TSI vie Priority Certified Mail Tracking # XXXX ( have receipts for this if needed ) XX/XX/XXXX @ XXXX PT- Called XXXX revenue services @ XXXX and spoke with XXXX or XXXX. The rep told me " this is an error and Transworld has been made aware of this known issue ''. " This is 100 % not my invoice or my debt ''. " Transworld has been sending incorrect info to customers ''. Said she would work with her supervisor & other teams to correct. She refused to send me ANYTHING in writing confirming what she was telling me over the phone. XX/XX/XXXX @ XXXX PT- Called TSI @ XXXX and spoke with XXXX XXXX XXXX XXXX stated " this is a billing error and it is not my debt ''. I asked for something in writing to support this even and email and she refused. I asked to speak with supervisor and was then transferred and HUNG UP ON. XX/XX/XXXX @ XXXX PT - Called TSI back and spoke with XXXX XXXX XXXX She was very combative from the start of the call and at first refused to answer my questions. She then put me on hold and when she came back she stated " the file is not coded correctly ''. I asked what that meant and she stated " the file is now coded correctly and will now be sent to management ''. I then asked what that means. She stated " TSI will now work with XXXX and the file should be closed this Thursday XX/XX/XXXX or Friday XX/XX/XXXX ''. I then asked for written proof of this and she refused. She stated " if you want a closure letter you need to pay the debt ''. To which I replied, " NO ITS NOT MY debt!!! '' I then asked to be transferred to a supervisor. The rep said a supervisor was not available. I told her I would wait and she stated " I don't have time for that, you can call back ''. I yelled at her and she hung up on me. XX/XX/XXXX @ XXXX PT - Called TSI back a 3rd time and spoke with XXXX XXXX . I provided him with the file # and he stated " This is a billing error and it has been placed under supervisor review to be cancelled ''. He said " this is a result of XXXX billing issues and 95 % of his calls are due to these ERRORS '' I asked for something in writing confirming this and he stated " i have spoke with my Lead and there is nothing we can legally provide you or send you, not even an email ''. He said the call is recorded and that is my proof. XX/XX/XXXX @ XXXX PT - Called XXXX revenue services and spoke with Sue. She refused to give me any identifying info ( EE ID, last name etc. ). She stated the debt was for {$220.00}. Then stated " one moment while i get this removed ''. I asked why this had happened and she stated " because the ZIP or Address was transposed ''. She stated " this is a billing error and it has been corrected ''. I asked for something in writing to support this and she refused. She stated " our call has been documented under the invoice # ''. There needs to be a inquiry into why XXXX is sending incorrect billing info to a collection agency who then turns around and seeks payment from people WHO OWE NOTHING. At this point it is clear this IS NOT MY debt!!!! All I want is something in writing from one of these companies confirming this.

The caller said they were collecting a debt from an address in XXXX Az, XXXX XXXX XXXX XXXX XXXX XXXX. The debt was from unpaid amount total a little over {$100.00}. The caller who said his name was XXXX and that Transworld was the collections agency for Arizona Public Service. He was calling about an outstanding debt stemming from XX/XX/2020. He asked if he had called ( my name ). I responded yes, for it is my name. At the conclusion of the conversation I hung up the phone with XXXX, and called XXXX. There was indeed a person with the same name, spelled slightly differently, living at that address, but the person 's information did not match my own. It is a common middle eastern name. That individual had verified themselves via passport. I have never lived in XXXX Az.
