Consumer Complaint: In accordance with the Fair Credit Reporting Act. The List of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. I have asked these companies not to display my date of birth, social security number and to display my correct name and address multiple times. And I have blatantly ignored and disregarded each time. I told XXXX, Transunion, and XXXX to reinvestigate these accounts as they are alleged : Account name : # XXXX XXXX. However, they stated everything was complete and accurate. But how is that possible if the open date, date of last activity, payment history, balance, and much more are incorrect? According to 15 USC 1681i ( 5 ) they are supposed to modify accounts by deletion that are violating my rights. that isn't reporting correctly. 15 U.S.C 1681 section 602 A. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions 15 U.S.C 1681c. ( a ) ( 5 ) Section States : no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years.15 U.S.C 1681c. Despite my previous 2 written requests, the unverified items listed below still remain on my credit report in violation of Federal Law. You stated in your responses to my 2 dispute letters that you have verified that the items listed below are accurate but you failed to send me copies of the documents that you used to verify these accounts as per my request. With certified letters stating that you are 100 % sure that the information being reported by you that is 100 % true and accurate, the method that you used, whom supplied the information etc The fact that you have ignored my request to send me copies of the documents that you used to verify the disputed accounts is evidence that you can not and did not verify any of the disputed accounts like you said you did. Your failure to delete the disputed accounts that you can not verify after two written requests is also evidence of your willful disregard of Federal Law. When we go to litigation and through the discovery process you will be required to produce these documents along with an affidavit of truth swearing under oath that these are the true and correct documents that you used to verify the disputed accounts. The fact that you don't have any of the said documents in your files is proof that you did not properly verify the accounts within 30 days as required by law nor submit to me within 5 days the certified process in which you verified such information and the Court will order you to delete them. You say that you have reinvestigated these accounts but you've admitted that all you have done is parroted information given to you by other sources and shifted the burden back to me to contact the original creditor to verify these accounts which is clearly in violation of 1681 ( a ) ( 4 ). I also asked you to give me the name of the person in your company who verified the accuracy of these accounts but you ignored this request as well which is another violation of Federal Law and evidence of your willful disregard of the law. Please be advised that under Section 611 ( 5 ) ( A ) of the FCRA- you are required to ..promptly DELETE all information that can not be verified. '' | request that you do this immediately. The law is very clear as to the Civil liability and the remedy available to me ( Section 616 & 617 ) if you fail to comply with Federal Law. I am a litigious consumer and fully intend on pursuing litigation in this matter to enforce my rights under the FCRA for an allotted amount of each error of $ XXXX I demand that you delete all of the accounts listed above immediately. Please provide me with a copy of an updated and corrected credit report showing that these items have been deleted. your non-compliance with the appropriate regulatory authorities. Consumer Complaint: Re : Violation of Federally Protected Rights to Privacy and Request for Account Deletion Dear Transunion, I received your response to my initial dispute with what I believe is a stall letter, an illegal practice. These letters have been logged with the CFPB. I am who I say I am and have submitted proof of identification address with my first dispute letters. I am sending clear proof once again of who I say I am and you WILL follow my instructions in regards to the handling of my personal information and data that you are furnishing incorrectly on my report. I will be suing our company for negligence and non willful compliance for the maximum allowable by law under 15 USC 1692k. I am writing in regards to several violations made by your company in relation to my consumer report. Your company has broken the law and violated my federally protected consumer rights. I under oath to God depose the following facts : Fact : Transunion does not have permissible purpose according to 15 USC 1681b ( a ) and has violated my federally protected rights. Fact : Transunion has violated my rights under 15 USC 1681d- Disclosure of investigative reports and has not given any explanation or proof as to why the disputed items remain on my report. This company has claimed to have completed investigations but has not reached out to any person and has not spoken to ANY INDIVIDUAL OR COMPANY regarding the validity of the data on my reports. THIS IS ILLEGAL! ( a ) Disclosure of fact of preparation A person may not procure or cause to be prepared an investigative consumer report on any consumer unless ( 1 ) it is clearly and accurately disclosed to the consumer that an investigative consumer report including information as to his character, general reputation, personal characteristics, and mode of living, whichever are applicable, may be made, and such disclosure ( A ) is made in a writing mailed, or otherwise delivered, to the consumer, not later than three days after the date on which the report was first requested, and ( B ) includes a statement informing the consumer of his right to request the additional disclosures provided for under subsection ( b ) of this section and the written summary of the rights of the consumer prepared pursuant to section 1681g ( c ) of this title ; Fact : Transunion has violated my rights under 15 USC 1681C-2 ( a ) by not respecting my initial requests to block information after submission and proof of identity theft on XX/XX/XXXXXXXX XXXX XXXX Fact : Transunion has violated my rights as a United States consumer and my RIGHT TO RESCIND under 15 USC 1681C-2 ( c ) the accounts listed below from XX/XX/XXXX XXXX XXXX Transunion has not investigated anything on my report and has not provided any proof of correspondence with any creditor or bank regarding my account as is the LAW.
