( a ) ( 5 ) Section States : no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

Consumer Complaint: This new claim is in regard to TransUnion 's response to claim XXXX. TransUnion 's response to claim XXXX reflects that the problem was not clearly understood by TransUnion. In speaking with the CFPB representative, they indicated that the best way to handle this confusion was to issue a new claim and try to better explain the problem. So the below is a summary of TransUnion 's previous response, the correct dispute, the problem and the action requested to solve the problem. TransUnion Response : Your response indicates that you think I'm disputing information in my report ; you further indicate that the information ( dispute ) is not currently on my TransUnion credit report. The confusion is that I'm not disputing information on my report ; I am disputing an entire account that should be reflected on my report and it isn't. The dispute is incorrectly categorized and incorrectly understood. What could be contributing to the confusion is that the CFPB system requires me to select a dispute category and there isn't a category that accurately reflects my problem. The closest CFPB category is " Incorrect information on your report '' but this is WRONG because as I stated earlier my dispute this is about an account that is NOT currently on my account at all and it should be. Situation ( Dispute ) : I have had this XXXX XXXX credit card account for over XX/XX/XXXX years. XXXX XXXX is a major creditor and should be reported on my credit report. Transunion is not currently reporting my XXXX XXXX account on my credit report ; although, you did report it in the past. In Summary, my dispute is that my entire " XXXX XXXX Account is NOT reported at all but should be reported with the maximum number of reporting years. Problem/Cause : My XXXX XXXX account is not shown on my TransUnion Credit report XXXX and it SHOULD be. XXXX XXXX has informed me that they have continually transmitted my account data to TransUnion every month and this data SHOULD BE ON MY REPORT. I'm told by Transunion supervisors that my XXXX XXXX account information is in your systems, but the account is in suppressed status and that is keeping it from showing on my credit report. In speaking with the Transunion supervisors, they were able pulled up my account data in the Transunion system and verify receipt of the most recent account balance data. The Transunion supervisor ( XXXX XXXX XXXX ) told me that a note on the account indicated that Transunion received a message years ago that the account did not belong to the owner. This is an ERROR ; I am the sole owner of this account and has been since it was opened in XXXX. I have never told Transunion that this is not my account. Also, in my discussion with XXXX XXXX, they have never told Transunion that this is not my account. The account was suppressed from my credit report due to this ERROR. TransUnion supervisor, XXXX XXXX XXXX, told me that in order to get my XXXX XXXX account re-instated on my TransUnion report that I should send TransUnion a letter of verification from XXXX XXXX which was mail to TransUnion on XX/XX/XXXX ( see attached document : XXXX XXXX XXXX ). Action required to solve problem : Please reinstate my XXXX XXXX account so that the account is reflected on my TransUnion credit report. As I've stated, I am told by the TransUnion representative supervisor that the account needs to be unsuppressed. I'm not sure if un-suppressing the account is the only corrective action necessary to get my XXXX XXXX account re-instated on my TransUnion credit report, but I look to TransUnion to research and figure out exactly what needs to be done to report my XXXX account and reach out to XXXX XXXX or myself if additional information is needed. XXXX XXXX is currently transmitting the monthly data, they have re-inserted the account, have contacted you to verify my account ownership, and they have issued a written document verifying my ownership of the account ( see attached document : XXXX XXXX XXXX ). Also, I have attached the full comprehensive set of action taken thus far with TransUnion since XXXX to get this issue resolve but have been unsuccessful ( See attached document [ save as a zip file due to CFPB file size limitations but was issued in earlier claim XXXX ] : XXXX TransUnion Issue Letter to Federal Agency and TU ) Again, Please Re-instate my American Account so that it is reflected on my Transunion credit report.
