Consumer Complaint: I received a copy of my credit report and found the following items to be reported in error I requested the bureaus to do an investigation on the accounts below for accuracy accounts came back verified I do not believe an investigation was done because its no way the accounts would come back verified as accurate due to the large discrepancies and information mismatch highlighted in the attached documents. This is the final request for account deletion my privacy has been violated this is direct violation of my consumer rights as outline by the FCRA I will be requesting {$1000.00} in damages due to failure of investigation please re-investigate and remove these accounts!! I found improper inaccuracies on the reports even after they did the thorough verification. By the provision of the fair credit reporting act I demand these items be investigated and removed from my credit report it is my understanding that you will reverify these accounts with the creditor that posted them. Please remove any information that the creditor can not verify I understand that under 15 U.S.C section 1681 ( i ) a you must complete this reinvestigation within 30 days of the receipt of this letter.These entries are in violation of my consumer rights under federal and state laws. Inaccurate Reporting : I have reason to believe that the reporting of this charge-off and collection is inaccurate, and I have not been provided with sufficient proof of the debt 's validity or any prior validation, as required by the FDCPA. Lack of Verification : The debt was never properly validated as required by the FDCPA. As a consumer, I have the right to demand validation of a debt before it is reported on my credit report or pursued for collection. Discrepancies in Reporting : The entries on my credit report are inconsistent with the legal requirements of the FCRA and FDCPA, as they do not provide a clear and accurate account of the debt. As defined by the IRS ; Even if you didnt receive a Form 1099-C, you must report canceled debt as a gross income on your tax return. The IRS clearly defines a charge-off as Gross or Ordinary income, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which in fact makes your reporting of this account inaccurate! By Definition The IRS clearly says a Canceled debt or Charge off is Income. The reporting of this account as a debt is inaccurate. 15 U.S. Code 1681s2 Says you are a furnisher of information to a consumer reporting agency. You ARE PROHIBITED BY LAW to furnish inaccurate information. I demand you to CEASE and DESIST the reporting of incorrect/in accurate information immediately. I REQUEST THAT YOU PROVIDE ME VERIFICATION OF THIS ALLEGED DEBT. VERIFICATION CONSISTS OF ALL DOCUMENTS LISTED UNDER REGULATION F 1006.18 ( e ) PROOF THAT THIS ALLEGED DEBT BELONGS TO ME, A FORMAL DECLARATION IN WHERE YOU SWEAR TO THE TRUTHS OF THE STATEMENTS OF THE FACTS OF THE MATTER, HAVE FIRST-HAND KNOWLEDGE AND MUST BE NOTARIZED. The lender must file Form 1099-C and send you a copy if the amount of debt canceled is {$600.00} or more and the lender is a financial institution, credit union , federal government agency, or other applicable entity as discussed earlier in chapter 1. **The above paragraph is taken directly from the IRS 2021 publication. ** 15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of furnishers of information to provide accurate information ( 1 ) Prohibition ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate ; and ( ii ) the information is, in fact, inaccurate. Duty : a moral or legal obligation ; a responsibility. Accurate : correct in all details ; exact Prohibition : a law or regulation forbidding something. 15 U.S.C 1681 Section 604 A Section 2 : it also states a consumer reporting agency can not furnish a account without my written instructions. 15 U.S. Code 1681a- Definitions ; rules of construction- Exclusions.-Except as provided in paragraph the term " consumer report '' does not include any report containing information solely as to transactions or experiences between the consumer and the person making the report ; 15 U.S.C 1666B : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for purpose. I kindly request that the inaccurate charge-off and collection entries be promptly investigated and removed in accordance with the FCRA, FDCPA, and all relevant consumer protection laws.It is my understanding that per 15 USC 1681 ( a ) ( 2 ) ( A ) ( I ), my consumer report should not contain Information solely as to transactions or experiences between the consumer ( me ) and the person ( you ) making the report. Payment history and the late payments associated with payment history negatively impacts my consumer report and are considered as part of my transactions and experiences between your company and me. Furthermore, I am requesting that you provide me with, in writing. the reasonable procedures ( according to 15 USC 1666 ( b ) ) that you have adopted to ensure that each periodic statement is mailed to me ( the consumer ) not later than 21 days before the payment due date. The accounts listed above have multiple inaccuracies that must be verified items such as Account type, account status, date opened etc are reporting dates and amounts incorrectly between the bureaus. Consumer reporting agencies shall not furnish incorrect information unverified from creditor these accounts must be deleted this is defamation to my character I have attached a copy of the report and highlighted the many inaccuracies on the accounts listed above. In conclusion I have shown you and you have been put on notice that you are reporting Inaccurate information. The information is, in fact, inaccurate. The continued reporting of this INACCURATE information is a clear violation of the Law 15 USC 1681 s-2 of your responsibilities as a furnisher of information. You have caused me and my family severe harm due to your negligence and INACCURATE reporting. This is a final opportunity to Cure and DELETE this Erroneous, inaccurate account from my Consumer report. If this continues, I will have no choice but to take legal action due to the immense stress this has caused me.
