Consumer Complaint: I am writing to express my concern regarding the unauthorized reporting of my personal information and that of my cosigner. I recently became aware that our information has been reported to my credit without our explicit consent. As you should be aware, The Privacy Act of 1974, as amended, specifically under 5 U.S.C. 552a, establishes a code of fair information practices governing the collection, maintenance, use, and dissemination of information about individuals maintained in systems of records by federal agencies. A system of records refers to a group of records under the control of an agency from which information is retrieved by the name of the individual or by some identifier assigned to the individual. Additionally, our rights are protected under the Family Educational Rights and Privacy Act ( FERPA ), as outlined in 20 U.S. Code 1232g. This legislation ensures certain conditions for the availability of funds to educational agencies or institutions, and it guarantees individuals the right to inspect and review their education records. Any disclosure of these records without proper authorization is a violation of our privacy rights. The Privacy Act of 1974, as amended, 5 U.S.C. 552a, establishes a code of fair information practices that governs the collection, maintenance, use, and dissemination of information about individuals that is maintained in systems of records by federal agencies. A system of records is a group of records under the control of an agency from which information is retrieved by the name of the individual or by some identifier assigned to the individual.
