In compliance with the Fair Credit Reporting Act and as a gesture of respect to the Federal Trade Commission Committee on accuracy and completeness of credit information I am formally writing in today to dispute negative information appearing on my credit. This incorrect information is greatly hindering me from getting the credit score I deserve and hopefully, this letter will resolve all the issues on my credit. Consumer Complaint: When a debt is sold to a third party, that is considered a certificate of indebtedness. The cancellation of a debt means it is income and it is against the law to report income on credit reports/credit profiles. Please immediately remove all of the discharged/charged-off accounts from my credit report. Yet XXXX is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of companies compliance. Provide me with the compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. These companies and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211 : Application For Award For Original Information Overview with the Internal Revenue Service against ALL entities involved In addition : According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, TransUnion and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states, " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX, TransUnion and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, TransUnion ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to file a formal complaint against Transunion and XXXX XXXX XXXX XXXX XXXX XXXX XXXX for their failure to comply with the Fair Credit Reporting Act ( FCRA ) in relation to the reporting and subsequent dispute handling of my credit information. Despite multiple disputes, specifically submitted on XXXX and XXXX the trade line for XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Account Number XXXX, continues to be inaccurately reported on my credit report maintained by Transunion. This trade line fails to reflect the original 180 days late status and has remained on my credit report beyond the period allowed by the FCRA, specifically 7 years and 180 days from the date of the first delinquency. I also called XXXX XXXX XXXX XXXX directly, however the phone listed for contact on my credit report is disconnected. Furthermore, the persistent inaccuracy of this trade line and the refusal to correct or delete it after ample notification severely undermines the integrity of my credit report and significantly impacts my financial well-being. This situation represents a clear violation of the FCRA, which mandates the reporting of accurate and complete credit information and prescribes specific timeframes for negative information to remain on a consumers credit report. My repeated attempts to resolve this matter directly with Transunion and XXXX XXXX XXXX XXXX XXXX XXXX XXXX have been met with inadequate responses and a failure to take corrective action as required by law. Enclosed with this letter, please find copies of the disputes submitted, correspondence received in response, and any other relevant documentation illustrating my attempts to rectify this issue and the non-compliance of the involved parties. This also violated 15 USC 1681s-2 ( a ) & ( b ), 15 USC 168i ( 5 ) ( A ) ( i ) & ( ii ). At This point I believe they are doing this on purpose according to 15 USC 1681e ( b ). Whenever a consumer reporting agency prepared consumer report shall follow reasonable procedure to assure maximum possible accuracy of information concern in the individual about whom the report relates.
