Consumer Complaint: I am filing this valid complaint against the City of XXXX Az. for willful failure to comply with the federal Fair Credit Reporting Act ( XXXX ) administered by the FTC. The XXXX XXXX. is in serious violation of the Federal Fair Credit Reporting Act and has no intention of correcting their actions. For the past XXXX months I had been a candidate for the entry level position of Crime Scene Specialist. I was offered Conditional Employment in mid XX/XX/XXXX by XXXX XXXX Supervisors, pending the required background check. Unfortunately, the Det. ( E. Quals ) assigned to do the background check failed me and has refused to provide to me any reason whatsoever for the failure, thus denying me Merit based employment. Whenever a credit reporting agency is used to conduct a background check, the Federal FCRA requires the reason for a failed background check be disclosed to the applicant. Quals used a credit reporting agency. This required Disclosure has put the City of XXXX in direct violation of the Federal Fair Credit Reporting Act. For the past three months I have been complaining to City of XXXX Mgmt. personnel through E-mails and telephone calls, requesting XXXX reasoning for her Neglectful decision, with no results from XXXX XXXX managers. I've sent XXXX XXXX Mails complaining to Phoenix Assist City Mgr. XXXX XXXX ( XXXX & XXXX XXXX ) ; her only response was referring the matter to Phoenix City Atty . XXXX XXXX. On XX/XX/XXXX I received an XXXX Mail from Atty. XXXX, Falsely stating her office is not required to comply with the FCRA. On XXXX I E-mailed Atty. XXXX attaching an XXXX sheet from the FTC mandating the FCRA requirements. The requirements ( Pre Adverse Action Notice ) include providing me with a copy of the Background Report, a summary of my rights, and info. concerning the credit reporting XXXX. No response from City Atty XXXX. None of these XXXX XXXX XXXX were complied with by the XXXX of XXXX despite my repeated attempts to obtain them. In addition, on XX/XX/XXXX I E-mailed XXXX XXXX XXXX XXXX requesting corrective action be taken ; no response from her. Also, on XX/XX/XXXX I sent an E-mail of complaint to XXXX XXXX XXXX. XXXX XXXX ; also no response. Please process this 100 % genuine complaint ASAP. I have all the E Mails referenced above plus some others.
