Consumer Complaint: I have a mortgage with select portfolio services # XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX UT XXXX I have asked for help during covid, and bc I suddenly become XXXX XXXX XXXX XXXX for weeks, then unable to return to work right away. So I requested a forbearance, but received instead a referral. What u thought would be 3 months not having to pay, then they'd put the 3 months owed onto the back of the loan allowing me 3 mo to get on my feet, and to start fresh after 3 mo are up. But I got instead a balloon pymnt owed after 3 mo which in no way I had the amount of money. So they had me apply for a modification, which I did everything required, signed and faxed papers on XX/XX/1922 and paid XXXX for 3 mo, if I did these we qualify for mod. I received letter saying I qualified, and was paying monthly per required amount. Then suddenly they kept calling every other day, even drove by my home took pics sent letters said I was in default. I called everytime requested why they were calling stated that I had followed all required, and received letters stating that I qualified for the loan. The agents would look to see why calling, confused most times and said all looked fine, I even had 1 agent tell me to ignore the calls, but being they drove by again taking pics I felt uncomfortable doing this. So again I called said what I was told by previous agent, and they researched why, then said that we didn't have sufficient amount of flood insurance which made no sense at all. We are covered up to XXXX in flood coverage, our mortg is only XXXX so why we didn't have enough confused me. Either way I asked how much do I need to increase it to in order to qualify, bc now they are saying we no longer qualify for the mod unless we increase the flood by XX/XX/XXXX I think it was? Well everytime I asked by how much I must increase it, no one knew, they said they would ask and call back but when call back they didn't know how much still? I finally had my insurance agent call their agents and she too struggled in calling she was extremely frustrated by how little they knew and the many places they sent her to, we finally together through 3 way calling figured out how much to increase it by, we did increase it to the fullest, but it was past the date requested.. I explained their confusion with me, and why its past the required date. The agent said she make note of why, and again told not to worry. But then again I received a default, and they now say I never was approved, they now say they never received signed papers which I faxed, and has repeatedly mentioned when I called asking why they're calling and never once in my calling them did they ever once tell me they never received the sign papers. They accuse me said it's my fault bc I chose to handle flood issues I said you never told me there were other issues, they blame me and rewuired me to sgain fill out an app for modify all over again. I was in tears! I feel like no matter what I do they'll find a reason to deny me, that same day they made me fill another app I received papers in the mail saying I'm approved for mod, but every date is wrong the years are all off? Please I beg you help me I feel they're trying to steal my home it's all very suspicious. I always approve recording so there's a record of my truth in all of this. Please listen to my recordings they have in file as far back as when I began this I think in XXXX? Thank you for helping me.

In review of our records, the adjusters worksheet for wind damage funds in the amount of {$18000.00} was received and accepted on XX/XX/XXXX. '' my response : SPServicing is flat out lying!! I submitted the adjuster 's worksheet for the wind damage on XX/XX/XXXX!! I have proof of that!! Let me know if CFPB would like to see my proof!! it comes from their own website!! Management of SPS and XXXX XXXX is flat out lying!! see attached PDF file!! I submitted the adjuster 's worksheet on XX/XX/XXXX!!! They Claim : " An inspection with XXXX has been ordered on XX/XX/XXXX. You also mentioned that the flood and wind claims should be treated separate. Due to the date of loss being XX/XX/XXXX, for XXXX damage, wind and flood funds are monitored as one. '' my response : THIS IS YOUR CHOICE AND YOU SHOULD COMMUNICATE THIS TO THE BORROWERS YOU ARE SERVICING!! They claim : " Please note that a voicemail was left for you on XX/XX/XXXX, requesting that you return call to XXXX XXXX ( Loss Drafts Department ) at XXXX " My responses : " AND I DID CALL HER BACK AND LEFT A VOICE MAIL FOR HER ON HER EXTENSION XXXX ON XXXX, XXXX AND XX/XX/XXXX AND SHE NEVER CALLED ME BACK!! AGAIN, YOU ARE LYING TO COVER XXXX!!

Consumer Complaint: At Select Servicing Portfolio we went on a COVID 19 forbearance plan. When it ended they demanded a lump sum to make up for the plan. I applied for assistance through their assistance program and they denied it for a modification with no explanation as how they arrived at their decision. Our housing counselor reviewed the response and helped us with the appeal. We asked for specific information about how they came to their denial. We are not asking for a principal/interest reduction only that payments resume as they were before the forbearance. Also one thing I noticed is that they have our income at {$1300.00} per month but we estimated about {$2400.00} per month in income. That could be the reason it is being denied.

Consumer Complaint: Select Portfolio Servicing is the mortgage company. -The seller of the home is the personal representative for the Estate. -Home was sold on XX/XX/XXXX through XXXX XXXX XXXX XXXX XXXX XXXX XXXX -Payoff quote valid until XX/XX/XXXX of {$92000.00} was provided by SPS to XXXX XXXX XXXX on XX/XX/XXXX. The correct amount of mortgage payoff funds were received by SPS on XX/XX/XXXX, following sale of the mortgaged property. XXXX XX/XX/XXXX, SPS accidently issued a check to XXXX XXXX for taxes. The check amount was {$2500.00}. XXXX XXXX issued a refund to SPS on XX/XX/XXXX because the taxes were paid during the closing of the house on XX/XX/XXXX. - Subsequently, SPS erroneously issued the estate a check in the amount of {$2800.00} on XX/XX/XXXX - The estate cashed the check - The personal representative contacted SPS in XXXX of XXXX after receiving multiple Mortgage Statements and notice that SPS was purchasing home insurance for the house. - The personal representative contacted SPS 3 times for an account review. - The first account review determined that there was a mistake and that they should not have issued the Escrow Check and determined that a value of {$2400.00} should be issued to SPS to close out the account. This was on XX/XX/XXXX. The letter does not specify the type of check or what date that check needed to be submitted by. - That requested amount was sent in to SPS ; check was cashed by SPS on XX/XX/XXXX and credited to the mortgage account. - SPS has failed to release the lien on the home.

Consumer Complaint: I applied for a modification and on XXXX/XXXX/2023 SPS sent me a letter saying my application was incomplete because it was missing the RMA with hardship letter and a Short Payoff offer. I was told to submit the needed information by XXXX/XXXX/2023, so I submitted the missing information on XXXX/XXXX/2023 ( I have attached proof of both items being uploaded before the required date ). Despite making the information available on time ( even before it was due ). SPS sent me one letter on XXXX/XXXX/2023, saying I did not submit the information and my application is still not complete. In this letter they give me another opportunity to send this information ( that I already submitted ) by XXXX/XXXX/2023. but may still foreclosure on me any time after XXXX/XXXX/2023. The very next day SPS sent a letter saying they could not assist me because they did not receive an answer from me. I am appealing this because they most definitely received an answer and all of the information they requested. In the meantime, I will not be surprised to receive another scheduled foreclosure date because they almost always send confusing, conflicting information and still move forward with scheduling a foreclosure sale. I am attaching each of the letters sent by SPS and proof that the requested information was submitted in time.

I am in total agreement with the client. I myself XXXX XXXX is willing to pay a affordable rate of the XXXX. I am unable to pay the XXXX that is being requested. Consumer Complaint: During COVID ( job loss ) received a forebearance but made payments ( not full amount but whatever I could ) loan amt $ XXXX is interest only adjustable rate. Found out that Servicer automated payment system should not have allowed meto make the random payments but did and all funds were put in an escrow bucket.On XX/XX/ 2022 recd letter stating there was a deficient balance of {$27000.00}. XXXX XXXX, 2022, escrow analysis showing refund due of {$18000.00}. On XXXX XXXX, 2022 I recieived repayment agreement increasing my monthly interest only payments from {$11000.00} to {$2300.00}. XXXX XXXX, 2022, sent a reply requesting a repayment more agreeable to my financial situation as this amount will create a deeper financial hardship. Denied. Was unable to make 2 of these payments ( XXXX and XX/XX/2022 ). Late XX/XX/2022 involved in HIT and Run was hospitalized left me unable to function could not work. Not at my current postion a year denied FMLA. Contacted lender to request help with my payment agreement due to my injuries, advised that the agreement must go into default and then I can request another one but no guarantee and if I do default then COVID protection of foreclosingwill no longer be active.

SPS has yet to return the unearned interest that is owed to me from my mortgage being paid off in full 15 years early pursuant to 15 USC 1615. They claimed that they gave me what was owed but that is inaccurate ; what SPS is referring to is a return on an overpayment for homeowners insurance. To be clear, I am demanding they return my unearned interest due to me from my home loan being paid off 15 years early. I demand the unearned discount ( unearned interest ) due to me from paying off the mortgage 15 years early.

Consumer Complaint: Today is XX/XX/XXXX, and again, I have not receive my year-end statement, also known as IRS tax form 1098 for the year XXXX, from Select Portfolio Servicing, as required by law. However, on XX/XX/XXXX Select Portfolio did take the time to submit fraudulent documents were my signature and initials were forged, copied and pasted to fraudulent documents. Select Portfolio Service also has not posted my XX/XX/XXXX payment as required by law. This is a common practice of Select Portfolio Servicing. Select Portfolio Service also stated that CFPB was sent the same fraudulent documents XX/XX/XXXX that was sent to me.
