Consumer Complaint: My property at XXXX XXXX XXXX XXXX, XXXX, Tn XXXX was vandalized back in XXXX, I filed an insurance claim with XXXX XXXX. XXXX sent the insurance check to XXXX XXXX XXXX on XXXX/XXXX/XXXX or XXXX. I was also in the process of doing a loan modification on the house because my brother moved out and I could not pay the mortgage for that property and also the property where I reside currently. Needless to say, XXXX XXXX XXXX never gave me the check for the repairs. Soon after, they sold the mortgage to Select Portfolio. I tried to sale the property and when I got a contract, codes ended up demolishing the property before my closing date. Now, there is no property ... but I still get mortgage payment requests, calls from SPS, my credit over the years has been destroyed and now I have a lien against the lot for the demolition! I do not know what to do at this point! The mortgage company will not foreclose, they will not allow me to surrender keys, I can not file a chapter XXXX at this time either. I am seeking guidance on what direction to take to file suit against the parties that caused this adverse affect on my life. SPS were made aware of the demolition at lease 90 days prior to it happening and they were also aware of the insurance money being held for repairs! I tried for years to get the money with no success so that I could make repairs and put a renter in there to start paying the mortgage! XXXX I told them I would be seeking counsel, they sent me forms informing me that I should get a quote from a contractor for repairs in an amount close to {$9000.00}. This was after the property was demolished. Please help me!!

Consumer Complaint: To whom it may concern : I have lived in the XXXX Arizona area since XXXX. I bought my home in XXXX XXXX in XXXX. This home means so much to me since it was my project to have it built from the ground up after a very emotional, messy divorce. I have endured many hardships from that point to now, but I still love my home and I do n't want to lose it. Unfortunately, I might because my lender is trying to foreclose on me. My home is scheduled to be sold on XXXX XXXX, XXXX!!! I did have my loan modified in XXXX, but the payment came out too high. From that point on, I have not trusted my lender or the modification process. I struggled but I made those mortgage payments until I started having medical issues in XXXX. I eventually had a XXXX in XXXX. I missed a lot of time at work and had to pay a lot of out-of-pocket expenses ( co-pays and deductibles ). I finally defaulted on the mortgage at the end of XX/XX/XXXX. Because of my poor experience with the last modification, I had no trust in trying by myself to get my loan modified again. I hired a law firm to help, but they got nowhere in dealing with this. I am a XXXX. I 've been in this industry for XXXX years, certified for the last XXXX years. When I went back to work after my XXXX, I had to deal with a lot of XXXX. I was falling further and further behind on my mortgage since any payment I sent would not be accepted, and I was n't getting anywhere with the modification process. That led to me being diagnosed with XXXX in XXXX of XXXX. I immediately had XXXX again and then XXXX in XXXX of XXXX. I hope to remain in XXXX now, and I 'd like to now solve my mortgage issue. I have not been assigned a single point of contact nor have I been offered any sort of assistance or repayment plan to get my payments on track. I believe that my loan fits squarely within government guidelines. I do n't need nor do I want a handout or anything that I do n't deserve. All I want is a little assistance in getting a loan modification that lowers the payment to a level that is sustainable moving forward. My financial future looks bright and I hope to be past my medical issues. I do n't anticipate having any financial issues moving forward if I can get this resolved reasonably. Consumer Complaint: I have lived in the XXXX County area most of my life, and I want to continue to live here and do so in my home. I have seen many good times, and recently I 've seen rough times. Unfortunately, I may be forced out of my home by my mortgage note holder, Select Portfolio Servicing ( SPS ), since they have been uncooperative and even deceptive when I try to work out a solution with them. My hardship began in XXXX when unfortunately my father passed away and 8 months later my daughter ran away from home. This emotional turmoil tore my family apart, and then my XXXX collapsed in XXXX. In XXXX, my husband and I got divorced ; and to top it off, I even lost my beloved dog in XXXX as well. The combination of all these events is what caused me to fall behind on my mortgage. When this run of unfortunate events began in XXXX, I reached out for help and was offered a rather unfair trial modification. I decided to go forward with in order to keep my home, but I was denied for a permanent modification once I completed the trial period due to missing documents that I had submitted many times to them. They kept making me start over with the process using the same reasoning for denial ( missing documents ), always taking my payments for three months before telling me they could n't move forward and that I had to start over. This continued for 3 years (!!! ) until they told me my arrears were now too high and I did n't qualify for assistance. It appears to me that this was their plan all along ... they had no interest in helping me, they just wanted to take my home away via foreclosure. I have being denied access to options that are supposed to be made available. They deceived me, lied to me, and frankly, stole from me while I was acting in good faith!!!!!!! Furthermore, I have serious issues with my property value. My property 's present value is below {$600000.00}, which is disturbing when you consider the purchase price we paid was {$1000000.00} with a {$90000.00} down payment. Plus, I 'm in what could be considered a predatory loan. I was somewhat forced into a 3-Year ARM with a high interest rate when I was looking for a 30-Year Fixed Rate loan. If I could get SPS to handle this fairly, I 'm sure I would be able to keep my home and make good on my mortgage. I do n't want or need a handout, but considering my financial recovery I am certain that there is a solution that I could qualify for. Is n't that what all this bailout money ( my tax money!! ) passed down from the government to these banks was for? Are n't these modification programs designed for people who had a hardship ( or in my case many hardships ) and have recovered and just need a little assistance restructuring their mortgage in order to move forward? I want Select Portfolio Servicing to stop the foreclosure process, review my loan in earnest for retention options, and stop playing games that prevent this problem from being solved.

Consumer Complaint: In the Memorandums of evidence attached, you will find a timeline reflecting the amount of time wasted in trying to communicate with XXXX and Select Portfolio Servicing XXXX Inc. ( SPS ). Additionally, there is a breach in contract due to the fact that neither XXXX nor Select Portfolio Servicing, Inc. ( SPS ) honored the Loan Modification promised, although taking the payment for the loan modification account AND a judge approving that the loan modification contract should be upheld ( also attached ). We believe that XXXX willfully denied the modification ( after contact signature and taking payments ) and transferred the loan to Select Portfolio Servicing XXXX Inc. ( SPS ) within 24 hours after the denial so that they would not have to face consequences. Furthermore more, willful negligence is purported on Select Portfolio Servicing, Inc. ( SPS ) as they did not even give a reason for the breach of contract until XXXX 2015, 150 days after they received the notification of transferal. Additionally, both XXXX and Select Portfolio Servicing , Inc. ( SPS ) is refusing to uphold a judge 's ruling to honor the loan modification as well as refusing to honor the loan modification contract itself. Therefore, we are charging your company with the following acts : Unfair Business Practices : These XXXX banks are using the bankruptcy process to push homeowners into foreclosure ( XXXX vs Select Portfolio Servicing , Inc. formerly known as XXXX XXXX XXXX Performance of Deceptive business practices ( misleading me regarding true reason of loan denial ) Breach of Contract : refusal to adhere to judge 's ruling and refusal to acknowledge the loanmodification contract that was signed and sent back Intentional/Negligent infliction of emotional distress : intentionally and negligently withholdinginformation of the true reason of denial for 3+ months Predatory lending strategies : trying to force a new loan modification procedure/application while not upholding previous contract

Consumer Complaint: Select portfolio servicing bought our mortgage about 7 years ago and I recently started noticing that there were extra charges on there besides late charges. They keep telling me that they are charges they do n't have to explain to me so I requested my loan information from the time we bought the house. I have asked twice now and they will only send me the last 7 years stating they do n't have to show me any paperwork from when they bought the loan or copies of any charges that have accrued ... .In XXXX I paid them XXXX house payments at which time they said I was still XXXX behind so in XXXX sent another XXXX plus extra for late charges. What I do n't get is in 15 years of having this mortgage they claim my payoff is still the original amount of the loan I just do n't think that could be right. Please help as we are still at almost an 11 % interest rate too!

NOW THAT I AM JUST ABOUT READY TO CLOSE THE TRANSACTION, I HAVE BEEN INFORMED THAT THE INTERNAL REVENUE SERVICE NEEDS A LITTLE MORE TIME TO PROCESS A PARTIAL LIEN RELEASE ( FOR MY HUSBAND XXXX ). THIS RELEASE IS NEEDED PRIOR TO CLOSE. IT IS ESTIMATED.THAT I MAY NEED AN EXTENSION FROM MY SERVICER TO XXXX XXXXXX/XX/2015. Servicer still has not responded and has gone well beyond the 15 days requested. In addition, when I requested a mortgage assistance package I was told by a representative of the servicer that I would not be allowed to apply for assistance. Instead of responding to the Qualified Written Request or allowing me to apply for mortgage assistance, the servicer has scheduled a foreclosure sale. This is the preferred method of offering assistance with my servicer - Select Portfolio Servicing.
