Consumer Complaint: this began when XXXX told me the only way they could modify my mortgage was for me to be behind on my pymnts. This was back in XXXX. The loan person said that if I would miss XXXX payments, then I could apply for a modification, and they would then be able to help me.. But as long as I was current, they could not modify my loan. So, i missed the XXXX payments they told me to, and applied for the modification. I did everything they told me to do,, The paperwork was incredible,, and I have submitted XXXX times,, re- submitted,, re-supplied " lost documents '' to them,, they have given me nothing but a complete run around. Now, as of XXXX XXXX, they transferred me to SPS..I was assured by SPS that they would get the modification done quickly and effectively,, and they apologized about what XXXX had put us through,. Ok, It is no different with SPS.. they have asked over and over again for the same documentation,, and I have provided it. The only thing I can say is that SPS allows me to submit via e mail,, and that helps a lot,, it also gives me proof that they received the documents. It is much better than faxing over and over again. So, the amount of money they say I am behind is incorrect. The payment when it was with XXXX was figured wrong for about XXXX months, becuase XXXX messed up my escrow analysis. XXXX wrote me in XXXX of XXXX telling me finally, that they had messed up my payment amt,, and that I was correct, and that my payment was not {$1500.00} per mo,, but it was {$1000.00} per mo,, then,, they transferred it to SPS,, and sps is using the incorrect amt of {$1500.00} too.. Even thought hey can clearly see my statements from XXXX,,, and even the sps statements show the XXXX amt.. ok,, it has now been XXXX months with no modification. PLease help me.. This has ruined my credit,, I was at a XXXX credit score when this began,, the hardship lasted XXXX year,, we can make normal payments,, my credit score has gone down to XXXX because of this XXXX.. and clear violation of my rights. They are running rough-shod all over me,, and no one will listen.. We are good people.. I am not leaving my home,, my mom XXXX in this house,, I raised my XXXX boys in our house,, I just want a modification.. Now, they say that they need XXXX more months of bank statements. that the last batch I sent them, the underwriters could not decipher the income on the deposits.. even thought the deposit amounts match the XXXX income statements exactly. We are XXXX employed, ,have been for XXXX years.. have good income,, all our tax returns are in order, ,they have them all,, This is our primary home,, I am begging for you to help me, XXXX My files on XXXX and SPS are over XXXX " thick XXXX. I have kept all correspondence.. they have not filed foreclosure ... .they are asking me if we have a copy of the note,, they can not find it.

Consumer Complaint: TO WHOM IT MAY CONCERN : I am writing in response to recent conversations with Select Portfolio Servicing, XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX, XXXX and XXXX XXXX, XXXX. For the past XXXX years, I have been in dispute with SPS regarding a Foreclosure Action that commenced in XXXX, at which time XXXX was the Servicer. SPS has adamantly refuted that a foreclosure action previously occurred and the foreclosure action did not commence until they initiated the action, XXXX XXXX. There are numerous phone calls, discussions far and in between the past month. I spoke to XXXX XXXX of Select Portfolio Servicing Advocacy Department, XXXX XXXX, XXXX. XXXX XXXX advised that she would be sending out a response letter stating that SPSs position remains the same regarding the on-going dispute that a foreclosure action occurred in XXXX. XXXX XXXX also asked what my intentions were with the property and questioned why I was not evicted if the property was already foreclosed upon. For more than two years SPS has denied knowledge of the mortgage servicing deficiencies that were unresolved prior to XXXX XXXX XXXX transferring the servicing rights to SPS, XXXX XXXX. Yet, SPS and its third party Attorney, XXXX XXXX XXXX, formerly known as XXXX XXXX XXXX, now known as XXXX XXXX XXXX attested to having full knowledge of the information filed with the XXXX Courts XXXX XXXX XXXX, Maryland and Maryland XXXX XXXX. I am vexed at SPSs repeated failure to acknowledge my inquiries and questions regarding the unresolved mortgage servicing deficiencies that were initiated at the commencement of the foreclosure action in XXXX, which resulted in the purchase of the property XXXX XXXX, XXXX, by the alleged secured party, XXXX Bank, XXXX, NA, Trustee for XXXX XXXX XXXX Mortgage XXXX XXXX, XXXX XXXX. The trust is in fact governed by New York XXXX XXXX. At the time of the commencement of the foreclosure action the note had not been assigned to the trust. In fact, the note was transferred to the securitized trust XXXX XXXX, prior to XXXX XXXX XXXX transferring servicing to SPS, XXXX XXXX.

Consumer Complaint: In XXXX of XXXX, my spouse and I purchased a home in XXXX XXXX through XXXX XXXX from XXXX XXXX XXXX XXXX We have since been informed by HUD that our neighborhood was targeted for high risk loans. XXXX XXXX refused to deal with any other financier than XXXX XXXX. We refinanced our home in the XX/XX/XXXX, only to have our {$10000.00} cash to be used to pay off other bills seized by the IRS ( I can tell you where the agent lives who threatened us because of my spouses XXXX XXXX XXXX XXXX for XXXX XXXX students and their families against several XXXX school districts, particularly the ones in XXXX County. Feel free to call and interview us! ) Our ARM was set at maximum rate ( cited to be " as allowed by our government. " ). In XXXX XXXX, XXXX took over XXXX XXXX. In XXXX, because of student and parent loan garnishments ( 15 % of our total income ), we approached XXXX to attempt a refinance. They kept losing our paperwork, and repeatedly told us we earned just a bit too much to qualify. In the meantime, after about a year of XXXX repeatedly telling us " your documents have been lost, '' we hired a XXXX attorney to handle our situation with XXXX. We failed to make payments under his direction. After paying him his fee, we were notified by the XXXX State Attorney General 's office of the indictment and conviction of our Attorney. XXXX refused to allow payments to resume. In XXXX, XXXX 's XXXX XXXX, represented by Director, XXXX XXXX, agreed to help us through Mediation on our home loan. We continue to be stuck in mediation with Select Portfolio Services, contracted by XXXX XXXX XXXX XXXX XXXX. It was n't until XXXX sent notice and mortgage documentation of having turned over our loan to SPS, in tiny print on the documents, I noticed that the primary holder of the loan was XXXX XXXX. Prior to that time, we had no knowledge of this. Nearly three years into this mediation process that we entered with XXXX, turned over to SPS, we are now being told we owe our principal due since XXXX ( {$190000.00} ), plus the {$76000.00} financial fees related to the past 2 plus years ( assuming they forgot to subtract the principal that was included in the {$76000.00} from the principal to which they continue to cite ), due immediately! Over the course of these three years we have submitted innumerable refinance applications ( copies stored in a large box, but too numerous to attach ). We have been told by XXXX and SPS repeatedly that our " paperwork has been lost, please start again. '' Sometimes they just want more new copies of supporting documents to be submitted, dates varying between before and after mediation meetings. SPS never sounds prepared for the mediation meetings. Again, SPS has offered to sell us our home for the {$270000.00} with {$10000.00} as a down payment, interest rate continuing to be " as high as our government will allow. '' In the meantime, my husband is declared ( since XXXX XXXX ) to have XXXX XXXX and I am recently racked with a work related injury ( I am a XXXX carrying about XXXX lbs. of test kit materials XXXX times a week for XXXX Public School XXXX XXXX Department to my XXXX assigned buildings - another case for some government agency to investigate, for sure. ). Believe it or not, XXXX Public Schools has just asked me to take time off from my job without pay as I enter therapy when I have over XXXX hours of sick leave that should more than cover my time off. We need help with Select Portfolio Services and their contracted companions, XXXX XXXX and XXXX XXXX. Please contact XXXX XXXX for supporting information. I am happy to work with any investigation procedures. We could write a book about the corruption of the power holders, based on real events.

Consumer Complaint: Sps has wrongfully taken my home. Naca was informed on XXXX XXXX that my property had no sale date. The sps rep advised this information directly to Naca via a phone call. Sps dropped the ball not advising to myself or Naca that the attorney handling foreclosure advised that the sale date could not be postponed due to timing. Please advise to me why the sale date for the XXXX was moved??? All of this happening why my file was being reviewed with sps as well as mailed notifications that the file was under review with no notification that sale date was not able to be modified sps has the ability to retract the sale that took place today XXXX.

Consumer Complaint: My home has been under the short sale program for several months with SPS, we have presented several offers to this company and all have come back being denied, my property needs repairs, we have been working with a buyer for several weeks that has spent time and money to prepare a bid for repairs for this lender. The value set on my property is for fair market value and my agent has been working to have the value properly reflect the repairs needed. Throughout this process we are all being told by SPS that my property did not have a sale date even though XXXX is publicized for XXXX XXXX XXXX, XX/XX/2015 at XXXX. As of today I am still having communication problems with having SPS advise their trustee that the sale scheduled for my property on Monday is on hold. They are trying to foreclose on me instead of working with my agent to sell my house. SPS has mislead us for several weeks and has lied many times by advising my agent that there is no sale date and that all is being worked on. When indeed there is a sale date and per their trustee it is active.

Consumer Complaint: We have been working or a Short Sale for Select Portfolio Servicing for a Loan for XXXX Bank Loan No. XXXX for XXXX XXXX at XXXX XXXX XXXX, XXXX, Florida XXXX. We had an approval letter that expired on XXXX/XXXX/2015 we asked for an extension on XXXX/XXXX/2015 with a credit toward closing cost and provided how the roof has no life left and the plumbing needs to be all re done. We were told on XXXX/XXXX/2015 that it would be XXXX business days. Then we were today XXXX business days. We were contacted by a lady named XXXX from XXXX on XXXX/XXXX/2015 asking for changes to the HUD and saying we should have approval by Friday XXXX/XXXX/2015. We called each day and then on Friday we called and were told by XXXX XXXX at EX XXXX that a manager would contact us by XXXX EST. Ofcourse, this did not happen, we called back to be told by XXXX XXXX a Manager that the file for extension was declined on XXXX and that us resubmitting on XXXX/XXXX/2015 is too close to the short sale date of XXXX/XXXX/2015. I have had many files with XXXX and know this is how they do this. I advised them on a recorded line that they were going to pull this game. This is not working for the homeowners or for the best interest of the economy. You have a ready willing and able buyer to purchase a run down property and make it habitable and the Banks are not willing to proceed. The Offer on this property is XXXX with a Net to the Bank XXXX XXXX on a Loan amount of XXXX. I would say the numbers work on this.

Consumer Complaint: I contacted Select Portfolio, my mortgage servicing company, in order the obtain a letter entailing the amount I need for reinstatement to avoid eminent foreclosure. They sent a letter of reinstatement, but it did not state that this amount was the amount needed to avoid eminent foreclosure. When I contacted them to inform them of this, they related that they do n't write letters of this nature. They also stated that they are not in the processing of foreclosure upon my property, but 'in litigation '. I was confused. " Foreclosure is the legal process in which a bank or other secured creditor sells or repossesses a parcel of real property after the owner has failed to comply with an agreement between the lender and borrower called a 'mortgate ' or 'deed of trust ' ". Since they are in the process of trying to force a sale of my house through the courts, and represent XXXX bank, how can they say that I am not in danger of eminent foreclosure? They further directed me to make a payment immediately. I am unsure where that payment would go nor am I sure it would be used to avoid eminent foreclosure. I am in the process of getting help to work with the bank, but they do n't seem interested in working with me. They said all of our conversations are recorded, so there should be no discrepancy as to each conversation that transpired.

Consumer Complaint: The PremisesThe Adjustable Rate Note on the subject loan is dated XX/XX/XXXX. The parties are XXXX, the borrower and XXXX XXXX XXXX XXXX XXXX, the originating lender. The Deed ofTrust dated on the same date. The parties are the borrower, XXXX XXXX, the co-borrower, the originating lender, MERS, which is named as nominee for the lender and beneficiary, andXXXX XXXX XXXX XXXX, the trustee. The subject loan has been securitized into XXXX XXXX Loan Trust XXXX. ThePooling and Servicing Agreement of the mentioned trust requires that the Adjustable RateNote should be endorsed by XXXX XXXX XXXX XXXX XXXX, the originating lender and sellerto XXXX, XXXX, the depositor and by the depositor to XXXX, the trustee. Consequently, the Deed of Trust should have been assigned by the originating lender and tothe depositor and by the depositor to the trustee. The chain of endorsements and assignments are also set to be followed in order qualify thetrust as a XXXX under the Internal Revenue Code. The mortgaged property has been foreclosed in favor of XXXX XXXX, XXXX XX/XX/XXXX The Note must be endorsed properly when the Security Instrument has been assigned. If thisdoes not occur, there is a separation of the security instrument from the debt instrument. Separation violates Paragraph 20, a XXXX XXXX in the Security Instrument contract. Additionally, any instance in which a successor trustee has been designated, but noThe Main Issues1. The subject loan was securitized. However, there were no documents to show thecompliance of the series of endorsements and assignments that:1.1. are required by the Pooling and Servicing Agreement ; and1.2. each constitutes a true sale from the originating lender to the seller, from the sellerto the depositor, and from the depositor to the trustee in order to ( a ) qualify thetrust as a XXXX and ( b ) give the trust the status of a holder in due course that wouldprotect it against adverse claims from the loan 's originator. 2. There is prima facie evidence that the signatures on the Assignment of Deed ofTrust and Substitution of Trustee have been forged. 3. No document was presented in this examination or recorded in the Voluntary LiensReport which shows that the trustee representing in foreclosure has been duly appointed. Consumer Complaint: This company, Select Portfolio Servicing , Inc ( SPS ) is a mortgage loan servicer. The company calls our phone number, a cell phone as early as XXXX in the morning repeatedly. We have asked them to stop XXXX times. We have been patenbtly clear they are calling early. They claim since the phone they 're calling has a XXXX area code ( time-zone difference ) they do not have to stop. Even though all our account information including the mortgage property address is in California and always has been. On occasion they apologize and say they 'll resolve the issue. They do not/have not resolved it. Occasionally SPS is combative and claim no responsibility to solve the problem. We need to communicate on that phone but not before XXXX.
