Consumer Complaint: I am the owner of XXXX XXXX XXXX, XXXX, NC XXXX. I bought the property in XXXX and paid as agreed until the endof XXXX. Due to personal and economic problems, I could notkeep up with payments to Select Portfolio Servicing XXXX XXXX XXXX. Both Deed of Trust were obtained at the timeof my purchase. These Companies are the current servicingcompanies that this complaint is all about. I gave up with XXXX XXXX even though they are chargingme a current rate of 12.5 % interest. They are impossible totalk to on the phone. Harassment is the only descriptionthat can define this company. I have gotten well over XXXXcalls, even on Sundays per year. It should show in their records. I had worked with SELECT PORFOLIO SERVICING to obtain anadjustment of the current interest rate of 8.5 % but I wasnever able to get a positive response. I decided to ask for aDeed In Lieu due to the fact that SPS has gotten appraisalsand XXXX to find the current market value, I bought the property at {$85000.00}. Today it is reported that is worth no more than {$40000.00}. Since I stopped payments, interest and penalties has adadded up to over {$96000.00}! After months of paperwork, In XXXX XXXX, I was told by SPSthat the STATUS of my account was at a Title search stage. Every single conversation with SPS has my permission to berecorded. Within days from that phone call, I received a letterfrom SPS denying my request for a Deed In Lieu due to lack ofsent by me. Since then I have copies of faxes sent to SPSshowing information as per request, yet I receive letters almostdaily, from SPS. My stack of papers is now over XXXX inches thick. I have been to court XXXX already for a foreclosure hearing. XXXX it has been reschedule because I showed the courtpapers to prove my case for the Deed In Lieu. Next courtdate if XXXX XXXX, XXXX. I have proof that SPS is very wellaware of this date. I do not know what else I can do to make SPS to have theunderwriter do his/her job and finish what was startedover a year ago. I just send a package to multiple parties asking for help toresolve this situation. NOTE - The home is not in bad condition. It can easily beupgraded for very low investment and it must appraise ata value of at least {$70000.00}! I know, I am able to get CMAwhich is a Comprehensive Market Value from the MultipleListing Service that REALTORS use. SPS is practicing business in an incompetent manner. This situation could have been completed to the satisfactionof the Investor holding the Deed of Trust and SPS. A family could be living in this house for a very low price andall parties could have saved time, money and aggravation.

Consumer Complaint: The servicing of my mortgage was transferred from XXXX toSelect Portfolio Servicing at the beginning of XXXX 2015. I attempted inXX/XX/XXXX, to make my XXXX mortgage payment online, but was unable toaccess my account information. I contacted SPS 's customer service andthe gentleman who answered the call was also unable to access myaccount information. I was told they were a really large servicing companyand it takes time to load all the loans they purchased??!! Was this their firsttime uploading loans to their system? I did as I was instructed and waited untilXXXX XXXX to log into my account and to my surprise my account informationwas available. I logged in set up an account, placed my checking accountinformation into the system, to see a message I was going to be assessed a {$15.00} check by phone fee to make an XXXX time, on time regular mortgagepayment?!!! Working in the financial and mortgage servicing industry for thelast 13 years I know for a fact it costs pennies to process check by phonepayments. Consumer 's should not be charged outrageous fees to processregular on time mortgage payments. I am not delinquent, I am not having arepresentative process the payment, I did all the work, now automation takes over .... and I have to pay for the companies automation? I never had to pay afee with XXXX and since consumers can not choose who their servicingcompany is, I feel it is unethical for the new company to charge for servicesthe prior servicer did n't charge for. After calling in a talking to a servicingrepresentative at SPS, I got the run around before even getting the feewaived. I should n't have to pay {$15.00} for the company 's incompetence. Mortgage servicing companies are necessary for processing payments, dealing with the escrows, ect. but since the consumer can not shop aroundand make the choice about who services their mortgage loan, the servicingcompanies should not be able to charge customers for making onetimepayments online.

Consumer Complaint: We have had several problems with them ( Select portfolio servicing center ) over the years but the most recent problem is we were trying to get a Home mortification done, and we have started atleast XXXX of them. I have made my payments on time then after the trial period is up then start sending our checks back uncashed and start foreclosure again. Have many fees unexplained. We have had nothing but trouble from them in the last XXXX.

Consumer Complaint: It is with great frustration that I write for the XXXX time to you. I have also done everything in my power to complied with SPS Servicing co. This is the XXXX time Sps confirms receipt of my documents and when I call again they are requesting same documents again. My attorney on record submitted a motion and it was just denied. Please hear me out. I want to resolved this problem. I am going through this for the past two and a half years. I want to keep my home. I went a head and did a forensic review. Apparently XXXX XXXX bankrupt and my note was in the bankruptcy. Where do I go from here? All I want is for SPS to come on with a loan modification.

Consumer Complaint: I am requesting a qualifying review of my mortgage as I am confused by the calculations surrounding my mortgage which was in XX/XX/XXXX modified by my lender under the HAMP modification program. Recently home was appraised and surprisingly is significantly under water with the mortgage. Subsequently no lender will accept my loan and so I can not get loan refinanced. Please request a qualifying review of my mortgage and provide a complete response as to all fees, interest and how they were applied. After paying loan since XX/XX/XXXX when loan was originated and for over XXXX years on time since my modification, I still seem to owe more than what the original loan was for {$430000.00}. Prior to my modification my loan was only XXXX months behind and was payed on time except for the XXXX months I was? behind the fees assessed then made my loan even more behind forcing the bank to file foreclosure on property .I have since managed to make all payments but now I am stuck cant sell the home or refinance the home due to my loan being severly under water even after paying over {$200000.00} since modification.

To Whom it may concern, Our loan is owned by XXXX, Until XXXX of last year we were being serviced by XXXX, do to circumstances beyond our control, we have had a few rough years starting with my health, in 2010 I had to have XXXX XXXX, ending up with me having to apply for XXXX. My husbands company in which he has worked for over XXXX years, was sold and under reconstruction he lost income there, my parents both died in XXXX months of each other and there was no insurance, we had to help pay funeral cost, these circumstances made it difficult for us to maintain a mortgage payment of XXXX. Last XXXX XXXX offered us a modification trial which brought our payment down to XXXX we have had no problem making this payment. and made XXXX in a row. After we made our XXXX payment to XXXX, we were switched to .Select Portfolio, we have had such a difficult time dealing with this company never get to speak to the same person XXXX, they assigned us an account person an til this date never spoke with .or if you leave a message, do n't return any calls. So they sent us a letter from XXXX saying they were n't going to honor our trial, a letter which we never received. I called XXXX and they stated that the offer was not declined and XXXX should be finalizing the agreement. I have a letter stating if we make XXXX payments of XXXX we would be permanently have that payment, XXXX even sent us a XXXX write off and XXXX company did n't honor that either. Why would XXXX send us a wrote off if they were n't going to honor the trial. XXXX told us we had to apply for your in house modification, in which we did and it has been very difficult, I have faxed it at least XXXX different times and even register mailed it, each and every time, I was told something was missing, even when I sent the registered letter, someone told me they did n't receive it, and I had the computer in front of me and I had to say someone signed for it, ( That 's funny I have proof that someone in your company signed for it ), I was put on hold and then told yeah we got it page XXXX is missing. When we finally received paper work from them instead of offering us a modification, their expecting us to pay 3000.00 a month, to catch up back payments not honoring the XXXX straight payments we made, their trying to say were XXXX behind if you subtract the payments we made it would n't be that much, along with the paper work was an application for short sale, they even had our home apprised which gave rental value of the house instead of market value, also on the paper work our income is n't correct, they have us making more then we actually make, I feel instead of helping us maintain our home, XXXX is trying to either foreclosed on us, or do a short sale it, do n't want to help us at all. . . Consumer Complaint: To Whom It May Concern, I 'm filing this grievance against Select Portfolio Servicing ( SPS ) for failure to record new terms to my loan with XXXX XXXX County records. A loan modification is a permanent change to the loan terms and I 'm seeking to reduce the possibility of future issues in the event that my loan is transferred to a new servicer. Primarily I 'm concern here is the fact that I 'm reassuming a debt that was previously discharged in XX/XX/XXXX prior to completion of a loan modification on XX/XX/XXXX. Per the California Bill of Rights it is required that lenders record loan modifications. A recent decision by the XXXX Circuit Court of Appeals underscores the critical importance of timely recordation of mortgage interests and the ineffectiveness of the " earmarking '' and " contemporaneous exchange for new value '' defenses in the face of the strict timing rules set forth in section 547 ( e ) ( 2 ) of the Bankruptcy Code. Lenders should take note of a XXXX Circuit decision earlier this year in which the Court of Appeals highlighted the importance of timely perfection of security interests and mortgages. Rejecting XXXX defenses commonly raised in preference actions, the Court of Appeals held that a lender who takes more than 30 days to perfect a mortgage interest in real property XXXX have that interest voided in a mortgagor 's bankruptcy case if the perfection occurred within the 90 days preceding the bankruptcy filing of the mortgagor. I 'm seeking assistance and demand that SPS immediately record my new terms accordingly.

Consumer Complaint: I have XXXX complaints regarding ( SPS ) Select Portfolio Servicing, Inc. * I will explain my XXXX complaint : I have been approved to enter into a trial period plan under the Home Affordable Modification Program since XXXX XXXX, 2015. My XXXX trial payment was sent and received in a timely manner which was due on XXXX XXXX, 2015. But SPS did not handle my XXXX trial payment correctly. They are making it look as if I am late or did not pay at all. It seems as though someone is deliberately working against me. I made sure to get the payment in on time and was advised by my relationship manager, XXXX XXXX to get it to them a week earlier by XXXX XXXX, 2015. I wired it on XXXX XXXX, and it was received on XXXX XXXX. Whenever I called the company about anything thereafter, both the automated system and the persons I spoke with always confirmed that my XXXX XXXX, 2015 payment had been received and that my next payment would be due on XXXX XXXX, 2015. So I felt satisfied that my payment had been received on time. This is how I found out that my XXXX XXXX, 2015 payment was handled incorrectly : yesterday on XXXX XXXX, I decided to call SPS because I had not heard from them regarding my payment confirmation in writing and for giving them the consent to deduct from my checking account for XXXX XXXX and XXXX XXXX 2015. Well, the person i spoke with, XXXX XXXX, could n't find my payment records, I was placed on hold for a long time, then she asked me " how much did I pay? '' I was flabbergasted! Did n't know what to think!. I asked to speak with my relationship manager but she did not transfer me. XXXX XXXX proceeded to inform me that the payment was handled incorrectly and that she would send a note to the Loan Dept. to see if they could change it and asked me to call back in XXXX to XXXX business days. *This is my XXXX complaint : SPS is refusing to assist me in getting my XXXX repaired. I sent the insurance check to them to be endorsed and they wo n't release the funds. I have had no acknowledgement in writing nor by phone that the check was received or their plans for keeping it, neither any explaination of whether they are going to help with the repairs or not. My XXXX is in desperate need of repairing. I had a storm damage 2 years ago and I filed a claim with my Home Owners Insurance Company. They sent me a check to get it fixed. I had to endorse it first and then send it to my mortgage company ( SPS ) to get their endorsement before it could be cashed. I was expecting them to return it to me to be cashed or do whatever needed to be done to start the procedure in repairing my XXXX. But I never heard back from them. So I got concerned and contacted them. SPS told me that they could not release the funds because of the status of my loan. I really need help in repairing my XXXX. There is a bad leak in the XXXX and XXXX. The XXXX is growing and is not good for my XXXX. The damage is getting worse and worser. Every time it rains I have to put a swimming pool under the leak to catch the water. And now the damage is extending into the living room.

Consumer Complaint: In XX/XX/XXXX I was told by XXXX XXXX XXXX that I was approved for a trial modification. In XX/XX/XXXX received a foreclosure sales date. The sales date was removed and my loan was transferred to Select Portfolio Servicing , inc in XX/XX/XXXX. Select Portfolio Servicing, Inc. stated that they did not have any record of the trial modification being offered and that I would have to submit a new modification package. I have submitted modification packages every XXXX months for the last XXXX years. Every occasion I am told that I am denied for incomplete information. In XX/XX/XXXX I was told that I no longer qualified for any home retention options. Because I was offered a trial modification and defaulted. I was never offered a trial modification. I was told that my only options were a short sales or deed in lieu. I choose to do a short sales and submitted paper work within the stated time frame. A sales date for XX/XX/XXXX was scheduled before I was giving notice that the short sale was denied. I contacted HOPE hotline and an investigation was opened. Because of this the foreclosure sales date was postponed. As a result Select Portfolio servicing offered a deed of lieu. I mailed the documents that were required to start the deed of lieu. The next day I received notice that my property was to be sold at foreclosure sale on XX/XX/XXXX. I contact Select Portfolio Servicing in regards to the foreclosure sale and was told because the sales date was so close that it would not be possible to do a deed of lieu. After reading countless horror stories from consumers about the treatment that they have received from SPS, I felt my situation would have a better ending. I have done everything within my power to get an affordable modification on my property. But, I have only received lie after lie. So I am filing this complaint on the grounds of LOAN MOD RUN-AROUND, DENIAL OF INFORMATION, AND LIES ABOUT AVAILABLE OPTIONS, and DUAL TRACKING OF LOAN MODIFICATION AND FORECLOSURE.

Consumer Complaint: I had lost my job several years ago and was unable to make my mortgage payments. I am XXXX years old. We tried to request loan modification but we were denied because I do n't have sufficient income. I only earn social security income. The mediation was denied in XXXX 2014. Foreclosure sale was scheduled for sometime in XXXX 2014 so I needed to do a BK XXXX. The debt was discharged. there was a junior lien with XXXX and also the XXXX. I have continued to receive correspondence from SPS that does not pertain to my particular situation. Since I was not approved for HAMP or HARP I moved out of my condo. I have continued to receive notices and when I call they say the account has been referred to an attorney. in XXXX I sent SPS all the information they needed including fax numbers and addresses for the junior liens because I wanted them to do a Deed in Lieu. SPS never did anything about it. Today i finally spoke with someone at SPS called XXXX XXXX ( XXXX ) who said things could have been handled better and that mistakes have been made with uploading my documents to their system. This delay has caused my deed in lieu to be delayed and so I continue to be harassed by correspondence that does not relate to my situation. the resolution to this account should be deed in lieu or foreclosure but they continue to send me notices that I owe money. this has caused me stress and I have moved out of the condo and just want to have my name off the deed so i can move on. sps had the sheriff knocking at my door so i moved out in XXXX and now they are still harassing me. at XXXX i can not live this way. i want them to do their job and continue with the deed in lieu and stop harrassing me. sps noted that they didn not handle my account correctly and did not upload the documents i sent them correctly which caused them to send me more and more threatening letters. i need this to stop.
