Consumer Complaint: I started a loan modification with XXXX XXXX in 2011 which was supposed to combine a XXXX & XXXX. I was making payment under a trial period until they qualified me for the modification. XXXX months into the process they sold the loan to XXXX after 9 month of making payments which never reduced my principle balance and also they reported me late during the time I was making the agreed payments. SLS service called me and said they were starting foreclosure because I had n't made a payment in 9 months. I hired an attorney and all they agreed to do was start another modification. I agreed because I was afraid of losing my home.I was told I 'd only have XXXX mortgage so I assumed when XXXX sold the serving it included both the XXXX and XXXX because they were differing XXXX of the {$26000.00} I owed on the XXXX. Now the loan has been transferred once again to SPS and they are stating the deferred amount is {$24000.00} which is {$10000.00} more than I agreed to in the signed loan modification agreement with XXXX. My rate is 7 % so I 'm trying to refinance my loan with a lender I know. I 've been told I have XXXX liens against my property and XXXX of them was a XXXX from XXXX. I requested my note from SPS over 45 days ago and they still have n't provided it. XXXX reported to the credit bureaus ' that the original XXXX was paid and closed that is why I thought it was transfer to SLS and was the deferred portion of my current payoff. How can they do this? Say it 's paid and closed and refuse to provide me with a lien release. They are holding me hostage so I 'm not able to refinance to a lower rate. My complaint involves XXXX companies XXXX ( original lender ), XXXX ( XXXX servicer of my loan and loan modification provider ), SPS ( current servicer of my note which they have refused to provide in a timely manner and have added XXXX to the deferred portion of my payoff, which was not supposed to collect interest.

An offer was obtained within XXXX of bank 's asking price, to further move this matter along my office requested reduction in all Closing costs to maximize the amount being received by the bank. We keep getting denied stating that investor guidelines are not being followed with no clarification. IN A LETTER DATED XXXX XXXX, 2015 SPS REQUESTS ADDITIONAL DOCUMENTS FROM ME AND IN THIS LETTER THEY PROVIDE A XXXX/XXXX/2015 DEADLINE. IN ANOTHER LETTER DATED XXXX/XXXX/2015, SPS NOTIFIES ME THAT THEY HAVE SCHEDULED A FORECLOSURE SALE FOR XXXX/XXXX/2015. ON XXXX XXXX, 2015 IN A PHONE CONVERSATION WITH SPS, A REQUEST WAS MADE THAT SPS RETRACT THE LETTER NOTING THE SALE DATE IN WRITING VIA EMAIL. THAT EMAIL OR RETRACTION HAS NOT BEEN RECEIVED. SPS IS ENGAGED IN DUAL TRACKING AND PREFERS TO PROFIT FROM THIS METHOD. THEY PRESENT A FACADE OF HELPFULNESS SO THAT THEY CURE LURE HOMEOWNERS INTO FORECLOSURES.

Consumer Complaint: I am trying to do a short sale on my home in order to avoid a foreclosure, at this point I along with my realtor have done everything that Select Portfolio Servicing " SPS '' asked of us. We got a cash offer for XXXX. SPS 's XXXX. shows non comparable properties that are located in a different and more expensive neighborhood " my house is the second largest in my neighborhood '', which are XXXX TO XXXX above value. My realtor who has over fifteen years experience in this area sent comparable examples in the same neighborhood showing the accurate value, but these have been ignored. There is a foreclosure sale date scheduled for XXXX XXXX. I received a letter from SPS dated XXXX XXXX stating I would have an answer in fifteen business days which is today XXXX XXXX. My realtor speaking on my behalf called them today to inquire as to they 're decision, they said we would be told by the end of the month. When we mentioned to them that we would be contacting the CFPB they said we would have an answer by next Wednesday " XXXX XXXX ''. At this point I fear that SPS will turn down the short sale in retaliation to my complaint. Please help me to resolve this matter so that the buyer does n't walk, and I do n't have my house foreclosed. Thank you.

Consumer Complaint: On XXXX XXXX, XXXX XXXX XXXX XXXX who was servicing our mortgage loan XXXX sent us a letter indicating that we had to purchase flood insurance. In response to this letter we visited the XXXX of XXXX office to verify is our property located at XXXX XXXX XXXX XXXX had been classified or considered to be in a flood zone. They said no. We proceeded to contact XXXX who informed us that if we did not purchase flood insurance we would be in violation in terms of our mortgage loan. We then proceeded to purchase flood insurance. During this period of time we were under Chapter XXXX Bankruptcy Protection Case XXXX yet XXXX failed to notify Bankruptcy Court of a new added requirement that was neither part of the Chapter XXXX Confirmed Plan or part of our initial mortgage loan obligation. In XXXX XXXX we received a letter from US District of Oregon notifying us of a class action suite Case No. XXXX : XXXX identifying us of victims of flood insurance fraud. It was claimed that XXXX ( XXXX ) violated the legal rights of its consumer requiring them to purchase excessive amount of flood insurance coverage and by arranging for improper kickbacks for itself and/or its affiliates ( including in the form of commissions in connection with forced-placed flood insurance. Our mortgage loan was transferred from XXXX to SPS Portfolio Servicing on XXXX XXXX, XXXX. On XXXX XXXX, XXXX we received a similar letter from SPS Portfolio claiming that we had to purchase yet again another fraudulent flood insurance coverage. Our SPS loan number is XXXX. We remain protected under US Bankruptcy Chapter XXXX yet SPS has also failed to obtain approval and notify bankruptcy court of a forced insurance coverage that was neither part of our original mortgage loan or part of the confirmed Chapter XXXX Plan. Consumer Complaint: I contacted Select Portfolio LLC ( who have held my original mortgage for 9 years ) to try and refinance through the HARP LOAN process. This request was to be completed within 3 months. I am a XXXX and had some trouble keeping a " stable '' job for a little over 2 years. During this time, Select Portfolio lowered my payments ( to {$820.00} ) while I was pursuing a career in XXXX and XXXX at XXXX College and XXXX College ( XXXX ). After completing the schools, Select Portfolio resumed my original note payment of {$1500.00} per month. I also have a {$190.00} per month HOA payment. I can not make these payments ( even though I rent to XXXX person for {$400.00} per month ). I now have a ''stable '' job ( also Oil Royalties averaging {$600.00} per month ) and know I could make loan payments of {$1000.00} per month plus my HOA payment. I have been making {$1500.00} payments for the last 9 months at the original rate of 8.3 %. Select Portfolio has stated over the telephone to me and my accountant that the information requested would complete the loan application and that they could let us know within 5 business days of theoutcome of the HARP loan applied for. They requested more information after making these statements XXXX different times. The continual lack of honest communication concerning my loan has affected my mental health. Select Portfolio also calls and uses abusive techniques concerning my monthly payments. I have withheld my XX/XX/XXXX payment because of the handling of my HARP loan. My credit score is poor and I do not know why they continue asking for more current information and processing this loan if, in fact, I do n't qualify. This continued pursuit of this loan is showing a complete lack of good faith.

Consumer Complaint: I was with XXXX prior to my mortgage being sold amost at the end of their modification and they sold my account to Select Portfolio Servicing. In doing so the modification had to start over from scratch. I did have a problem paying my mortgage ( due to loss of income through divorce with XXXX ), and received assistance from the XXXX program ( a third party ), but was never late. XXXX informed me by them being involved sending part of my payment I would not be accountable for any lateness on my payments, because I was always current with the part I paid ; they did recieve the full mortage payment. This would apply also through XXXX and until the modification was completed. By XXXX selling the mortgage just before the modification was completed, and me being at the end of the program starting over ; I had to go into an agreement with Select Portfolo to avoid foreclosure while their modification was in process. I was to pay an amount agreed upon, until it was completed. It was n't the full amount, but it was accepted and an agreement was in place, and that amount was never late. Now I am sited with 120days late on my mortgage, after all that was agreed upon. My modification is now in place and I have been current with my payments since the modification XXXX of 2015. I think this is unfair and if there is someone that can possible help me with this, it will truly be appreciated. Originally the loan was a ( ARM ) mortgage.

Consumer Complaint: Back in XX/XX/XXXX I got very ill ( i 'm a XXXX ) lost my job and my family was helping me pay my mortgage and bills. I got a modification offer letter from my bank offering to modify my current negative amortization loan for a stable loan with low monthly payment and for the current value of the property. I called XXXX XXXX XXXX my mortgagor and I was told that i would not qualify unless i 'm behind on payments for my mortgage. I had a perfect credit with XXXX scores which took me years to build and now I had to default in order to save my house. So per XXXX XXXX XXXX 's advise I did ... .I have been trying to modify my current existing neg am mortgage with my bank- XXXX XXXX XXXX for the past 4 years now. My current loan amount is over XXXX and my appraised value of the property is not even XXXX. Select portfolio services a note servicer for XXXX XXXX XXXX served me with a notice of default in XX/XX/XXXX. I applied for mediation in XXXX. I got approved for a reverse mortgage in the amount of XXXX and we sent in a pay off offer for XXXX for the current loan. SPS declined the pay off offer and countered us to send in a new pay off offer for the amount of XXXX which we did. Then they declined that offer as well, did a new appraisal and are demanding the full pay off for the current note which is XXXX. The property is over 50 % under value, I currently have a negative amortization loan which is going up every month. My house is a full rebuilt from fire has several structural defects and bank keeps asking me to resend documentations to them over and over. I 'm XXXX years old on ssi low income, my house is all I have left and keeping with with reverse mortgage would be only option for me. SPS now is asking me to send them a new pay off offer, new financial statement, new bank statements, new ssi award letter .... I have been faxing them a full set of documents as they request for the past 2 years now. It takes them 2-3 months to review and they get back to me stating that I need to send in a different pay off offer letter XXXX last XXXX I sent was for XXXX and they countered me to send them a pay off offer for XXXX AND a new set of bank statements, XXXX award letter and etc, because what they have in the file is now over 2 months old. I feel like this is a formality and nobody really cares or gives me a clear answer on what needs to be done to either modify or refinance this loan. I 'm very exhausted and now since they denied the last pay off offer through mediation which was for the exact amount that they requested, I now have an " important notice '' from the supreme court of NV stating that they will issue a certificate of foreclosure on or about XXXX XXXX ... PLEASE HELP ME! I DO N'T WANT TO GO HOMELESS AT MY AGE AND CONDITION!

Consumer Complaint: homeowner was delinquent on their loan and were protected by a C XXXX homeowners did not understand the XXXX process, they paid the XXXX plan payment but did not make their regular payments outside the XXXX plan to their lender. during this time the lender did not seek relief and allowed the homeowner to complete the XXXX plan. In XX/XX/XXXX we asked for a modification and SELECT PORTFOLIO SERVICING sent a packet and agreed to look at the client 's financial for a modification review. from XX/XX/XXXX through XX/XX/XXXX we have submitted, resubmitted the same documents over and over and have answered the same questions again and again. the client has enough verifiable income to modify the loan. SPS has been dragging their feet and lying to the client and to the housing counselor on a monthly basis. this is clearly servicer abuse and ignorance on the lender 's part. I know that they are reading from a screen and saying a lot of XXXX because they can not answer any questions about the underwriting process. we have been trying to negotiate with them for 9 months. we were told since XXXX that the modification was in underwriting then they would ask for updated information we would update them with the information and then they would punish the borrower by saying that the process was starting all over again. that 's just wrong. the lender is accepting monthly payments but keeping us in a holding pattern on the delinquency. need some action cfpb!!!
