Consumer Complaint: My father passed away in XX/XX/XXXX. His mortgage was held by Select Portfolio Servicing Inc ( SPS ). I went to court and was appointed as the Administrator of his estate. Once I had the applicable court documentation I called SPS to catch up the mortgage to ensure the property would not be lost. I first contacted SPS on XX/XX/XXXX and emailed in all the requested documentation to have me added as an authorized individual on the account. However even with the court paperwork they refused to provide me info on the loan, amount to get it current, etc. until I provided them my tax returns, pay stubbs etc. With each call they would try and trick me into applying for a new mortgage by providing all those documents all while the mortgage grew further behind because they would not provide info. After several calls where I tried to obtain the needed info and instead was tried to be tricked into taking a new loan in my name at the current interest rates which are double the current note rate I got my attorney involved. We called SPS together and of course upon hearing there was an attorney on the line they for the first time said they dont need my tax returns and pay stubs and can tell me whatever I need to know. Thus the first complaint again SPS is that they are trying to take advantage of individuals in difficult times after loosing a loved one to try and leverage them into new business even though it is not required by law they act as if it is. The second complaint is during this period of time when they would not provide the mortgage info to get it paid current they were without notifying us or consent sending technicians into our property. They changed the locks despite no communication or filing about any movement toward foreclosure. Upon paying the mortgage current we were still not notified of their accessing the property nor was the lockbox removed. They have now changed our locks and when opening the lockbox no key is inside so we can not access our own property that is fully current on the mortgage. Because they changed the locks and let unknown persons into the residence our property was illegally access and all my late father possessions have been stolen.

Consumer Complaint: I have always been fond of my XXXX based brother whom suffers from XXXX XXXX problems. I rearrived back to XXXX from XXXX in XXXX. I have been communicating with SPS since XXXX XXXX initiated and we are in good contact. It was suggested to me from SPS to contact GA XXXX XXXX XXXX XXXX XXXXe, which I proceeded to do, however, myself and others were victim of fraud phishing scheme, as I had heard on the news. As a result of the aforementioned fraudulent activity, I have been getting calls, letters, etc which prompted me to start a police report in response to the stolen information. I was told by SPS that I had to choose either the GA XXXX XXXX GA Mortgage assistance, or the modification of the loan. I have successfully passed all the conditions for the modification approval. I am tasked to choose between the two so I am taking time trying to make the best informed decision as it relates to my mortgage. Every payment has been made on time, however, due to the past Pandemic, I exercised the XXXX XXXX XXXX, for ease of caregivers for my daughter and brother. I am fighting fraud and weighing options between the two so please allow me a few more moments to make the best informed decision for my circumstances.

Consumer Complaint: During XXXX, my husband 's hours were cut, my Mom who had XXXX had reached the maximum payout for her long term care, so I became her full time caregiver and XXXX of my children moved back home. We were having difficulty making the house payment, so I called the lender and they granted a forbearance over the phone. I did not sign any paperwork nor was anything discussed regarding payment arrangements. I extended the forbearance in the same manner several times. There are 3 homes on the parcel, 2 of them are rented. The XXXX came in XX/XX/XXXX, because the tenants turned the rentals into XXXXXXXX XXXX XXXX. My husband and I were XXXX and they never went after the tenants. We discovered a water leak in the main home that did {$140000.00} in damages. The lender, SPS was aware and received the insurance payments to disburse. Once the remodel was completed in XXXX, we were once again able to rent the homes and began making mortgage payments. The lender rejected the payments and in XX/XX/XXXX filed a Notice of Default. Since this time I have been working with the lender to reinstate the mortgage, but they are insisting on {$100000.00} in back payments. I was assured the foreclosure would be halted while we were attempting to make arrangements. Yesterday I was notified they have moved forward with a foreclosure sale dated XX/XX/XXXX! I have been unable to speak with anyone other than a customer service rep to go over any repayment options. California has a program where they offer up to {$79000.00} to bring the loan current, but I am unable to speak to anyone about an arrangement to lower the total to at or under {$79000.00} and possibly place the remaining balance on the back end of loan or make additional principal paydowns. SPS Servicing is the servicer, XXXX XXXX is the lender and XXXX XXXX XXXX Processing is the one who filed the sale date. I just received the name and number of the attorneys involved, XXXX XXXX XXXX in XXXX XXXX.

SPS bought the loan, where the problem is they have sold my information to realtors but I cant out right prove but they have because SPS buy loans that are in danger of foreclosure. My problems comes with the escrow part they keep bumping my payment so high to where there trying to put me in danger of losing my house .I made all the payments and they keep double the escrow saying I need a cushion but they can not send me anything in writing.

Consumer Complaint: On XX/XX/XXXX we checked our online account with SPS servicing and it stated we were due for a XX/XX/XXXX payment and that the XX/XX/XXXX payment was processing. On XX/XX/XXXX we noticed that the money had not come out of our account for XXXX or XXXX and we called in on XX/XX/XXXX and made a XXXX payment which shouldve been good for XXXX and XXXX. We then received a letter stating that our rate went from 4.875 % to 20 % and we were forced to pay over {$3300.00} for XXXX and XXXX. They excepted our phones and are still stating that we are in default. Our bank confirmed that the money was available on XX/XX/XXXX and that they never attempted to withdraw the ACH payment. We provided SPS servicing with proof that money was in the account on XX/XX/XXXX. This is predatory lending at its finest. We have called in every week and are getting different answers every time we call him. They have taken the money and that applied to any past due payments.

Consumer Complaint: Under previous complaints with CFPB where a complaint was submitted regarding the accounting of this loan # XXXX, the mortgage company failed to provide me with options for loss mitigation. I was only notified XX/XX/2023 by XXXX XXXX XXXX, XXXX XXXX XXXX XXXX that SPS notified them that foreclosure proceedings had commenced and my coverage would be cancelled XX/XX/2023. I did not receive a written notification at the property address of XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX from SPS, Inc of foreclosure proceedings nor did I receive loss mitigation options. I contacted SPS, Inc XX/XX/2023 and spoke with a representative regarding one loss mitigation option ( repayment plan ) that was sent electronically through SPS portal and subsequently submitted an appeal due to not receiving the one option. I requested an application to see if I can do a modification and I was advised by SPS, Inc that no other options were available to me.

Consumer Complaint: SPS is a predatory lender who acquired my loan from XXXX XXXX XXXX in good standing in XXXX XXXX XXXX SPS lending practices are illegal and they should be prosecuted to the fullest letter of the law. When SPS acquired my loan my monthly payments were : {$1000.00} Principal & Interest {$670.00} Escrow = {$1600.00} Monthly Payment XXXX has never assigned an escrow shortfall/PMI to my account. XXXX consistently paid the balance due of my taxes and insurance annually from my escrow account After making my monthly payments consistently to SPS from XXXX to XXXX XXXX XXXX, I received a new escrow analysis on XX/XX/XXXX. The new analysis included the addition of a mortgage shortfall account. Escrow Analysis XX/XX/XXXX {$1000.00} Principal & Interest {$740.00} Regular Escrow {$130.00} Monthly Escrow Shortage/PMI = {$1800.00} Monthly Payment In this analysis they advised that my shortfall amount was {$3700.00} and would be spread over 24 months. Where are these numbers coming from??? FRAUD!!! After receiving this analysis, I reached out to SPS and requested that the PMI/Shortfall account be removed. I advised the State of Georgia does NOT require PMI accounts. SPS responded with the illegal closure of all escrow accounts. ( FRAUD ) After refuting back and forth with SPS, they issued a new analysis on XX/XX/XXXX which reflected a shortfall in the amount of {$4400.00} with the amount being spread over 24 months. {$1000.00} Principal & Interest {$740.00} Escrow {$190.00} Monthly Shortfall/PMI = {$1900.00} Monthly Payment With this information in hand and because of the illegal practices with the mishandling of my escrow account and misallocation of funds, I reported SPS to CFPB requesting an internal investigation. After the internal investigation by CFPB, SPS issued a new escrow analysis on XX/XX/XXXX which reflected a shortfall balance of {$8100.00} with this amount being spread over 12 months. {$1000.00} Principal and Interest {$740.00} Regular Escrow {$580.00} Shortfall/PMI = {$2300.00} Monthly Payment SPS actions are reflective of a predatory lender who is attempting to push the consumer into foreclosure. Their numbers are inconsistent and their practices are illegal!! I am requesting the following : XXXX. The immediate removal of all shortfall/PMI accounts. ( FRAUD ) ( Georgia does NOT require PMI ) with my monthly not being converted back to the amount at the time of acquisition. ( {$1600.00} ) XXXX. SPS license be revoked for fraud and predatory lending practices XXXX. SPS be subjected to a full internal investigation by the DOJ and FTC for misallocation of escrow payments, money laundering and the illegal closure of escrow accounts. XXXX. All fund remitted that were allocated for escrow should be fully applied to the regular escrow NOT the shortfall account. SPS creation of the shortfall accounts is identified as money laundering and they should prosecuted to the fullest extent of the law.

We own a logistics transportation business since XXXX and was very profitable up until XXXX when Covid hit so many businesses.My husband and I haven't received a personal income in four years and have depended on our cabin rental to help pay what bills we could.We had our mortgage loan with our local bank and was looking for lower interest. The company we went to sold our loan to Select Portfolio Servicing and had never dealt with this type of company. XX/XX/XXXX I started working with XXXX XXXX to get my mortgage moved to help with payments and use our equity to consolidate debt and do renovation needed at the cabin.Signed all the documents in XXXX with a notary and was told from XXXX they would payoff SPS and would receive funds end of XXXXThey requested a payoff quote from SPS on XX/XX/XXXX. I was also working with SPS for a lower payment so we could continue making the mortgage payment. On XX/XX/XXXX they sent me a payment plan that was to start on XX/XX/XXXX for {$3200.00} and was higher than our payment of $ XXXX were not trying to help with our issue to have affordable payment! I was still working with XXXX hoping for an answer and the first lender did not work. On XX/XX/XXXX SPS withdrew my application for assistance because I didn't the payment plan that I could not afford! On XX/XX/XXXX they sent me a demand notice of default, so I started sending them documents for the assistance program. From XX/XX/XXXX I kept getting letters stating missing information and contacted them each time to see what else they needed up until XXXXOn XX/XX/XXXX I contacted the relationship manager and wanted to make a {$5000.00} payment on the loan that would cover two months and wouldn't except because had started foreclosure on the property. We have always had our home loans with our with our local bank and moved the loan for lower interest and have always made our payments on time for 42 years. I have never done business with this type of company and would have never moved our loan if I had known this could happen! There business practices are unethical for the average consumer that is trying to survive and was hit with an unfortunate situation out of our control. We want and need to keep our home and the rental is our only income to live.I have read reviews with SPS and they are all BAD. I hope you can help me with this and stop foreclosure on our home.They have set the date for XX/XX/XXXX to no longer work with me. Need your Help!

I called their customer service number and raised the issue telling them their XXXX statement is accurate while their website is not.Their reply was due to a review?! they had to take back the 4 payments and the issue would be corrected in less than 48 hours which they indeed did the correction. On XXXX I connected to their website and now I see that THEY TOOK BACK 5 PAYMENTS TOTALING {$3400.00} SHOWING THAT I OWE A PAYMENT AS FAR BACK AS XXXX. I CALLED this morning to inquire only to be told that they are going to correct the issue in a couple of days, I told the customer service this had happened on XXXX and now again on XXXX I can't do this every 13 days I would have a XXXX XXXX, I am a home owner making his payments in a timely manner. First, I don't know if they are going to correct this mistake in 2 days? Second, why are they reversing numerous payments in the name of illusional reviews?!! third, they did this on XXXX after sending a resolution letter dated XXXX assuring that the next payment due is XXXX with no past due amounts. Select portfolio servicing is not accredited by the XXXX XXXX XXXX and my loan will be paid off in less than a year, their actions the last 14 days are incomprehensible.,.

Consumer Complaint: My mortgage was sold to Select portfolio servicing early in XXXX. Everything was fine untill XXXX XXXX when they did ACH payment from two accounts instead of one and I called them to request one account to be refunded. They refunded one of the payments but now they claim I missed my XX/XX/XXXX payment and put me on default and my property on pre foreclosure. At this point they adjusted my rate at 20 % and they wont let me make payments until i came up with XXXX so i can catch up. I called millions of times to ask for help and audit but no one helps. We did pay our payments on time until XX/XX/XXXX when they stop letting us make regular payments and purposely putting us on default for the incoming months. Customer service is not helpful and rude and the managers can clearly see that they got our XXXX.payment but miss to include it in the payment history. Its an accounting error on their side but they dont fix it. Please help
