Consumer Complaint: By failing to adhere to both California law and the rules under CFPB, The party ( ies ) complained of in my initial complaint are not compliant with rules regarding dual tracking. The Parties are " covered '' under both California Homeowner 's Bill of Rights and the CFPB 's strict guidelines. I have a valid and complete loan modification package on XXXX XXXX, 2016 that has been acknowledged as received and no notice of deficiency of documentation has been received by me. I just received another Notice of Trustee during the pendency of my application. The Parties have also failed to respond to the initial complaint with competent and reliable evidence that supports all facts contained within all recorded title documents that were used against my contract rights. Specifically, the assignment ( s ) of deed of trust to an un-verified entity, Notice of Default, Notice of Trustee Sale. No authenticated evidence has been offered by the offending Parties by any person with personal, first-hand knowledge of those facts. I am not in default to an unknown, un-authenticated party that is currently in my chain of title without competent evidence to support the beneficial interest.

Consumer Complaint: I had a large job camcelled last fall. No money, but I got some Smaller jobs to help pay other bills. We applied for a HAMP modification about XXXX months ago. And the requests for the additional documents never stopped. " Oh, those XXXX are 90 days old now, you have to resubmit ''. Etc. each and every time they ( SPS ) was reviewing my file, they told me " this may be referred to an atty for legal action. I finally said, " are you allowed to say that while we are in the Federal HAMP program ''?. " Everything we do is in accordamce with the law I was told last week. I resubmitted my wife 's XXXX last week. I call back today for an update ( i called a day after I sent the XXXX to make sure they got them, amd they did ) and the woman tells me " your loan has been recerred to an atty for foreclosure. But no date has been set. And then she adds " it may take up to 30 days to review the HAMP application ''?! Is n't this called dual tracking? Formerly called parallel foreclosure? XXXX. I have spent the last 3 months linkng up work to get a large chunk of the arrearages paid down, ( XXXX-XXXX out of {$18000.00} ) and am working 6 & 7 days per week. And now they pull this? I thought the various " settlememts '' among the state AGs were to put an emd to this. I will have to speak w an atty about filing a complaint for mental duress. Or similar. THEY ALSO VIOLATED THE PRIVACY POLICY ACT AND SENT ALL OF MY PERSONAL INFORMATION TO ANOTHER BORROWER. THAT WILL ALSO BE ATTACHED. MY ATTORNEY HAS SENT THEM LETTERS REGARDING THIS BECAUSE THEY SENT ME A CHECK TO PAY FOR XXXX, BUT UNFORTUNATELY THE AMOUNT THEY SENT DOES NOT EVEN COVER THE BASIC COST OF THIS PRODUCT. When we ( wife and I ) signed the documents, with Select Portfolio Servicing who were with with XXXX, we were not aware of the final balloon payment on the interest bearing principal balance added to my mortgage. I was never given a copy of this agreement. I became aware of this recently when I asked the homeownership counselor what my final payoff will be, the told me about this new balance on my mortgage. I feel that fraud and misleading information has taken place. This organization was not upfront nor honest with me.

Consumer Complaint: XX/XX/2015 close to 8 months ago I began a mortgage Modification with Select Portfolio Servicing my current mortgage servicer. Early last my XXXX had a major set back when I lost my XXXX. Since beginning the process I have seen first-hand incompetence and miscommunication. As of this date my home has been appraised 3 times with each value thousands of dollars different from the one before, I have had values of $ XXXX, XXXX, and XXXX. Right now I owe {$470000.00} on the house. Since this night mare began I have submitted dozens of paystubs, and bank statements as well as any other documents that have been requested. I have spent hours on the phone talking with one representative after another and very seldom receiving the same information. At first I chalked this up to an over worked staff but as month after month has passed I came to the conclusion that no one business could be run so poorly, this had to be done purposely in order to tack on more fees to the back of the loan. In order to avoid any further issues at least with a pending foreclosure I began to pay 3 months ago on what was described as a streamlined modification which according to one rep was given to me by the Federal Government with out income verification but this would not affect the modification that I have in process. Even this was a point of contention in that I was originally told that if I began to pay I would be accepting this agreement which is saving me less than {$100.00}. and that the modification that I have been working on for the last 8 months we be voided. I am thankful that every conversation that I have had has been recorded I encourage the investigator to listen to these tapes and hear for themselves the misinformation that is given. I have been bombarded by dozens of letters which I receive daily asking for information then acknowledging that it was received and then asking for the same document again. I know that as part of this complaint that you will ask for documentation. I have well over XXXX XXXX pages that I will not burden you with. I am sending over the XXXX appraisals as well as a document request letter and a staement.

Consumer Complaint: On XXXX XXXX, 2016 I received a phone message from XXXX XXXX stating she wanted to go over some things regarding the previous complaint. I returned the call, spoke with XXXX, after verify all our loan information, she asked how she can help, I told her I was returning a call from XXXX. ( once again the representatives do not know why we are getting calls ) XXXX told me XXXX is a investigator and does not take calls. ( Then why call us asking to call back if she does n't take calls ). XXXX then put me on hold to discuss with XXXX why she called us. XXXX got back on line to say that they are missing YTD information on the pay stubs that we had already submitted. Every one of the pay stubs have YTD information. My husband, XXXX who is the loan holder talked with XXXX and explained where the YTD information was on the pay stub. XXXX understood, took note for the underwriters. XXXX admitted there was " a issue going on '', I talked to XXXX mentioning it did n't make sense we received a multiple letter stating SPS had the received the documents, it also showed on the website under our account that they had received all documents needed and the modification was be reviewed. XXXX told us she would talk to XXXX to figure out what was wrong and call us back. Today, XXXX XXXX, 2016, I checked the website and our account, it now states they need YTD information. We received letters on XXXX XXXX, 2016, XXXX XXXX, 2016 and 2 letters on XXXX XXXX, 2016 stating they have received the documents needed. I have attached scanned copies of each letter. To this date, no one has called us back.

Consumer Complaint: I am the daughter of XXXX XXXX and have power of attorney. My mother with my assistance are in the process of obtaining a loan modification. We started this process in XXXX of 2016. The decision to modify was due to our discovery of an exhorbitant interest hike for an interest only first mortgage which is now nearly 7 % as well her dwindling of assets due to these terms. Frankly the loan terms reflect a predatory abuse of a XXXX. It was n't until recent review that we discovered a high interest interest only mortgage. Thus far the modification process with Select Portfolio Portfolio Servicing Inc. as been painfully redundant in document production. Nearly every document has had to be re emailed to them despite confirmation of receipt in good order They also have asked for us to restate income from investments to a category known as " other '' rather than " wages '' which yielded the same gross income. This red lining against this XXXX systematically is depleting her assets and creating a default. Her simple objective is to preserve her home and reduce the interest rate to 2 to 3 % with a principal amortization of XXXX yrs which is something more typical of those yielded in the modification market.

Consumer Complaint: Good morning, I qualified for a home modification with SPS. I made my payments according to SPS 's instructions. They gave me the principal reduction of {$76000.00}. Then they stole the money back by withdrawing the same amount, {$76000.00}, from my account. Then they lied by saying they were taking the money out for a government program. Now I read that SPS was given a $ XXXX Bailout on XX/XX/2009 as an Incentive Payments for Home Loan Modification. ( XXXX ). I am told they never paid that back and are not expected to pay that back. So, my question is, if they received $ XXXX for loan modifications but they are stealing the modification back from the homeowner and then lying to the homeowner in the name of a government program, why is the government allowing this? It seems like SPS is stealing XXXX from the taxpayers and then stealing {$76000.00} from the homeowner in the name of a government program. This is illegal, right?
