Consumer Complaint: XXXX customer service told me my mortgage payments were current and I did not have to pay the XXXX XXXX payment because I had done a loan modification and the loan was current. The payments are {$840.00} each. But they require that the payments be sent by XXXX XXXX because the payments can not be paid online at their site. That 's another {$16.00}. The total payment is $ XXXX/mo. I was current until they said I did n't have to pay the XXXX Payment. I paid the XXXX payment today and went online to check the amount and it says I owe for XXXX and XXXX. I sent the XXXX payment via XXXX XXXX as usual for the XXXX Payment. I called and they said I owe both months {$1700.00}. The customer service people who told me I did n't have to pay I questioned and she put her supervisor on the line too. He said the same thing, the loan was current. That call was on XXXX/XXXX/XXXX. I called yesterday and the customer service rep I spoke too said they should not have told me that and that they had mislead ( lied ) to me and she had notes in the file that they did in fact tell me that and that all their calls are recorded. She said she would get back to me because she wanted her supervisor to review the phone recording and ask me if that was ok. I am praying its not the same supervisor that lied before. I checked today and there is a class action lawsuit filed against this company in Colorado where they are located and multiple other complaints. I am sacred that I might loose my home and have been sick and XXXX XXXX last year. It would be impossible for me to move now. But based on their information my loan is current and has been since the modification last XXXX XXXX. But I think they tried and are still trying to file foreclosure on my home. The last one cost me {$13000.00} on top of my mortgage and I received a new loan modification package from them yesterday. I did not ask for a modification. My loan is current except for their trickery about the XXXX XXXX payment. I 'm worried since my credit is bad because of my illness last year and to refinance would be difficult for me because I 'm self employed. And when I requested a payoff statement from them or even payment coupons they would not give them to me. The loan officer I went too said to get another loan I had to have a payoff statement. Consumer Complaint: The short sale package was submitted for review in a timely manner. SPS has continuously throughout the review process ask for documents that have already been submitted to be resubmitted again. Delaying process over and over. Most recent submitted of a hardship affidavit was submitted on XXXX/XXXX/16 at which time i was told file was in review for a decision. I called on XXXX/XXXX/16 to follow up on receipt of affidavit it was confirmed received and i called on XXXX XXXX, 2016, and was told file in review. I called again today on XXXX/XXXX/16 and was told that file was going to be escalated because it was not submitted in review on XXXX/XXXX/16 as it should have been. Now we are going to have to wait again for review without a specific time frame and are going to lose the buyer due to these inadequacies by short sale lender. Original short sale package was submitted on XXXX/XXXX/16. There should be a comprehensive review and specific as to what items are missing or need to be supplemented so they can be provided at once within a 30 day period. Instead every time i called they requested for an additional documents. Delaying process to the detriment of the seller and buyers.

Consumer Complaint: I XXXX XXXX XXXX XXXX XXXX from XXXX .stand behind what XXXX XXXX has stated in her complaint. When we got the verbal denial on XXXX XXXX XXXX XXXX and myself did a three way call and filed a formal dispute which no one got back to either one of us for days. When I finally called to find out where we were at I asked to speak to XXXX XXXX who was supposed to be the lead on this but in all the time we have been working on this the attorney or myself never spoke to him. They said that he had called me and discussed the situation which was an out and out lie. I asked to verify that with a recording of that conversation which I was told was not possible. If in truth they want to help people out of foreclosure than this house should not be going in that direction. We have a willing and able cash buyer that could close in 2 weeks. We submitted all paper work in the time frame asked which I and XXXX attorney XXXX XXXX have record of. I have a list of people I talked to never the same person twice. Select Portfolio kept switching time limits and not notifying us as to what was going on and than almost the final hour denied us instead of giving us the time needed to close this property. None of what they have done makes sense. We the consumer have bailed the banks out and now they are dictating unfairly the future of the same people that helped them out. The best thing and most sensible would be to let us move forward with the short sale. It would be a travesty to let this property go into foreclosure. XXXX health has progressively gotten worse through this whole thing forcing her to go stay with her daughter for the weather and no longer being able to do stairs. Her possessions are still in the house which she has not been able to come back for because of her ending up in the hospital and affordability. She had been approved for the HAFA money is what I and the attorney had been told. If they needed more time to go through the paper work why did n't they give us more time? I could ready with all my documentation if you want confirmation of any of this complaint. We have all worked long and hard on keeping this together which is best for the consumer who is the reason laws are being put in place to protect even better. SPS still will not send my client proper notification and again violate consumer protection law of 30 day notice in advance. Because SPS calls me and gives me dates and yet my client XXXX XXXX never receives anything until several days later which is unethical. I was told to rewrite the HUD-1 settlement as they only want to offer my client {$3500.00} instead of the {$10000.00} relocation assistance under HAFA because she has had to go into the XXXX. This undue XXXX and hardship on my client is horrible what SPS has made my client endure. A month ago etc., my client was only facing XXXX and other XXXX needs that were urgently needed as she is facing even more XXXX needs. Today XX/XX/2016, I spoke w/XXXX at XXXX. They reopen the short sale to get in to do the EPO appraisal.However my client has not been legally written informed and because of SPS negligence and playing w/miscommunication they want to offer this {$3500.00} at {$110000.00} of 3 % instead of the full {$10000.00} relocation assistance as this was SPS/XXXX intention all along regardless of the hardship endured on my client. This amount is the same as " cash for keys '. Now, my client XXXX XXXX has indicated they do n't have a problem going to court with a trial by jury if necessary.SPS wants to conduct business verbally by calling XXXX XXXX asking for XXXX XXXX in the Obsumden Dept. Client should respectfully receive adequate written notification in writing but SPS is unreasonable in meeting request.

Consumer Complaint: Select Portfolio Servicing states that it seeks to help individuals stay in their home and that they offer many plans to help pay missed payments. However, nothing is further from the truth. After missing XXXX payments due to major health problems, SPS locked my online account and returned my checks, refusing to accept any payment other than the full amount owed, which included late fees, home inspection fees and other fees I was attempting to dispute. When I called to speak with a SPS employee, I was told the only thing I could do was to complete the loan modification documents, which I did several times. Every time I completed the documents and submitted everything that I was asked to, I was always told they had not received everything and was told to resubmit the same forms again and again. SPS notified me that a foreclosure sale had been set. In an effort to stop the sale, I continuously attempted to pay everything that SPS said I owed. I made numerous calls requesting the amount I should wire, however, no employee could ever tell me the amount. I made written settlement offers, to which SPS has failed to respond. After speaking with the foreclosure attorney, I was told the sale had been cancelled. I then am told to complete the modification documents again. I submitted what I was asked to and received a notice that some documents were missing. Additionally, SPS 's XXXX XXXX letter, stated that I needed to submit additional information for my loan modification review by XXXX XXXX, and further stated : " Please know that while we are awaiting the additional information, your account will not be referred to foreclosure, nor will it be sold at a foreclosure sale if the foreclosure process has already been initiated. '' Moreover, SPS sent another letter on XXXX XXXX asking for additional information by XXXX XXXX, 2016 and again stated the promise that while waiting for this information, my account would not be referred to foreclosure. However, on XXXX XXXX, only 6 days since the last letter and over three weeks before the deadline for the additional information, SPS 's foreclosure attorney notified that SPS " had instructed [ the foreclosure attorney ] to foreclosure the property. '' Even more shocking, the foreclosure attorney stated that XXXX XXXX sale would be publicly announced the very next day, XXXX XXXX in my locate paper. I then sent a letter to the foreclosure attorney and various departments at SPS notifying them of their wrongful foreclosure, dual tracking, fraud and, instead of filing a lawsuit, I enclosed payment for XXXX of the outstanding fees and requested a payment plan for the remaining amount. Again, my payment was refused. I received a letter from SPS stating that in order to stop the foreclosure, I needed to pay the full amount of outstanding fees by XXXX XXXX. No one at SPS has been able to help me with the loan modification, which has not been reviewed, or a payment plan. Due to SPS 's initiation of the XXXX wrongful foreclosure, I incurred huge fees and tax liability, for withdrawing funds and making an early withdraw from my retirement account, in order to stop the foreclosure. Moreover, SPS 's malicious acts have caused me enormous stress, which has exasperated my health problems, which has caused me to miss work and family functions. SPS 's actions are not only a malicious contradiction of their written promises, but are in direct violation of the law. As SPS and their foreclosure attorney has failed to respond to my letters, I am asking for help from you.

Consumer Complaint: I applied for assistance in saving my home with my servicer, SPS. I hired an attorney to help me submit my paperwork to my lender. My attorney confirmed SPS received my full and complete application and all financials and that my loan was under an active review for loss mitigation ( Loan Modification ) as of XXXX/XXXX/2016. My attorney again spoke with SPS on XXXX/XXXX/2016 and confirmed my loan was still under an active review. I was previously denied for a loan modification and my appeal was closed on XXXX/XXXX/2016, however SPS told my attorney that another review was open and they were working on it starting immediately after my last application and appeal were denied on XXXX/XXXX/2016. On XXXX/XXXX/2016 my attorney spoke with SPS and confirmed my loan has been under an active review without pause since XXXX/XXXX/2016 and is still currently under review and awaiting a decision. My complaint is that SPS via XXXX XXXX XXXX, recorded a Notice of Default against my home on XXXX/XXXX/2016??? According to my attorney : RESPA Reg x ( 1024.41 ) states no foreclosure action shall be ordered while a homeowner is under an active review for loss mitigation assistance. It appears SPS allowed XXXX XXXX XXXX to order ( start ) foreclosure against me while I am under an active review ( DUAL TRACKING ), my foreclosure process. Another complaint I have is that they have had my application with everything they would need to make a decision since XXXX 2016. They keep stalling, evading making a decision in order to dual track my foreclosure process and then leave me with no alternative once my time runs out and I am foreclosed. I am told they are required by RESPA to make a decision in 30 days or less. Instead they are making up excuses and dual tracking me and after XXXX/XXXX/2016, THIS MONTH, I will face a Notice of Sale. I feel this is not only wrong, but something the DUAL Tracking laws and RESPS Reg X was supposed to protect me from. My attorney states SPS acts as a co-conspirator for the investor of my loan in evading, stalling and dual tracking me PURPOSELY in order to block me from getting help before it 's too late. PLEASE STOP this very bad servicer from hurting me and everyone else they do this to. It 's unethical and apparently illegal!

They have begun an aggressive and at times abusive campaign to seize our property. They have been offering us {$10000.00} to vacate our property. We have been receiving written harassing correspondence on a daily basis, as well as constant daily phone calls. Our original mortgage was a conventional fixed, and now they are claiming that it will be Adjusted every 5 years. This was not what we had signed up for.

Consumer Complaint: In XXXX 2016 after checking my credit report, I realized that there was an error on my credit report. Select Portfolio Servicing, Inc. had attached a debt to my credit report which did not belong to me. The debt actually belonged to my father who has the same first and last name as me. I contacted SPS in XXXX to correct the issue and made them aware that they had illegally obtained my Social Security number and attached it to my fathers debt. My father also contacted them to make them aware of the error. SPS mailed my father the appropriate forms to verify his identity and he completed the forms and returned them. He also attached copies of his drivers license and Social Security card to confirm his identity. SPS will not acknowledge these complaints or receipt of the forms mailed in by my father. Additionally, SPS will not admit fault for illegally obtaining my Social Security number and attaching it to this debt. For the past several weeks I have contacted SPS nearly every day by phone and have also contacted them in writing to resolve this issue. I have recently been denied a home loan because of this error on my credit report. SPS has made no effort whatsoever to resolve this issue and now I will soon be homeless because I sold my home and was unable to obtain financing to purchase a new XXXX.

Consumer Complaint: We mediated with Select Portfolio Servicing , Inc. in XXXX XXXX to allow us an opportunity to sell the property through a short sale prior to foreclosing. On XXXX XXXX, XXXX we received an offer of {$50000.00} cash. SPS had a broker price opinion done and said the property was valued at {$64000.00}. We disagreed with this price and they suggested we go out and pay for a third party certified appraisal. We did and that appraisal came back at {$52000.00} on XXXX XXXX, XXXX. SPS then told us we needed to update the contract with the new price, get a new proof of funds and produce a new HUD statement. All of which we did. They denied the new offer stating it was still too low in mid XXXX. In XXXX, the Realtor got the same buyer to go up to {$57000.00}, {$5000.00} above an appraised value of {$52000.00}. SPS requested that we get an updated proof of funds and a new HUD statement, which we did. SPS sent out for another Broker price opinion. After we went through this appraisal process for the third time, SPS sent me a letter stating that two and a half weeks would not be enough time to consider this new offer. I contacted SPS multiple times asking them to postpone the sale for 30 days to give us time to complete the short sale and they have refused. I truly feel that SPS purposely strung us along making us think we had a chance at a short sale, making us jump through many hoops with no intention of allowing for a short sale.
