Again SPS is not clear XXXX - SPS there were no options to deal with XXXX? I will have transaction history checked by a professional once received. Again SPS originally told me over the phone it was over by more than XXXX dollars and would not confirm amount with XXXX. However it is now being confirmed the amount was only XXXX - appears some game is going on at SPS. If SPS really wanted to assist me in keeping my home - an option would have been presented. SPS wrote : Denial of XXXX In your inquiry you state the amount to reinstate your account was below the XXXX amount of {$100000.00} when SPS denied you for the assistance. At the time the account was reviewed for XXXX the amount to reinstate the account was {$100000.00}. SPS received the assistance request regarding a principal reduction recast program from XXXX on XXXX XXXX, XXXX. The purpose of the XXXX recast assistance is to have funds applied to the principal balance of the account, resulting in a lowered monthly payment. Because the account exceeded the program allowable assistance, SPS is unable to proceed. The total amount is broken down as follows : Past due payments XXXX XXXX, XXXX to XXXX XXXX, XXXX {$91000.00} XXXX XXXX, XXXX payment {$3200.00} Loan Level Advances {$1600.00} Escrow Advance {$3900.00} Reinstatement Amount {$100000.00} I wrote : The income does not appear to be the challenge regarding modification option XXXX Tier XXXX. Appears SPS focus is on the EQUITY in my home. My family has stated indirectly and directly to SPS they can assist me finantially. No matter what my income is SPS will not assist because of Equity as was told to me today by XXXX and SPS representative - SPS just say that instead of making up income that I never gave you at no time. SPS is conveniently over by XXXX - to not except XXXX SPS seems surprised that after SPS denied assisting me XXXX approved me SPS told me to allow them to assist first and then SPS can receive additional funds from XXXX However XXXX confirmed yes a dual-program does exist however SPS should have not told you that as SPS is not signed up for that program at the moment- SPS can however currently they are not. SPS representative told me on the same day - SPS is concerned if they except XXXX funds I would not be able to make my payments. SPS statement do not show a breakdown of amount due I believe on purpose - when XXXX XXXX XXXX transferred the loan my statements had a breakdown of fees in XXXX. If SPS states its because of the bankruptcy - SPS should stop reporting to all XXXX credit bureaus every month impacting my credit. SPS statements originally had a breakdown - and then nothing. I have no way of tracking alleged total due. Also I requested the investor ADDRESS - not SPS address the alleged servicer - whom appear to have more involvement that disclosing.

Consumer Complaint: Select Portfolio Servicing is a debt collector who claims to have seized my home in year 2004. I still reside in said home. I am a veteran XXXX being bullied by this company. Repeatedly sending the local Sheriff to my home and posting foreclosure papers. I did not ever receive a loan from this company. The company they claim to be collecting for is XXXX XXXX which is no longer in the loan business. I believe the statute of limitations is expired on their debt claim. There are discrepancies in the tax records on said property they are claiming to seize.

Consumer Complaint: Submitted application for home modification with my servicer a year ago. They have been asking for documents since then. We provide them every time they ask. I feel that we should have been given an answer in a timely manner. This has caused the arrears to continue to go up. If we would have been given an answer in a timely fashion, we would have been able to explore other options. They simultaneously have served us with an intent for foreclose, with 35 days being given to answer the complaint. My husband and I have been doing everything we could to save our home, i.e. making applications to better paying jobs, going to food pantries, eliminating unnecessary bills such as cable, and keeping our old cars, which have no monthly payments. It is essential for us to keep our home. We have been here since we are married and have a special needs son. This house gives him some stability, and he is currently in a good education program, where he is making progress. We would just like them to provide an answer once and for all. At this point, they have all updated income information and bank statements.

All historical and current servicers ( XXXX, XXXX, XXXX and SPS ) of my mortgage that originated in XXXX by XXXX indicate the same. None of these servicers have contacated XXXX XXXX backed XXXX on my behalf requesting a waiver allowing me to modify my mortgage. When i contact XXXX XXXX, XXXX as the 'trustee ' they indicate that they do not have the authority to provide permission to modify my loan and refer my back to the service. the servicers will not provide me with contact telephone number nor contact name at XXXX XXXX backed XXXX so that I can reach out on my own behalf. the last filing of XXXX XXXX backed XXXX XXXX was in XXXX with the SEC. I have been informed by historical servicer that my loan was not propoerly securitized and that there is evidence of fruad. XXXX XXXX backed XXXX is a subsiduary of XXXX. My current servicer is Select Portfolio Services ( SPS ). My loan note and mortgage still indicate that XXXX as the originator from XXXX even though XXXX ( aka XXXX ) is no longer in business. Consumer Complaint: I am assisting my aunt with a short sale on her home. Her loan is being serviced with a company called Select Portfolio Servicing XXXX XXXX. XXXX XXXX XXXX XXXX XXXX, UT XXXX ). She has been working to get this resolved since XXXX of XXXX, and has now submitted her 3rd offer. All XXXX offers have been equal to or greater than the XXXX value. Everytime an offer is submitted my aunt is required to send new documents. Everytime we call and ask if all information has been received, and they say yes. Then we call back for a status and they state they need someting else. Then the original documents expire and we have to submit again and reapply. We keep going in circles. After we lost the first XXXX buyers I called and complained to the Ombudsman office. They assured me that this time would be different and that they had everything needed. However when I called in for status, they again are asking for something additional that was not requested initally. We are getting no where and now time is running out as foreclosure is moving forward. We have a current cash offer for fair market value and we can not get an answer. The current XXXX is going to expire on XXXX/XXXX/XXXX and they still have not submitted the offer to the investor. Please help.

Please have SPS comply to my written requests without further delay. I have been in contact with them long enough toi realize that it is a total waste of time and energy without your help to force them to comply.

Consumer Complaint: Select Portfolio Servicing at XXXX Account Number XXXX On XX/XX/XXXX, I signed papers to turn a house, XXXX XXXX XXXX, XXXX, Md, XXXX to this lender under their deed in lieu of foreclosure program. I signed the deed in front of a notary with an attorney reviewing the papers. They wanted the house available as of XX/XX/XXXX. The property manager, XXXX XXXX, XXXX had everything ready for them and no-one showed. They have since missed several appointments and treated the property manager very unprofessionally. But the house is sitting empty all this time and things are happening. The company gave me tax forms stating that the house was transferred in XX/XX/XXXX and I filed those forms with the state of Maryland and the Federal government with my tax return under the advice of a CPA. But the company still has not taken the keys from the property manager and expects me to keep up the vacant house. It has been over six years for this servicer to make up its mind about the house. Even filling out and signing the deed has not gotten rid of this house even though I had it broom clean on the day they asked me. Back when I was going through the loan modification process, they told you I did not file the papers, but that assertion was incorrect. They continued processing the modification after they told you I had not completed the process correctly and later turned down the loan modificiation. Now they wanted to take the house but expect me to keep it up after I signed the deed over to them and filed my tax return with their information.

Consumer Complaint: For over seven years we have been trying to get our loan payment lowered to where we can stay in our home. Until XXXX, 2015 our loan payment was over our income. In 2015 our payment was lowered to approximately {$1300.00} dollars but it was still 70 % of our income. We can not afford that payment and also have had to invest money into our property because it was deteriorating. This has been making it hard plus many health issues that we have had. All we want is for our servicer to lower our payments to something reasonable and affordable. Every time they have helped us the loan modification was an in-house, which resulted in our loan balance now being at {$360000.00}, when the origination amount was {$230000.00}. This is a greater than a {$130000.00} difference. We were solicited at least three times resulting in these in-house loan modifications. We are preparing a summary of the history of these loan modifications and the solicitation letters we received. We currently try to get a loan modification every chance we get, and we get turned down with a letter telling us we have no loan mitigation options. Every time this happens to us, we get harassing phone calls from the servicer trying to get us to sell our home or turn our property over to them. They say that obviously the home is not affordable to us, but when we compare what is being offered in home mortgages in the market place to our situation we know that our home would be affordable if the servicer had not ruined our credit. We have now asked the servicer to comply with RESPA laws regarding answering our questions that we have asked repeatedly before. We are attaching the last letter we sent to our servicer. We waited to see if we would get response from them within 5 days regarding our Qualified Written Request before we forwarded this letter to CFPB. We hope, with help from the CFPB, we will get some results on a loan modification that will give us a payment that we can afford. We do n't care if they even raise our mortgage balance again ; we just need to have payments that we can make on time.

Consumer Complaint: On XXXX XXXX, XXXX, I incurred a financial obligation when I purchased my home located at XXXX , GA XXXX for the amount of {$180000.00}. The loan was evidenced by a Note, naming XXXX as the " Lender. '' Sometimes thereafter, my Security Deed was assigned to Select Portfolio Servicing. I, however, was not provided any notices of the purported assignment, sale or transfer of the servicing of the loan to Select Portfolio Servicing. I began to have difficulty meeting my obligation during the housing market collapse. In an attempt to save my home, I 've made various efforts to get an affordable loan modification from Select Portfolio Servicing. All attempts, however, were unsuccessful. It appears that they refuse to give me a reasonable workout option and is bent on taking my home. Because I questioned Select Portfolio Servicing 's servicing of my loan and how credits had been applied and whether or not my loan account is actually in default, on XXXX XXXX, XXXX I forwarded to Select Portfolio Servicing a Qualified Written Requests ( QWRs ) requesting that Select Portfolio Servicing provide me with ( 1 ) A complete audit history from alleged loan origination, showing the dates payments were applied, and to what internal accounts ( i.e. principal, interest, suspense, escrow, etc. ) payments were applied ; ( 2 ) A complete and itemized statement of all advances or charges against this account ; and ( 3 ) A complete and itemized statement of the escrow for this account, if any, from the date of the note origination to the date of your response to this letter. Also, my QWR stated that it was my belief that my loan account has been improperly serviced in that credits for payments made by me had not been applied to my mortgage loan account. Select Portfolio Servicing, however, did not respond to my QWR, took no responsive action and undertook no investigation into the issues raised by my QWR. The only way to ensure the integrity of my loan and whether my account has been properly credited is for Select Portfolio Servicing to produce a verified accounting in compliance with RESPA 2605 ( e ).
