Consumer Complaint: On XX/XX/XXXX, Select Portfolio Servicing sent an Act 91 Notice on XXXX XXXX XXXX, XXXX, XXXX XXXX. Payments were due the 1st of each month. Due financial issues, the acct was due for 2 payments at {$620.00}. I immediately contacted SPS XX/XX/XXXX ( XXXX ) and a repayment plan was started for {$940.00} beginning XX/XX/XXXX. On XX/XX/XXXX, I contacted and spoke to XXXX to request cancellation of the payment plan. I was able to make the requested amount due {$1800.00} and XXXX processed the payment on XX/XX/XXXX. The payment plan was confirmed cancelled. On XX/XX/XXXX, I wrote to SPS to inquire about a fee {$350.00} added to the account statement balance. There was never a notice or explanation of a fee which was arbitrarily placed on the account. The account was paid and up to date. On XX/XX/XXXX SPS sent a letter advising my inquiry was received and being reviewed. XX/XX/XXXX, SPS again advised still working on my inquiry of XX/XX/XXXX. On XX/XX/XXXX, SPS had not addressed my original inquiry regarding a lien as well as {$350.00} unknown fee. I advised they had not answered my question in their correspondence to me. To date, XX/XX/XXXX, SPS has not provided an explanation of the {$350.00}. There is not a lien nor has there been a judgement submitted to the courts. I requested SPS remove the erroneous fee of {$350.00} and also interest accrued on the outstanding which included the {$350.00}

Consumer Complaint: Inadvertently, on XXXX XXXX, my hazard insurance expired, because the current one ( XXXX XXXX XXXX XXXX ) did not renew it. I got another insurance on XX/XX/3023 ( XXXX Policy # XXXX ). SPS lender place carrier from XX/XX/XXXX to XX/XX/XXXX. and charge {$310.00}. This is : XXXX. Current new insurance is XXXX. This means that SPS placed insurance that is 178 % of the average insurance for this property. My complaint is directed at two points : 1. New insurance started effective XX/XX/XXXX. at XXXX XXXX. Therefore, the lender place insurance should be effective until XX/XX/XXXX. not XXXX. If they are going to charge XXXX, then it would be 11 days, not 12 days. 2. I understand that the lender place carrier could be more expensive but increasing 76 % is abusive.

Consumer Complaint: Requests for Loan Modifications since XXXX have been continuously denied. I suffer major health collapse in XXXX which seriously impacted my ability to work while I rehabilitated. SPS continually gave false hopes and would not accept any payments during that time. We soon nationally entered into a pandemic further preventing primary borrower from working. Primary borrower was declared permanently XXXX XXXX in XXXX and made more attempts to satisfy arrearages. First by Shortsale whereby XXXX separate sales collapsed due to SPS not performing there due diligence and having to delay settlements and both times each buyer chose other homes. Courts closed and I still tried to mediate virtually but SPS still refused to help. Fast forward to XX/XX/XXXX after more than XXXX requests for mortgage assistance and SPS grant trial mortgage modification that doubles mort payment. Then, at the XXXX payment during mortgage XXXX was exposed to bank fraud via SPS mortgage company internal staff. Causing yet again another instance to reapply for mortgage assistance. Now XX/XX/XXXX, SPS Mortgage company offers another trial mortgage modification plus increased property taxes and insurance also twice times the normal mortgage payment and i simply can not bear that burden on XXXX incomes, tenant rent, and spousal support. So I then requested SPS servicing to allow me to short sale the property because I have exhausted all savings, resources and family help at this point with no fixed loan modification still not in place. SPS then becomes relentless to foreclose on property knowing I am an XXXX With a XXXX XXXX, minor child, and co borrower has long sense abandoned the property and obligation and filing for XXXX XXXX bankruptcy. Ive lived in this home made major home improvements for nearly XXXX years and have no equity due to a underwater economy. XXXX monies I have had access have been used to maintain and upkeep there assets and yet SPS doesnt even want to afford me with relocation assistance know I have XXXX XXXX. This shows how they are socially in-XXXX and have no awareness for those that undergo disaster outside of there financial ability. Also, how they would discriminate in offerings to one that is protected by XXXX right. Then, most importantly how they will accept federal aide money and not use it for the purpose its intended. Lastly, I applied for the HAF program and due to the time we refinanced in XXXX, SPS continues to provide false home origin mortgage and documents to ensure we are afforded the aide we need. Moreover, I believe this is intentionally done to bring harm to me the homeowner ( buyer ) and further demonstrating how big business can dominate the little home owner. I end to say my attempts to give SPS the desired amount to remedy the arrearages never was reciprocated with other alternatives that have come along for example principal reduction, lower interest rates, capitalization over a reamortization of terms. My complaint is just another of many against SPS Servicing who we all know is disguised name and face to XXXX XXXX companies who afforded us the mortgage crisis we are in today. Just with this home purchase my wife and I have had the unfortunate experience to be under there financial portfolio, we started with XXXX XXXX, went to XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, and now SPS Servicing the worse.

Consumer Complaint: On XX/XX/XXXX, we were forced to file an emergency XXXX XXXX Bankruptcy petition because our Home was scheduled for foreclosure sale the next day, XX/XX/XXXX, as the result of Select Portfolio Services ( SPS ) illegally filing a home foreclosure action to recover, IN FULL, THE LUMP SUM PAYMENT OF {$35000.00}, in skipped payments, after the CAREs Act forbearance period reportedly ended. Attached are copies of : XX/XX/XXXX Mortgage statement demanding the full payment of {$35000.00} Foreclosure Sale Notice Emergency XXXX XXXX Bankruptcy Order On XX/XX/XXXX, we formally submitted a CARE 's Act Request for Mortgage Assistance. On XX/XX/XXXX, SPS illegally denied our loss mitigation assistance request. SPS refused to offer us any one of the following modification support/assistance : 1. Deferral or partial claim : Part or all of our past-due balance would be put aside to pay off later. It would be due when we pay off your mortgage, sell our home or refinance. We won't be charged any additional interest on the deferred balance. 2. Repayment plan : Our past-due balance would be added to our regular monthly payments for a specified amount of time, typically 3 6 months, until our loan is current. 3. Loan modification : The terms of our existing loan will be updated in order to include past-due payments. These terms could include changing our rate, term and principal balance. Our expressed preference, if it had been properly offered to us by SPS, would have been to add the amount due, {$35000.00}, as an extension of the term of our existing loan and we would resume our monthly mortgage payments of $ XXXX. Its clear that SPSs desire and intent were for us to cure the arrears by surrendering our Home ownership. The only mitigation options that SPS approved and highlighted were : Short Sale : If we were interested in selling our home. Deed in Lieu of Foreclosure : With a deed in lieu, we would agree to transfer the title or ownership of our Home. Both options presented to us by SPS were back-door attempts to pressure us to surrender ownership of our home. According to SPSs valuation, the value of our Home is only {$530000.00}, 30 days repaired ( see attached Property Valuation Notice ). However, we have received offers as high as {$600000.00}. SPS also failed to properly consider the fact that a co-owner is unemployed and can not walk without assistance. This refusal/failure to recognize his disability as unemployment is a form of discrimination. On XX/XX/XXXX, SPS denied our written request for a mortgage modification. We were notified that ( a ) fter careful review of your account, we find that there are no home retention loss mitigation options for which you are approved. Even assuming that SPS properly, and with good cause, denied our request for mortgage assistance, SPS failed to give us a written deadline by which the balance of {$35000.00} had to be paid to avoid receiving a legal notice of foreclosure action. We received the notice of foreclosure without warning. {$35000.00} is a lot on cash for most families to pay in full. SPS should have given us a written deadline and final written warning that foreclosure would be filed against us if we did not pay by a specific deadline. The only language, one sentence, regarding the threat of foreclosure was in the XX/XX/XXXX billing statement. SPS mentioned that it had completed the first notice or filing required to start a foreclosure, with not deadline by which to pay the {$35000.00}, in full, for us to avoid foreclosure. Warnings of possible legal action from SPS should be sent both electronically, if that is the default selected communication of the borrower, and sent by mail. The later is the most effective and sure way of issuing important/legal communications. SPS is not bound to ONLY send electronic communications. SPSs electronic opt in process does not state that the user waives his/her right to receive communications that should be delivered by mail. ABOUT US : We purchased our home 16 years ago. We have a family of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX During the COVID pandemic, my oldest daughter, XXXX XXXX XXXX XXXX moved out. A couple of years ago, a spouse had a XXXX XXXX and currently is XXXX XXXX XXXX The other spouse is a works from home and is a care provider. CONCLUSION : This wrongful foreclosure action has be an extremely stressful and financially damaging event for our family. NOTE : In XXXX, there is was a {$25000.00} loan from the XXXX XXXX XXXX XXXX.

They have continually and consistently raised our payment and the numbers never add up to the taxes and insurance going up which has happened. They label this the Annual Escrow Account. When I call, which is every year, we go back and forth ( they have been trained on the same lines that are full of lies to block you ) and they mail me a bigger set of papers with the same lies. ( They attempt to make it confusing by making it complicated and thereby obfuscating the Truth, but numbers do not lie. ) Numbers for year XXXX : Insurance went from {$1200.00} to {$1400.00} Taxes went from {$4900.00} to {$5300.00} add that adds up and total {$580.00}. They said there was a shortage of {$2300.00} and they raised our payment by {$190.00}. How? They say from last year but last year they raised they payment too. And it didnt make sense. They finally allowed us to pay Taxes and insurance separately but first they are stealing {$1700.00} from our family.

Consumer Complaint: I closed my escrow account XX/XX/XXXX Select Portfolio Servicing. The servicer claimed to send a check at that time. I called XX/XX/XXXX and was told that it was issued XX/XX/XXXX ( never received ) I requested a new check be issued and was told it would be 3-5 business days. Its now XX/XX/XXXX and I called, they have yet to even issue my check returning those funds as its tied up in a work ticket inside their own system. When I call to find the check, I get told that its a process and a small team. I requested the check be overnighted and tracked - and they say they can not do that. Its ridiculous that I cant get the money back in any other form than a check mailed through USPS, untracked and not monitored. The entire Escrow process is a debacle with this company. They take MONTHS to remove it and MONTHS to return MY money.

Consumer Complaint: mailed by check on XX/XX/XXXX for more than the amount due paying extra on the principle, noticed my check has not cleared my bank on XX/XX/XXXX, spoke to rep at SPS Servicing on XX/XX/XXXX and she said check was received on XX/XX/XXXX but not applied to my account yet, called XX/XX/XXXX told check was received but not applied yet give it until XX/XX/XXXX, called XX/XX/XXXX check still not applied to my account - was told it waiting to be processed - asked to speak to supervisor because received a late notice on XX/XX/XXXX - supervisor told me she is escalating for my payment to be processed - said because it was more than I owed the system rejected the payment- I sent in the payment coupon showing I wanted to extra applied to my principle and I can't not understand why my payment would be rejected and no one has contacted me about it - she said they had to do research to see if there was a prepayment penalty for overpayment - I explained the her they have had the check for over 12 business days - how long does it take to do research and to deposit my check? She replied she had no idea why the process was so long
