XXXX RE : Loan # XXXX SPS Financing, It has been brought to my attention that SPS Financing, better known as Select Portfolio Servicing Inc. held the loan and has been collecting payments from XXXX XXXX since XXXX. SPS Financing sold or transferred the loan to XXXX XXXX in XXXX. According to legal records in XXXX XXXX XXXX XXXX XXXX, the loan was authorized and was taken over by the Government State Entity called the Florida Housing Finance Corporation in XXXX. SPS Financing did not have the authority to sell or trade the loan, offer any modifications, or collect any payments consisting of principle, interest, and escrow. During this duration SPS Financing was not the holder of the loan. Furthermore, the loan was sold/transferred back to SPS Financing from XXXX XXXX from the years XXXX, The official records of Satisfaction Of Mortgage Note and Loan Modification states that the loan was paid off XX/XX/XXXX. I am requesting : ALL PAYMENTS INCLUDING PRINCIPAL, INTEREST, AND ESCROW THAT WAS COLLECTED FOR THE YEARS, XXXX XXXX, XXXX BE REIMBURSED BACK TO ME WITHIN 30 BUSINESS DAYS OF THIS LETTER. Consumer Complaint: I am in a terrible situation with my mortgage because of XXXX which decimated my carpentry business. My lender is Select Portfolio Servicing and they have filed legal paperwork to foreclose on my home, which my father built with his own hands in XXXX. My clientele was primarily elderly homeowners who learned about me through word of mouth over the years. During the pandemic people were frightened to have workers come to their home and my business got very slow and at that same time I was diagnosed of XXXX XXXX and eventually my business shut down. This led to missed mortgage payments. I contacted SPS to try and get help but feel that I was given the cold shoulder. I thought that there were programs available to help homeowners who had financial problems because of XXXX but I don't think that the bank gave me access to any of these programs. After missing several months of payments I received paperwork that I was approved for a repayment plan that raised my payment almost {$300.00} per month. I called into SPS to tell them that this was too expensive and request that I be reviewed for other programs. My current interest rate is 8.1 % and my missed payments were the result of XXXX. But they did not give me a chance to be reviewed for any other programs and started foreclosure against my family in XXXX. We submitted new applications for assistance at the beginning of XXXX and after months of review were told that there were no options. I do not believe this is true. The government offered to reimburse banks through the CARES program and I know that SPS participated. Their denial letters claim that we are denied because of " investor guidelines '' but a pandemic related hardship does not fit into " investor guidelines '' and I think that there should be exceptions that can be made by management in this type of situation. I am not happy with the way things have went with SPS and just want the opportunity for a fair negotiation for a reasonable solution. We have the ability to make our regular mortgage payment, but we do not have the ability to pay back the {$11000.00} in missed payments and fees. SPS has many tools at their disposal to address this situation but instead of allowing access they tell us sorry, we are taking your house because of " investor guidelines. '' Due to the high interest rate they should be able to restructure and modify our mortgage loan and put the missed payments back into the balance of the loan. Or there should be an option to defer the missed payments and resume the regular payment. Either one of those options would work and allow us to save our home. We are now receiving legal notices that they are preparing to sell our home but we don't want to give up.

I emailed Select Portfolio Servicing on XX/XX/2023 via email to supply the requested probate documents : official State of Utah probate document ( Letters of Administration which is what the State of Utah issues to the biological heirs in intestate cases ) ; my father 's death certificate. XXXX. On XX/XX/2023, I received a letter from SPS stating that they will not accept the official probate document I received from the State of Utah due to " applicable law '' which they failed to quote specifically. Since my father left an unsigned will on his computer, Utah State Law 75-2-503 " Writings Intended as Wills '' stipulates that : " Although a document or writing added upon a document was not executed in compliance with Section XXXX, the document or writing is treated as if it had been executed in compliance with that section if the proponent of the document or writing establishes by clear and convincing evidence that the decedent intended the document or writing to constitute : ( XXXX ) the decedent 's will ; " I informed SPS of this state law on XX/XX/2023, as well as provided them a copy of the unsigned will, death certificate, my father 's birth certificate, my birth certificate. I am the sole biological heir, and my father bequeathed his entire estate to me as written in his unsigned will.

I am being scammed out of my property I have owned since 2007 because I have mi insurance which the investor will be paid in full for my loan if they foreclose. I asked my Servicer the number to my investor and could not give me the number.

Consumer Complaint: Select Portfolio Servicing is my Mortgage company and they have taken home insurance out on my home. They have added the insurance payment to my mortgage payments for each month. I recently file bankruptcy and will be paying the insurance payment back to my mortgage company for the insurance they have taken out on my home. I recently have had major roof damage from storms and hail which have caused my roof to leak in several areas in my home. So, I needed to take a claim out and did so and had a claim specialist come out and look at the damage. I received a claim check from the insurance company, and it has my name and my mortgage company name on the check. My mortgage company is refusing to send the check back to me so I can pay a contractor to fix my roof damage and the inside my house ceiling where it leaks. They want to send me a quarter of the money for me to pay my contractor. I can not pay my contractor a quarter of the money because my contractor will only do all the work at one time and will not only do partially of the roof work. So, I am stuck with a damage roof and my ceiling leaking and can not get it fix because my mortgage company is refusing to send me all the claim check back to me. I have recorded conversation with my mortgage company that by law I made sure they knew I was recorded our conversation on several different conversation with different agents telling me to send them the check and they would endorse it and send it back to me. And I have other recorded conversation with agents telling me different stories about what I need to do with the claim check. And I'm also trying to get my own home insurance on my home, so I don't have to pay my mortgage company to take insurance out on my home. But no insurance company will give me insurance with a damage roof until I replace my roof damage. And now my mortgage company is taking their own insurance out on me again and adding the payments to my mortgage payments every month causing my monthly payments to go up on me. I will be more than happy to send the recorded conversation to the CFPB if needed. Thank you.

Consumer Complaint: My home went through three different banks to be modified with no success. Wells Fargo promised me $ XXXX to leave my home which I never received. I had a renter in the home at the time of the foreclosure. She was able to stay almost two years before the sheriff locked her out ( XXXX, XXXX ). Wells ' agent ( out of XXXX Ga ) was made aware that i was a victim of a predatory loan ; my mortgage started at {$1600.00} in XXXX ; it was {$3200.00} by the time I was foreclosed on. There are may other people who were turned out of their home by Wells that got settlements ; I simply want what i am owed for my pain and suffering from losing the only home I've ever had. I have XXXX stage XXXX XXXX, and could use the money since I am now permanently XXXX. Wells owes me ( and I'm sure other folks as well ) who have not spoken out. Don't let them get away with this!!!!

Consumer Complaint: I, XXXX XXXX have applied for mortgage assistance with Select Portfolio Servicing XXXX Inc. on two occasions. Our loan is maturing on XXXX XXXX and we are unable to pay the lump sum in full. A loan modification for the balance was requested. My husband and I had been battling severe illnesses since XXXX. XXXX had XXXX for XXXX XXXX and was out of work. After he returned to work XX/XX/XXXX XXXX caused a lack of work and our finances were strained over the next year. I had a total XXXX XXXX XXXX in XXXX that became XXXX and caused injuries to my XXXX, XXXX and cXXXX XXXX. The XXXX injury lead to XXXX XXXXXXXX XXXX. XXXX lost wages during my illness while assisting me. Payments were late at times.But during the past three years we still kept the mortgage out of default/foreclosure by putting all we had into keeping our home. As of XX/XX/XXXX XXXX and I separated and he moved out of the home. I submitted legal separation documents as well.I have even asked Select Portfolio Servicing for a modification based on the current occupants. I live in the home with my brother who contributes to the household expenses. The first decision was that we were current on the loan so the modification was denied. However the maturity date still needed to be addressed. The second response from the relationship manager was that we were denied because of a delinquency. I was told that there are no retention options. This servicing company and investor seem to be determined to foreclose on my only home because it is worth much more than what is owed on it. They have not shown any interest in assisting homeowners. I have the ability to keep up with a modification and have sent proof of my income as well as my brothers signed contributions statement. If there is any assistance you can render to help me save my home from what seems to be a predatory lender would be greatly appreciated. Thank you, XXXX XXXX

Consumer Complaint: as stated in my XX/XX/XXXX complaint, select portfolio services ( SPS ) is a predatory loan service and foreclosed on my deceased parent 's home during the covid19 federal mandate NOT to foreclose on ANY homes! SPS claims that because they " started '' foreclosure proceedings " before '' covid19 federal mandate was approved, SPS are in the clear to foreclose on any homes. My deceased parent 's home was foreclosed, the excess proceeds are being held by a non-disclosed 3rd party instructed by SPS. XXXXper SPS instructions regarding XX/XX/XXXX complaint, Supposedly the foreclosure attorney ( which SPS did NOT give contact info ), was to " help '' explain where the rightful heirs could obtain their proceeds from the illegal foreclosure sale that happened on XX/XX/XXXX, I called ombudsman at SPS spoke to a XXXX # XXXX and she gave a very inexplicable response as to where the excess proceeds are located and how the rightful heirs can obtain them, SPS also referred me to the XXXX XXXX XXXX 's office and they confirmed there are NO excess proceeds at their offices XXXXI called SPS ombudsman office back spoke to a XXXX XXXX and she refused to allow me to speak with a supervisor in order to escalate the issue further, furthermore SPS refers me to a non-existant foreclosure attorney PHONE NUMBER meaning as soon as you confirm the acct # they transfer to a dead phone line/vmail system that will NEVER answer
