Issue: Trouble during payment process

Consumer Complaint: Before XXXX took over my loan I was with SPS ( Select Portfolio Servicing, Inc. Loan # XXXX ) They did a loan medication for me please see attached documents for proof. Apparently when my loan with SPS was transferred payments were missing to XXXX that were not and paid. On XXXX XXXX, 2014 When I spoke to Nationstar from accounting department he noticed that SPS did not send my loan medication documents and a lot of documents were missing including payment history when the transfer took place. When I spoke to XXXX they were not aware that there was a trial period for a Loan modification and approved before the transfer. In the meantime, there were payments and escrow missing which should not. I was told XXXX didnt receive XXXX, XXXX, & XXXX 2014 payments. Of which Proof of payment history showing XXXX and XXXX 2014 was paid to SPS. When XXXX payment was mailed to SPS Ck # XXXX I was told by SPS that they received this payment and will over nigh it to XXXX tracking # XXXX. At first XXXX told me in XXXX 2014 that they did receive the XXXX 2014 payment and even gave me the check number. After 3 weeks when that check didnt cash I called XXXX and was told they did receive the payment, but dont know what happen to it and if I can put a stop payment on it. Well the next day I received from XXXX a letter with the check stating they are returning it because they dont know where that payment belongs too. So on XXXX XXXX, 2014 not only I wrote another check # XXXX replacing ck # XXXX I also mailed XXXX 2014 payment. So Since XXXX 2014 no one has done anything to correct this issue. From XXXX 2014 till XXXX 2014 I was harassed every day or 2nd day that there is payment missing and my account is past due. Each time you get a different person and I had to explain no when they check my account they see notes and tell me we see proof of payment, but we are very sorry no one has done anything with this. I was harassed and was told research will be done and corrected no one did anything. I was told this will take up to 30days to fix the problem. In the mean Time Im being harassed with phones calls and receiving forecloser letters. On XXXX XXXX, 2014 I was harassed so much and stressed out so much from XXXX irresponsible and unprofessional staff that it caused me to go to the ER with a XXXX XXXX of XXXX that they immediately took me in to give me medication thru the XXXX to bring the XXXX XXXX and not cause a XXXX XXXX. And yes XXXX did call me in the morning on XXXX XXXX, 2014. I have no problem providing proof of documents that I was at the ER that day and what my XXXX XXXX was. As of today I still have not receive reimbursement back for over payment that I was forced to pay to avoid foreclosure. Please help me get my money back.

Attached is your letter dated XX/XX/2017 which appears your unable to find /locate the unauthorized charges which SPS has been the servicer assigned from XXXX and you provided never a response and again doing everything you can to stale /delay and not provide full explanation and simply make additional large excessive profit and simply ripping off consumers. You SPS have carefully, willfully and deliberately hide /refuse to acknowledge or provide proof ( more exact ) number which apparently your unable to locate is {$11000.00} of unauthorized charges ( SEE PAYOFF STATEMENT AND YOUR OWN STATEMENT ). My Principle balance was only XXXX yet you reported to the Title Company unpaid Principal is XXXX. You SPS are hiding interest from IRS and me as the customer. SPS assigned from XXXX XXXX have unauthorized charges to place on my account of {$11000.00} and I demand this money back to XXXX XXXX and XXXX XXXXXXXX XXXX the rightful persons on the mortgage. You find not find any authorization from XXXX or XXXX XXXX XXXX approving these this interest if anything SPS assigned from XXXX has been losing my paper work for six years trying to do a loan modification which SPS FAILED but amazing XXXX XXXX was able to assist. I demand this {$11000.00} that you added as principal which my balance and all these years my interest statement is as reported to IRS is {$84000.00} and that how interest statement were sent to me. You can not just add {$11000.00} to my principal just because you know this was unauthorized charges. I only borrowed XXXX from XXXX XXXX /XXXX XXXX who sold it to XXXX then XXXX XXXX then back to XXXX then to XXXX , its like a game and they never have any answers and always XXXX up our credit, force place insurance on a 20 year old mortgage that is escrowed, and now with this {$11000.00} we are worn out with this types of mortgage companies they all provide the worst service more important they cant provide any approval so we want the {$11000.00} that the stole or added to our payoff as they refused to answer any letters and we were at closing so we had no choice but to close as we been trying to sell this home in Florida for over 2 years so they force this on the title company otherwise the closing would have fell apart. This is a second part to be added to complaint # XXXX. We would never want this to happen to someone else

Consumer Complaint: Select Portfolio Servicing are in violation of HAMP Rules found in Hanbook 5.1, dated XX/XX/XXXX. Section 3.1 of the HAMP Handbook clearly reflects that a a servicer must not refer or conduct a scheduled foreclosure sale " until '' the borrower has been evaluated. Thus, in the event the request is denied, servicer must allowed additional ( 30 ) days to appeal such decision. While on review the servicer contacted their legal representative to re-schedule a sale date. See attached motion to reschedule sale date by the plaintiff on XX/XX/XXXX, while in review for a Federal program Tarp. The Consumer Financial protection Bureau is fully aware that Tarp- is the " centerpiece of the [ Emergency Economic Stabilization ] Act [ of 2008, ] '' bestowing a host of " duties and powers '' upon the secretary of the treasury for the purpose of facilitating economic recovery. XXXX v XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX ( Cir. XXXX ). Hamp is one component of tarp focused specifically on protecting home ownership. See 12 U.S.C. 5219a. Consumer Complaint: Fast history on me. My mortgage is current and has n't been in default for some time now. My property taxes are current. My property insurance is current. My original lender was XXXX XXXX XXXX. Several years back when the economy crashed, my wife 's employer abruptly discontinued their weekend package pay. At the same time, my employer eliminated our department bonuses. This hit us extremely hard and we were unable to pay our property taxes. XXXX stepped in and paid those for us ( {$7500.00} ) because our loan did n't include escrow payments for property taxes. They told us that amount would be interest free and just added to the end of the loan, which they honored. Last year our mortgage was sold to XXXX XXXX XXXX. They told me they would not be pursuing collection of this amount due to my original arrangement with XXXX. Then once again, my mortgage was sold to Select Portfolio Servicing ( SPS ). I 've made several payments to them, on time and in full, but I 'm guessing since I 'm making my payments on time, they are attempting to collect that {$7500.00} in hopes I ca n't afford it and then they can foreclose. Let 's all be realistic and honest here, there 's no other reason for them to be taking this action. I CA N'T control my mortgage being sold. As a homeowner, I have no options to say, no. From everything I 've read online about my rights during a mortgage transfer and based upon what XXXX told me, I do n't believe they have the right to pursue collecting this money right now. The original arrangement was to pay it by the end of the loan. I spoke with XXXX XXXX at SPS on XXXX17 at XXXX XXXX CST. She informed me she would put in a request to try and move the collection to a 60 month term, but that does n't change the fact that I do n't understand how they can pursue this money when my original lender and even the second one both told me it would be kept at the end of the loan. I made an arrangement in good faith and I 've kept my end of the deal by making my payments on time and keeping my property taxes current. SPS should do the same.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: My Request : I have twice this year submitted disputes on two, 30-day late marks on my personal credit bureau reports with XXXX, XXXX, and XXXX. In both cases, the items were not removed, even though prior conversations with the lender stated that these items would be removed, or not even reported in the first place due to special circumstances. In my most recent dispute I even went so far as to write a letter outlining why these items were not valid and reminding the lender that they had agreed to remove these marks from my credit bureau. I have not received feedback from the lender and the disputes filed did not provide any understandable feedback. I am asking the CFPB to raise this issue with the lender and credit bureaus to help relieve my otherwise clean credit report of these two, undeserved marks on the basis of special circumstances even though these should be considered simply on the basis of a 12 year old mortgage with no other payment issues. Background on this relationship : I have held this account with Select Portfolio Servicing since XX/XX/XXXX. My brother and I bought a home together seeking to fix up an old, dilapidated house to live in while we started our careers. Two years later we found, much to our dismay that the loan we thought was a 5 year ARM set to prime was a 2 year arm set to 5 % over LIBOR. It 's bad enough being lied to, but the market had just crashed and we could not even approach refinancing or modifying our note without going into default on our obligation. So even though our rates were as high as 8 %, when other people were paying 3 %, we made our payments on time, even though it did nothing but leave us starving some months. I suppose this makes us a minority in that we honored our obligations when these seemed to be a subsidy on credit default. I mention this because I would like to think that after 12 years of honoring our commitments, someone at SPS would step up and to the right thing. Background on the 2 negative credit marks : The two negative marks in question are for the months of XX/XX/XXXX and XX/XX/XXXX. In both cases and well recorded the mountain area we lived was under severe weather warnings, mountain roads were closing regularly due to avalanche and trees were falling under the severe weight of what turned into a particularly harsh weather period. In XX/XX/XXXX snowfalls exceeding 1 foot per hour were recorded, and by XX/XX/XXXX the XXXX XXXX Mountains had already recorded their biggest winter in recorded history. In both cases we issued our payments, on time, for the mortgage. In both of these cases the next day our deposits were not processed due to issues at XXXX XXXX XXXX where our payments were being debited from. On those particular days the staff of the bank was not able to get in, either at all, or until late. And one person told us, their night deposit had frozen solid. When the issues came to light, I spoke immediately with the lender and corrected the payments. In both cases I was told they would keep this off my credit. Now I just feel lied to again. Now I do n't want to be given the run around, told to a letter from this person and submit to them and be sent in a circle between bank, lender, and credit bureau. I stepped up to my responsibilities for 12 years, through a horrible financial crisis, pinched pennies at times to make my payments on time. I 'd like to know that counts for something, and with someone.

They sent us a letter indicating they had all the information they needed and we were pretty much approved. One week later we were asked again for the same information we have already submitted several times. Based on everything they have done and said they have no intention on giving us a modification, even though they admit they are legally required to do so. We and hundreds of other customers are treated unfairly and are the victims of illegal practices and an overall culture of attempting to stall and do everything possible to not help anyone. They are at best incompetent bumbling idiots that work there or more likely - following company policy which seems to be to help no one and try and accumulate as many fees as possible ... .they charge us for evaluating our property about 6-7 times a year, they charge us to make a payment. They are acting criminally.They are predators and should be stopped.
