Consumer Complaint: In XX/XX/XXXX, our home mortgage was sold to a service provider named SPS ( Select Portfolio Servicing ). On XX/XX/XXXX, we sent the company notification via phone, fax and upload to their website that we elected to pay property taxes directly to the municipality. We did not give consent for SPS to escrow in anticipation of the next quarterly tax payment that is due on XX/XX/XXXX. In response to our call, fax and uploaded document, we received verbal ( recorded ) acknowledgment by a representative named XXXX XXXX on XX/XX/XXXX at XXXX that SPS would NOT escrow our taxes. However, SPS sent out payment for taxes to our municipality at some point prior to our conversation with SPS representative named XXXX on XX/XX/XXXX at XXXX. The due date for taxes is XX/XX/XXXX. We spoke with XXXX and she confirmed that a payment in fact had been made without our consent ( recorded ). She suggested that we go to the municipality and ask them to reject the payment ( which put the responsibility on us to correct an error made by SPS ). She also told us that we could " just pay them ( SPS ) back '' ( recorded ) to correct the error. We are filing an official complaint and want restorative action taken to correct this matter.

Consumer Complaint: In a letter dated XX/XX/2018 it reads that I did not make a payment in XX/XX/2018. I have never missed a payment to Select Portfolio Servicing at any time and I will attach proof of payment. I have also contacted XXXX XXXX. They are immediately sending me documentation that I will forward to your company. I do not know why Select Portfolio Servicing would document this error and would like a correction letter send to me and my account made to reflect that I have not missed any payments to your company. This is a very serious matter to me and I am once again being pushed into a negative account status through errors created by a Mortgage Company ; that then tries to force negative repercussions to those errors, such as Default etc. I have attached payments made in XX/XX/XXXX, XX/XX/XXXX and XX/XX/2018 along with the receipts so there is no error.

Consumer Complaint: My loan started to adjust in XX/XX/XXXX, it has continued to adjust. My payments were about {$1300.00} a month and now they are {$3700.00} a month. They forced an impound on my account when they paid for back taxes when I was in BK. I was in a repayment program with the county during the BK and had done exactly what they county advised me to do. I have been trying to get a modification since XX/XX/XXXX, every time I send the documentation they request they ask for something else. By the time they get back to me it is 3 months and they want more updated documentation or they turn me down with no explanation. It has become a vicious cycle. I live in a beach community, I purchased my home in XX/XX/XXXX. In XX/XX/XXXXwe found a builder, constructor defect that had caused massive mold in my home. I eventually had to file chapter XXXX BK. It had to be torn down to the studs. After having to sue the builder I barely had enough to rebuild. It still didn't fix the problem and I have found leaks each year when we have bad storms. Hopefully I have finally fixed the leaks, it has not leaked in 3 years. When I had to rebuild my home we turned the back bedroom into a studio apartment that I could get {$2000.00} a month income from if and when I choose to rent it out for extra income. I have struggled to keep my home all this time. I rented out my house as a vacation rental a few months of the year to pay my property taxes. Currently I have been forced to rent out my home on a regular basis in order to pay this huge mortgage payment to avoid losing all the equity in my home. I stay with my boyfriend and my children when it is rented out. I have tried to get a reverse mortgage and don't qualify. I don't qualify for a refinance, I am XXXX and have been since I was XXXX years old, I am now XXXX years old and on a fixed income. My home is all I have, all the equity is my retirement, which I can't access. The lender has now stated that they are sending the loan back to the original lender BofA to approve. My loan has been sold 4 or 5 times since the original loan, I don't understand why it would be going to BofA for modification approval. I have tried to sell the home with no success. I owe {$520000.00} on my home, it is worth at least {>= $1,000,000}. After I sell my home with all the realtor and other fees and taxes I won't even be able to purchase another home in the area I have lived at for the past 30+ years. Since I have had to rent out my home on a regular basis I no longer qualify for the {$250000.00} tax credit when I sell it. I love my home, I want to keep my home. I am in desperate of help. I no longer have a savings, everything I have goes to making the {$3700.00} house payment. PLEASE HELP ME The stress of this nightmare is killing me physically and emotionally. My health is worse than it has been in years. I applied for save your home CA, was told I had to take my house off the real estate market, and had to be off at least 2 months. When I called back in XXXX XXXX they were out of money. HARP turned me down because I had too much equity.

Consumer Complaint: I am disputing the debt owed to Select Portfolio Servicing for Acct # XXXX under the name of XXXX XXXX. Select Portfolio Services my loan on behalf of XXXX XXXX XXXX XXXX XXXX, as Indenture Trustee, for the benefit of the holders of the XXXX XXXX XXXX XXXX XXXX Mortgage Backed Notes. I dispute the legitimacy of the XXXX XXXX XXXX XXXX XXXX Mortgage Backed Notes. I have asked Select Portfolio multiple times for information on this trust and have never gotten a straight answer describing or proving it's existence. This is unacceptable to me. I have fallen way behind on this mortgage payments mainly because there has always been an issue with the way this mortgage has been serviced. There have been many deceptive practices by Select Portfolio Servicing. They seem to be more intent on foreclosing on this property than giving me the answers I need to have confidence on where my money is actually going. At this point I would be blindly paying them just to keep my house from being foreclosed on. I have spoken to XXXX XXXX and they can't even give me information on the trust.They tell me that it is XXXX XXXX who has the information on the trust ... I call them and nobody and can me anything about it. I talk to the folks at Select Portfolio and they know nothing as well. This is very odd to me. I want to settle this and get my mortgage back on track. I have the funds to get things back to where they should be I just need some clarity on where my funds are going. Thus should not be such an outrageous request.

Consumer Complaint: XXXX XXXX/XXXX as well as XXXX XXXX, and Select Portfolio Servicing, have not been forth coming with THEIR SIDE of the financials. Meaning for over 12 years my money was DISAPPEARING from my account. I made a complaint 10 years ago requesting this information through H.O.M.E, with no documents. I was advised to do a Chapter XXXX, I did and 2.5 years into the Banckruptcy the lender LIED to my lawyer and my lawyer let them process a " stay '' not sure of the legal term, but it removed them from the bankruptcy. I have ALL DOCUMENTS and CAN PROVE, LENDER FRAUD, WIRE FRAUD, BANKRUPTCY FRAUD, and ESCROW FRAUD.I was not able to get the Lenders financials until I wrote up to the White House last XX/XX/2018. All of my money is gone. These financials ARE Correct as they show every month the banking charges but not my payments and I have every one THE ORIGINALS. I was told by S.P.S. that they were not able to get the financials as when XXXX. sold the note that only like years were sent. I find that very interesting because that is around the time I had stopped paying XXXX. When I could not qualify for the H.A.M.P. program I was told by the Lender that the Note Holder did not pertisapate. At, this point XXXX gave me an in-house modification called CHAMP. This is another rip-off as they added XXXX changing my Original Note from XXXX to XXXX. They closed their account on the Credit reporting agency XXXX as CLOSED-DEED IN LIEU OF ... I NEVER SIGNED ANYTHING!!! I took photos of the Notification I got from XXXX because of course they have lied on their last response back to you. Everything that they are saying are lies and I can PROVE EVERYTHING. Please Please help me, I am XXXX XXXX and I do not want to go through another year of this horrible treatment. Thank you, lets go get these guys once and for all.

Consumer Complaint: In XX/XX/2018 I was laid off from my job and just days later had my wallet stolen. I immediately closed my checking account and opened new account with same banking institution. Unfortunately, I neglected to update online banking information when making XX/XX/2018 mortgage payment ; however, days later it occurred to me and immediately called Select Portfolio. The updated account information was provided to Select Portfolios representative and payment was made. The representative assured me the banking information had been updated online and no further action was required. This was not the case as the following payment for XXXX was returned by my bank as closed account. Although I can appreciate Select Portfolios concern, my sharing that I was assured by their representative in XXXX that my banking information was updated in their system was met with confrontation and requirement for future payments to be made by certified funds. Payment to replace returned check was sent by certified mail and received by Select Portfolio on XX/XX/XXXX. A few days later I received a collection call from Select Portfolio. Imagine my shock when I learned that said XXXX payment of {$2600.00} for XXXX mortgage was applied to line of credit rather than my mortgage. Since the payment on the line of credit is approximately {$330.00} each month, it baffles me why it was posted to that account. I was assured it would be corrected ten days ago and yet it remains unresolved. Unless corrected, I lose benefit of the tax deduction for 2018 for XXXX mortgage payment as a result of their sole action. Further, from a credit standing, it impacts to have late payment as a result of their ineptness and lack of interest to correct. As an aside, I did utilize the ombudsman with not as much as an acknowledgement much less a response. Any assistance you can provide in this matter would be very much appreciated.

Consumer Complaint: i applied for a modificaiton/workout in XX/XX/XXXX to see if they could assist with reducing the payments since I don't have enough income to refinance ; In XX/XX/XXXX they presented me an offer that i declined - because it was only a reduction in payment for 3 mos and then would only reduce my payment by $ XXXX/mo ( this was not in any of my paperwork either ). I have not been late with my payments during this review period and declined it. They reported me late and/or in modification to the credit bureaus and have a " repayment '' payment option for me on their website when I make a payment. I remained current during their review, I continue to be current, i declined their offer, therefore, i'm not late and I am not in modification/workout. I have called 2x for a letter stating same and they won't send it. I want something in writing since so i can fix it with the credit bureau as my score dropped 30 points due to same, which is why i don't believe them, only mortgage reporting drops it that much in a 1 month period.

Consumer Complaint: My previous mortgage servicing company ( XXXX ) would allow online and or phone payments for no charge. That servicer transferred my mortgage to another servicer ( Select Portfolio Servicing, Inc. ). SPS ( Select Portfolio Servicing ) requires the payment of a {$15.00} fee anytime you make a one time online payment on their website. I do not believe this is fair and I question whether it's even legal. And I'm not XXXX. It does not cost them anything to accept online payments. There are no incremental costs to SPS when they accept online payments. Effectively, with no authorization from me, these two companies ( XXXX & SPS ) changed the terms of my mortgage and made it more expensive. I am requesting that SPS be required to allow online payments for no fee.

Consumer Complaint: Select Portfolio requested proof of the XXXX statement that shows my loan was never modified and the detailed history. XXXX has not complied with the terms of the DODD Frank 's Act to allow for consumers to convert subprime mortgages under the HARP program to a fix rate mortgage. XXXX sold my mortgage to Select Portfolio on XXXX XX/XX/XXXX. XXXX is actually still the lender and they denied my request to a loan modification in XX/XX/XXXX. The mandate period expired on XX/XX/XXXX. XXXX was sued for mortgage fraud in XXXX and XXXX. I never agreed to a subprime mortgage. I want this issue resolved asap. Request the FBI, CFPB, SEC, FTC mortgage fraud investigators investigate this matter and add ke to the class action lawsuit against select portfolio. XXXX refuses to resolve this matter and intentionally uses Select Portfolio to avoid penalties and accountability for this mortgage fraud.

Consumer Complaint: My loan is with SPS Select Portfolio Servicing. I was sent two separate XXXX Cancellation debt one for XX/XX/XXXX of in the amount of {$91000.00} and one for XX/XX/XXXX for the amount of {$76000.00}. I have file both XXXX on my taxes. Both years have been adjusted on my taxes. Both amounts have been added back into the loan. Which has increased the of my loan to {$380000.00}. I was informed from several agencies that those amounts should not be added back into the loan because these amounts have been sent to the IRS as a forgiven debt. Which means they have said they can not collect the debt. So why are the added back into the loan. The explanation The servers is say is that because the loan modification was not completed. The amounts have been added back into the loan. So they get the tax break from the IRS and still get to add it back into the loan. I have been trying to get help to get help with my loan and I don't qualify because of the amount stated on my statements. I need help getting this corrected so I can get my mortgage back on track.
