Payment amount : _____ {$1400.00} Date the payment ( s ) appeared on my account statement : XX/XX/XXXX Specifically : I never authorized the debit to this company. Select Portfolio Servicing, Inc., took over my mortgage from XXXX XXXX in XX/XX/XXXX. We didnt know anything about them. They are a small regional firm located in Utah. We didn't trust them. Our mis-trust turned out to be well founded. Each payment we made was done with a physical check and sent via USPS Certified Mail. My check # XXXX was sent this way, and cashed XX/XX/XXXX. Minutes later, Select Portfolio Servicing, Inc. made a second, unauthorized electronic withdrawal of funds from my account in the amount of {$1400.00}. I want Select Portfolio Servicing, Inc., to make this right, pay any fines + overdraft fees.

Consumer Complaint: I acquired the home that i had lived in for 15 years via a divorce. Ex husband gave me the house and a gift of equity and deed was transferred. I had contacted SPS in late XX/XX/2018 after my divorce in XX/XX/2018 to begin to assume the mortgage. The plan according to them was to Assumption of mortgage 1st then a Modification. SINCE submitted all required documents early XX/XX/XXXX i have been in constant communications with them every week since early XX/XX/XXXX. I have submitted and re-submitted documents. They alleged they did not receive certain documents or they will ask me to submit documents because they need certain numbers CIRCLED on my bank statements. I just resubmitted for the 2nd time my childrens income that i get due to my XXXX, even thought all of this was submitted in the initial application. I was originally told mid XX/XX/XXXX that it will be 30 days. It is now XX/XX/XXXX-nearly 2 months later and i am still getting the run around submitting documents all over. I am on social security XXXX and get child support and alimony. all that was documented. this run around has caused me alot of stress-not knowing whether i will wake up with a foreclosure sign on my front lawn. In addition, ex husband gets periodically phone calls from SPS ( the Florida location ) not Utah ) stating NONE of the documents and the application has been submitted. THis is a typical case of the right hand does not know what the left hand is doing. Just too many people handling my case and no resolution. I have also sent emails to Ombudsman over at SPS and that has never been answered. I also sent emails to the agent that is suppose to be handling the case 2 times and he has not answer neither of my emails. Select Portfolio Services is essentially bleeding the equity of my home. i only owe XXXX. but since my ex husband left we are behind. I have since acquiring the home been sending XXXX dollars to cover some mortgage in hopes that i don't fall too far behind. But as far as i can see the money that i am sending is not getting applied and i am now behind XXXX. Of which XXXX or so is late fees and application fees. Consumer Complaint: Hi my is name XXXX XXXX. I have some concerns with my servicer Select Portfolio Servicing. I have a scheduled foreclosure sale schedule soon on XX/XX/2019. Recently I have faxed and mailed in a loan modification Request for Mortgage Assistance form along with all the necessary documents that are essential to having a complete packet. SPS have received a complete Request for Mortgage Assistance packet and its under review. Im still just worried that they will play some game right before the sale and foreclosure on my home. They still have not cancelled or postponed the sale even though they have a complete loan modification packet and its still in underwriting review. This is a continuous game they play and always are putting me on the edge and fear that I will lose my home. Can they just cancel the sale and work with me. Give me a good loan modification with a principal reduction or something that I could afford monthly. However number of financial factors that make it more profitable for a mortgage servicer avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by the servicer. Select portfolio Servicing and all other previous servicers and their Investors conduct was unlawful in that : They engaged in the uniform practice of requesting unnecessary documentation, seeking repetitive submissions of the same documents, and never rendering a decision, and in doing so, such activity provides the basis for an unfair inquiry and could deceive the me because it places burdensome requirements on me that served no purpose but to provide a basis for either engaging in Dual Tracking by selling my home and by denying loss mitigation options, such as loan modifications If they proceed with the sale they will be violating the California Homeowners Bill of Rights Act

Consumer Complaint: My mortgage was transferred to Select Portfolio Servicing ( SPS ) from XXXX on XX/XX/XXXX. When my loan was transferred, there were a lot of problems regarding the interest rate coupled with monies SPS suggested I owed, however SPS has yet to provide documentation for the amounts in question. I contacted Select Portfolio Servicing shortly after my loan was transferred and adv. that my interest rate was incorrect. XXXX offered a rewards program ( XXXX XXXX XXXX XXXX ). Details below. XXXX XXXX XXXX XXXX program provides you with the opportunity to lower your interest rate. After a customer makes 12 consecutive months of on-time payments, the interest rate is reduced by one quarter of one percent ( .25 % ) each year. This rate reduction is available up to 12 times, which means that a customer can achieve up to a 3 percent rate reduction in a minimum of 12 years. This program applies only to closed-end real estate loans. The rate reduction is disclosed in your loan agreement ( not including all states and for all loan programs ). I made timely payments for the first 2 years thereby my interest rate should have been reduced from 11.2 % to 10.7 %. I submitted a copy of the XXXX loan documentation to SPS. Although SPS has yet to provide documentation regarding the outstanding amounts, it was suggested that the interest rate inquiry was resolved. While speaking with a representative on XX/XX/XXXX, she suggested that the effective interest rate on my account was 11.20 %. This was extremely disheartening. Indubitably, I am writing to file a formal grievance against SPS for not honoring the terms and conditions of my mortgage contract.

I filled it out and sent it back there was some confusion with my understanding of this process. I do have a XXXX XXXX XXXX as a result of an accident. This s part of the problem. The concern I have is that I sent in the reply for mediation, without the fee, as I don't have the money. I explained on the phone to XXXX. XXXX a case manager for the State Program. She told me they never received my reply with the money by the deadline. Okay, I told her I had read on the form that if I was low income or having financial difficulty the fee could be waived. She told me No, it could be reduced. I asked why they didn't respond to my request for a waiver. Then she said they never got the reply. I asked since they are an earlier file why did they email me. She told me they can not email people without permission. How baffling, I can't believe it. She emailed a copy of our conversation which I will include. I need to get a mediation for my situation. I have a job as a XXXX XXXX XXXX now but due to a XXXX XXXX problem, I am undergoing a test to address it. Therefore, I am not able to XXXX XXXX XXXX until it is corrected. Also, I am on appeal for the Stolen Car Hit and Run while on the job. I do not expect to lose my appeal but who knows. The date is XX/XX/XXXX. I am trying to find another job in the meantime. To be clear, Oregon law requires MCM to issue a certificate of compliance to a beneficiary that meets certain narrow requirements. The beneficiary met those requirements in this case. MCM does not have any legal authority to reopen your case. Per our conversation today, as I understood you, you stated you were not informed that you had to send a fee. You also told me that you mailed our notices back. You feel that a Certificate of Compliance should not have been issued and you feel that since you did not understand the notices and the requirement to pay a fee by the deadline of XX/XX/XXXX, that you should be allowed to participate in the Oregon Foreclosure Avoidance Program and meet with Select Portfolio Servicing , Inc . Consumer Complaint: I purchased my home in XXXX and suffered a hardship in XXXX but was able to reinstate my loan in XXXX with XXXX XXXX after paying XXXX shortly after that I missed 5 payments when in XX/XX/XXXX XXXX offered me a loan modification to begin in XX/XX/XXXX I made my 3 trial payments and continued paying as agreed when in XX/XX/XXXX my loan servicer was switch to select portfolio services by XXXX I continued paying as agreed when in XX/XX/XXXX I was informed that select portfolio would b applying my XX/XX/XXXX payment to an XX/XX/XXXX payment that was missed. I explained I had accepted a modification and did not miss any payments. in a follow up conversation with select portfolio services I was now being told I missed 3 payments XXXX, XXXX, XX/XX/XXXX. I explained that I had made the payments to XXXX and that I could prove it. I was ask to do so which I did I sent select portfolio services copies of the cashiers check and money orders before I could contact them to follow up I was now receiving foreclosure letter stating that I was behind {$25000.00} so I reach out to select portfolio services who was suppose to be looking into my payments which I had sent proof of payment to them they now said I would have to pay this amount and to go to court which I did go to court and they continued with the foreclosure. I assumed they would figure it out appoligize and we would move forward but that was not the case they continued the foreclosure. sending me documents stating my last payment was made XXXX I went to hud for assistance with this issue and now select portfolio services stated that I was offered a modification in XX/XX/XXXX and failed to accept it. which is incorrect I received my modification offer in XX/XX/XXXX to begin in XXXX XXXX and XX/XX/XXXX trial payments in the amount of XXXX from XXXX which I accepted and complied with the payments and they continued billing me statements where from XXXX when I had still been paying at the time and had proof of nine payments after that date at which time they said they would look into it once again but they where disregarding my whole modification and payments which I had received prior and accepted through XXXX prior to being transferred to select portfolio services. I was told the only resolution would be to contact their attorneys XXXX XXXX XXXX to ask for a reinstatement amount. I called in my payments monthly to select portfolio who drafted the funds from my account and was never told of a problem before XX/XX/XXXX when this problem began all my calls where recorded by select portfolio with my permission and all I did was plead with them to look into my payment history which they never did. that proves I was already paying prior to these calls. my modification originated through XXXX which I accepted and continued paying they are now stating I failed to accept a modification offered to me in XX/XX/XXXX in the amount of {$1300.00} when I was paying {$1900.00} since XXXX XXXX and XXXX and continued to pay through XX/XX/XXXX I would have definitely took advantage of an offer saving me an additional {$600.00} a month. all I want is that my original modification be honored as agreed by myself and XXXX.select portfolio services stated to me that they do not honor modifications and do not offer them either if you look throughout this whole ordeal they have never themselves offered me any modification.

We borrowed {$30000.00} to repair a rental property we own. XXXX has done a lot wrong with our contract, changing most of it without consulting us. Early in XXXX XXXX started referring to themselves as my mortgage company. Because we have no mortgage ( paid off in XXXX with XXXX XXXX XXXX ) I questioned XXXX about what they thought they were doing. I accused XXXX of predatory lending and started looking for a attorney to help me with this issue while I continued paying on the account. On XXXX I got a letter from Select Portfolio saying. they will be servicing my 2nd mortgage account. I called select portfolio and spoke with, XXXX XXXX. I told her I was seeking legal help with XXXX and to please wait until my complaint against XXXX was addressed. I continue paying XXXX but stopped when XXXX returned the last two payments I sent them. I felt that going forward with an innocent, Select Portfolio would leave my wife and me Unable to recover position. So payments did not go to Select Portfolio, ever.Now Select Portfolio is attempting a foreclosure. They dont hold a mortgage for this property. Please help.
