Consumer Complaint: We want Sps mortgage inc investegated you are the servicer on our mortgage. Our loan was originated back in XX/XX/XXXX. We are victims of a predatory loan. We were misrepresented by the mortgage broker and by XXXX XXXX when this loan was originated. We have reviewed our loan with specialist in the industry and there was fraud on documents from the mortgage broker to the banks and forgery on loan documents and disclosures. Since this loan was originated this loan has been passed along from XXXX XXXX, to XXXX XXXX and now Sps mortgage inc. We also have checked with title specilist and Sps does not hold legal title on our home properly to foreclose on our home since title recording on purchase date and from all the loan transfers from bank to bank .The title chain is broken and not correct. We are victims of predatory lending and now we are stuck with a toxic loan, Due to all these greedy large banks and corporations trying to maximize profits on homeowners that got these toxic loans. We want to hold these corporations accountable for the problems you have caused to our family. We have tried to work with sps over and over to fix our toxic loan and it just seams to fall on deaf ears. We will continue to defend our home until there is a fix on our mortgage. Consumer Complaint: SPS Select Portfolio Servicing, PO Box XXXX, XXXX XXXX XXXX, Utah XXXX are attempting to collect XXXX XXXX dollars for a mortgage that no longer exists. This mortgage was a result of an Identity Theft Fraud/Forgery prosecuted by the U.S Attorneys Office in NYS. The mortage was vacated by a XXXX Supreme Court Judge in XX/XX/2013, yet they continue to bill, attempt to foreclose, attempt to lock out owner, winterize the property and change the locks, serve documents to the wrong address. They have trespassed, harrassed and continue their predatory aggression even after being put on notice by an licensed Attorney. They have issued home owners policys in our name, Even after being served with proof the home was already insured. Given our correct address and phone number and asked to remove the erroneous file. They have assessed taxes and fees and post transaction acceleration fees even though they are illegal in NYS. They have not deceased attempting to collect a debt that does not exist.They have trespassed in attempts to lock us out of our home, board it up and change the locks. If my realtor was not there, they would have succeeded.

Consumer Complaint: Last month, our mortgage provider switched to Select Portfolio Servicing. The name of our road was changed a good ten years ago ; Select is unaware of this. We have a main house and two small structures on our property -- this is the way it had been for around 15 years, yet Select is unable to understand this. I can not explain over and over again that the name of our street was changed over a decade ago. I can not explain over and over that we have a main house with two smaller structures. This is more than annoying -- for 18 years much of our insurance coverage had been paid via our escrow account. Because of Select, I have had to pay a substantial amount for coverage from my own pocket. This has never happened before in all the years we've lived here -- and I'm simply can't afford to suddenly pay for this coverage out of pocket. The switch to Select has been a disaster.

Consumer Complaint: Dear Madam or Sir : I understand that under Section 6 of RESPA you are required to acknowledge my request within 20 business days and must try to resolve the issue within 60 business days. Please treat this letter as a " qualified written request '' under the Real Estate Settlement Procedures Act, 12 U.S.C. Section 2605 ( e ). I am writing to you to complain about the accounting and servicing of my mortgage and my need for understanding and clarification of various charges, credits, debits, transactions, reversals, actions, payments, analyses and records related to the servicing of my loan from its origination to the present date. To date, the documents and information I have, that you have sent me, and the conversations with your service representatives can not answer my many questions. It is my understanding that your company has been accused as engaging in one or more predatory lending and servicing schemes. As a citizen, I am extremely concerned about such practices by anyone, let alone my own mortgage company or anyone who has held a beneficial interest in my QUALIFIED WRITTEN REQUEST COMPLAINT DISPUTE OF DEBT/ VALIDATION OF DEBT TILA REQUEST Page 2 of 8 loan. I am concerned that such abuses are targeting the uneducated and uninformed consumer and disadvantaged, poor, elderly and minorities. Needless to say, I am more concerned as an alleged borrower. I am worried that potential fraudulent and deceptive practices by unscrupulous mortgage brokers ; sales and transfers of mortgage servicing rights ; deceptive and fraudulent servicing practices to enhance balance sheets ; deceptive, abusive and fraudulent accounting tricks and practices may have negatively affected my credit rating, mortgage account and/or the debt or payments to which I am legally obligated. Because of this and other reasons that leave me to believe that I may be a victim of predatory lending, I am disputing the validity of the current debt you claim I owe. By debt I am referring to : 1. The principal balance claimed owed ; 2. My calculated monthly payment, 3. Calculated escrow payment 4. And any fees claimed to be owed by you or any trust or entity you may represent. I have reason to believe that the loan terms were misrepresented to me at the time of application and further obscured and/or modified prior to signing. I believe that my income may have been inflated on the application. I also have reason to believe that certain statements were not provided for my approval prior to closing, and that signatures may have been forged on various documents. It is also my belief that certain documents may have not been presented at all. Additionally, I believe that a notary was not physically present to witness my signatures on several pertinent documents and that I was ill advised at the time of closing. To independently validate my debt, I need to conduct a complete exam, audit, review and accounting of my mortgage loan from its inception through the present date. Issue: Struggling to pay mortgage

Consumer Complaint: Hi my is name XXXX XXXX. I have some concerns with my servicer Select Portfolio Servicing , Inc . I have a scheduled foreclosure sale schedule soon on XX/XX/XXXX. Recently I have faxed and mailed in a loan modification Request for Mortgage Assistance form along with all the necessary documents that are essential to having a complete packet. SPS have received a complete Request for Mortgage Assistance packet and its under review. Im still just worried that they will play some game right before the sale and foreclosure on my home. They still have not cancelled or postponed the sale even though they have a complete loan modification packet and its still in underwriting review. This is a continuous game they play and always are putting me on the edge and fear that I will lose my home. Can they just cancel the sale and work with me. Give me a good loan modification with a principal reduction or something that I could afford monthly. As part of this bailout, on XX/XX/XXXX, the United States Government took over XXXX XXXX and pumped billions, which in XX/XX/XXXX, then Treasury Secretary XXXX XXXX said as much as {$200.00} XXXX would be pumped into XXXX XXXX and XXXX XXXX, each, which was separate from the {$700.00} in TARP funds given out to other lenders. 1. The guidelines issued by the United States Treasury set forth a detailed process whereby a participating servicer, either action or not acting through its subsidiary, must : a. identify loans that are subject to modification under the HAMP program, both through its own review and in response to requests for modification from individual homeowners ; b. collect financial and other personal information from the homeowners to evaluate whether the homeowner is eligible for a loan modification under HAMP ; c. institute a modified loan with a reduced payment amount as per a mandated formula, that is effective for a three-month trial period for borrowers that are eligible for a modification ; and d. provide a permanently modified loan to those homeowners who comply with the requirements during the trial period. Whether the homeowner qualifies for a modification or not, participating servicers are also required to provide written notices to every mortgage borrower that has been evaluated for a loan modification, whether or not the borrower has been found eligible. HAMP and its associated directives also set prohibitions against certain conduct including demanding upfront payments in order to be evaluated for a loan modification, instituting or continuing foreclosures while a borrower is being evaluated for a loan modification, assigning a single point of contact, maintaining an adequate level communication with borrowers, maintaining proper caseload to ensure HAMP objections are met, and restrictions on the way a servicer may report the borrower to credit reporting agencies. All servicers have systematically failed to comply with the terms of the HAMP directives and has regularly and repeatedly violated several of its prohibitions. Now that HAMP is over and expired due to servicers prolonging these modifications they are now proceeding with other alternatives. Under HAMP, the federal government incentivizes participating servicers to make adjustments to existing mortgage obligations in order to make the monthly payments more affordable. Servicers receive at least {$1000.00} for each HAMP modification. However, this incentive is countered by a number of financial factors that make it more profitable for a mortgage servicer avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by the servicer. However, this incentive is countered by a number of financial factors that make it more profitable for a mortgage servicer such as Select Portfolio Servicing , Inc. to avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by Service companies because Service companies do not carry a significant risk of loss in the event of foreclosure. California Business and Professions Code 17200 et seq., also known as the California Unfair Competition Law ( UCL ), prohibits acts of unfair competition, including any unlawful, unfair, or deceptive business act or practice as well as unfair, deceptive, untrue or misleading advertising. Select Portfolio Servicing, Inc. and all other previous servicers and their Investors conduct was unlawful in that : They illegally began and prosecuted the non-judicial foreclosure based on the lien to the 1st Deed of Trust, despite i was not in breach of payments on said lien ; They engaged in the uniform practice of requesting unnecessary documentation, seeking repetitive submissions of the same documents, and never rendering a decision, and in doing so, such activity provides the basis for an unfair inquiry and could deceive the public because it places burdensome requirements on me that served no purpose but to provide a basis for either engaging in Dual Tracking by selling my home and by denying loss mitigation options, such as loan modifications ; They failed to properly consider loan modification applications before trying to sell my home. 1. On information and belief, Select Portfolio Servicing , Inc. does not own a significant majority of the loans on which it functions as servicer. 2. Economic Factors that discourage Select Portfolio Servicing , Inc . XXXX from meeting its obligations under HAMP by facilitating loan modifications include the following : a. Select Portfolio Servicing, Inc. may be required to repurchase loans from the investor in order to permanently modify the loan. This presents a substantial cost and loss of revenue that can be avoided by keeping the loan in a state of temporary modification or lingering default. b. The monthly service fee that Select Portfolio Servicing , Inc. as the servicer, collects as to each loan it services in a pool of loans, is calculated as a fixed percentage of the unpaid principal balance of the loans in the pool. Consequently, the modifying of a loan to reduce the principal balance results in a lower monthly fee to the servicer. c. Fees that Select Portfolio Servicing , Inc. charges borrowers that are in default constitute a significant source of revenue to it. Aside from income Select Portfolio Servicing , Inc. directly receives, late fees and process management fees are often added to the principal loan amount thereby increasing the unpaid balance in a pool of loans and increasing the amount of the servicers monthly service fee. d. Entering into a permanent modification will often delay a servicers ability to recover advances it is required to make to investors of the unpaid principal and interest payment of a non-performing loan. The servicers right to recover expenses from an investor in a loan modification, rather than a foreclosure, is often less clear and less generous. e. Fixed overhead costs involved in successfully performing loan modifications involve up-front costs to the servicer for additional staffing, physical infrastructure, and expenses such as property valuation, credit reports and financing costs. 4. Rather than allocating adequate resources and working diligently to reduce the number of loans in danger of default by establishing permanent modifications, Select Portfolio Servicing , Inc. has serially strung out, delayed, and otherwise hindered the modification processes that it contractually undertook to facilitate when it accepted billions of dollars from the United States. Select Portfolio Servicing, Inc. delay and obstruction tactics have taken various forms with the common result that my loan serviced by Select Portfolio Servicing , Inc., in which iam eligible for permanent loan modifications, and have met the requirements for participation in HAMP, have not received permanent loan modifications to which iam entitled. 5. By failing to comply with the California Homeowner Bill of Rights ; specifically, by engaging in the unlawful practice of Dual Tracking, Select Portfolio Servicing , Inc. has left me in a state of despa ir and panic as I seek a loan modification from Select Portfolio Servicing Inc., only to have my home wrongfully, oppressively and illegally sold out from under my feet. If they proceed with the sale they will be violating the California Homeowners Bill of Rights Act

Issue: Trouble during payment process

Consumer Complaint: On XX/XX/XXXX, we received notification from XXXX XXXX XXXX that our mortgage servicing was transitioning to Select Portfolio Servicing effective XX/XX/XXXX. On XX/XX/XXXX, once we verified the mortgage service moved, we paid our mortgage in the amount of {$1600.00} which they deposited on XX/XX/XXXX. We have paid our mortgage on XX/XX/XXXX and you deposited it on XX/XX/XXXX in the amount of {$1500.00} and on XX/XX/XXXX we paid {$1600.00} and on XX/XX/XXXX we paid {$1700.00} and our mortgage remains current and paid according to the invoices they send out on a monthly basis. On XX/XX/XXXX, SPS transferred {$1900.00} to XXXX XXXX for our homeowners insurance that they labeled as hazard insurance In XXXX, we moved our servicing of our homeowners insurance to XXXX XXXX and informed XXXX XXXX that we would be paying directly to XXXX XXXX to earn discounts as we arranged all our insurance needs under one umbrella. XXXX XXXX is our insurer today. The payment SPS sent on XX/XX/XXXX from our escrow was made in error, we pay XXXX XXXX directly. Our XXXX XXXX agent confirmed that on XX/XX/XXXX they returned the funds to SPS Select Portfolio Servicing. Those funds were returned to SPS in XXXX and they withheld the funds from our account for 3 months. On XX/XX/XXXX, SPS sent a refund check in the amount of {$1300.00} which is {$620.00} short of the overpayment. We have served SPS with 2 notices of error regarding this matter. SPS fraudulently took money from us that was an overpayment of our Homeowners Insurance when we owed nothing to them as our mortgage and escrow accounts were 100 % current based on their billing. We believe that SPS took {$620.00} in funds, without explanation, to insert into an Escrow account and boost the value of the account ahead of schedule and we believe this a breach of contract on our mortgage.

Consumer Complaint: I applied for a home loan modification and was denied. In XXXX I was going through a divorce.. That same year I was diagnosed with XXXX. The XXXX treatment ended up causing a XXXX XXXX. Between not being able to XXXX and the the XXXX treatment I was unable to work for years and was unable to pay my mortgage. I am now fine and have been working since the end of XXXX. My income is enough to pay my mortgage payments. My request for mortgage assistance was to defer my payments. I just wanted to make good on the payments but just push them to the back of the loan. I wasn't requesting a payment reduction but was still denied.
