Consumer Complaint: SPS was not participating in Covid-19 relief therefore denied us for modification at least 6 times. They did refer us to Georgia HAF for assistance. We provided them with ALL documentation to prove our setback was due to the Covid pandemic. We were given a grant for {$32000.00} to bring our mortgage current. Our problem with SPS is the credit reporting. Under the CARES ACT, there are not to be any delinquent credit reporting due to the Covid Pandemic. SPS refuses to remove past due reporting during this difficult time. We are seeking your assistance in having them removed. Thank You

Issue: Trouble during payment process

Subissue: Payment process

Consumer Complaint: This is the third complaint that I'm filing against this company on how they apply my mortgage payments. As of the time of my writing, I have {$6000.00} in non interest bearing account called " UNAPPLIED PAYMENT '' that they did not apply to my account so that my interest can be reduced. I have called several times- asking them to apply all my monthly excess payments towards principal. So far, they have not done so. I will like to know how my loan can be moved from this loan servicer because they're costing me money and I don't trust them because of their actions so far. They also charged me {$97.00} for some nonsense that they did not notify me about. Thanks

Issue: Trouble during payment process

Subissue: Loan sold or transferred to another company

Consumer Complaint: At the end of last year, through the first part of 2023, I worked with my previous mortgage servicer ( XXXX XXXX ) to modify my loan. The process got delayed when I reviewed the XXXX & XXXX and disagreed with them. After a couple of months, we came to an agreement and all the paperwork was signed and officially executed. Almost immediately after signature, my loan was sold ( the notice for the sale of the loan happened a month before ). This was XX/XX/2023. As of XX/XX/XXXX, the loan still has not been fully boarded. Since XX/XX/XXXX I have followed up weekly, trying to facilitate completion. Each time I called, I got different rationales for the delays and what needed to occur, including : XXXX. Wait 60 days, thats how long it takes to board - We are beyond that XX/XX/XXXX date XXXX. The paperwork wasnt received - on other calls, confirmed it was received and I have a copy directly from them ( my loan modification ) 3. Paperwork was never completed because it wasnt notarized. Both the new servicer and on my own, have validated that it did not require a notary, and I was told I completed all actions 4. After 60 days, be patient 5. Asked for the paperwork to resign and was told it would be sent, but it was never sent In the interim I am getting demand notices, notices that my modification is no longer approved since I did not complete paperwork in time. They erroneously paid real estate taxes ( I have no escrow ) and worse, to the wrong period due. I tried to make payments and was told not to make payments until everything was resolved ( I ended up making my XXXX payment and will make my XXXX payment by the end of the month ). Threats that my mortgage would foreclose potentially in XXXX. I finally lost my patience yesterday. After working with someone who claims to be in their Executive Office for the last two weeks with her promise to facilitate completing and staying in touch. She calls me once-a-week to tell me basically nothing. XXXX she said they FINALLY received the paperwork from the other lender ( confirmed from previous phone calls they received it at least XXXX weeks ago ). I asked for a timetable to complete. She could not give me one. I asked her what the issue was with the boarding. She did not give me one. What makes it worse is I get emails/texts/calls about being delinquent. To add to it, when she calls me she asks if she can record the conversation. I ask the same question and she says no ( as I now, apparently know, in XXXX I can record if I consent to the recording ), in preparation for a lawsuit. I have asked them to retain recordings. I want everything on record. She then tells me that anything discussed will be used to collect a debt, before giving me an update with no information. She told me to ignore the demand letters and I asked her to put that in writing and she said that she could not do that. Finally, my online dashboard shows incorrect amounts paid to my previous lender ( omitted payments ), incorrect escrow, incorrect tax information and incorrect last payment date.

Consumer Complaint: I have applied for a loan modification with Select Portfolio Servicing ( SPS ) in XXXX of XXXX and was approved. However the payment I was approved was {$10000.00} a month which I believe is egrecious and predatory. The loan amount is only {$580.00}. I'm not sure if the payment is so high due to race because I'm an XXXX or they are just trying to take my house. My wife and I both experienced covid and fell behind. We are now both back to work. I would like to work with them and work out a more affordable and reasonable payment. We would really like to stay in our house, Any assistance you can give in regards to this matter would be greatly appreciated.

Consumer Complaint: In XX/XX/, I asked for an impound analysis of my escrow account, because I knew it had been overfunded. On XX/XX/XXXX, I called the company and confirmed that they would be issuing me a refund of {$15000.00}. They subsequently informed me that they had issued the check on XXXX XXXX XXXX I never received that check. I followed up several times and received no plausible explanation of where my refund check was. On XX/XX/XXXX, I called again and spoke at length with a customer service rep and a supervisor. I was told the original check could be voided and a new one issued. I consented. However, by now it was clear that the company is in violation of Rule X of the CFPB. On XX/XX/XXXX, I received new electronic correspondence from the company indicating that they had erred in their escrow analysis and I was only entitled to a refund of approximately {$9600.00}. On XX/XX/XXXX, I called them again and told them they had to issue my refund and overnight it to me or I would be filing a complaint with the CFPB. Here we are.

Consumer Complaint: I am beside myself at how horrific SPS has mishandled my loan assumption request. The mortgage with SPS was in my father and mother 's name ( XXXX XXXX XXXX and XXXX XXXX ). They both passed away when in the process of doing a loan modification. After their passing, the law firm I hired has helped me apply for a loan assumption so I can assume the loan of my parents and keep the family home. The law firm told me that this is by far the worst mishandling of a file that they have seen in the past 10 years. On XX/XX/, a complete Successor in Interest package was submitted to SPS. We later found out that they never did anything with the documents or update the file to show me as the Success or Interest. A new loan assumption package was submitted on XX/XX/XXXX with all of the same information, but with updated documents to ensure the package was complete. From this point, I could go on forever about how many times the law firm followed up to find out that they claimed the XXXX form was blank that they received. They had over 10 managers involved who pulled the emails and confirmed the XXXX was all correct and not blank. Yet, they continued to ask for documents they already had and we had to continue fighting a battle that never should have happened. The managers at SPS openly admit that their system automatically uploads the documents into the system which clearly caused an unacceptable delay when they had the Successor in Interest documents back in XXXX of XXXX and a complete financial package on XX/XX/. It literally took almost 3 and a half months of them making mistakes, requesting documents they already had on file, delaying reviewing the file timely before we received a letter stating the application was complete. The major issue I have that is not acceptable on any level is that due to their major delays, which were 100 % on their end, they ordered the sale on my home and it is now set for XX/XX/! First, the sale NEVER should have been ordered to begin with as the only reason the file wasn't deemed complete back in late XXXX or early XXXX is completely the fault of SPS. It's truly at the point that it looks intentional and unethical at the highest level. Over 10 managers had reviewed and confirmed SPS 's mistakes and said they would get it corrected over the past 3 and a half months but never did they actually do anything to fix the issue to ensure the file was deemed complete. In the complete assistance application review letter that I have attached from SPS, they clearly outline that they will advise their attorney to postpone or cancel the sale date while the file is in review. Yet, when the law firm continues to request that the sale date be postponed or withdrawn, they won't do it. This is completely unethical and the sale date needs to be cancelled immediately! Lastly, the law firm received another letter today requesting additional information. It never ends as they just keep screwing up! My law firm clarified the question they had today so they can't try to claim they don't have everything they have requested and continue to request.
