I need a Loan Modification that reduces my Loan rate from 7 % Predatory Loan Yes, XXXX XXXX is redoing my loan and NOT reducing the loan Rate. I am going to have to write President Trump for this FRAUD. This is my 4th Complaint and Consumer Financial Protection Bureau DOES NOT HELP US! Consumer Complaint: I am writing to report illegal activities of SPS Select Portoilio Servicing , Inc ( SPS ). This company is taking advantage of the Covid-19 crisis, to illegally extort moneys from consumers, knowing that legal help is limited during the crisis. SPS a mortgage servicer charged me an extra {$5700.00} on XX/XX/XXXX, stating they are doing this on my behalf due to urgency surrounding delinquent taxes. This amount was added to my mortgage in addition to extra high interest. This is very false and there are no deliquent taxes in XXXX. Secondly SPS sent me a letter stating that I called to deffer my XX/XX/XXXX mortgage payments because of Financial hardships with documents that reflect a delay in the maturation of the loan. This is also very untrue and my mortgage for XXXX had been paid before the letter was sent. I have never called SPS to discuss any financial hardships.This is a scam and false information.

Consumer Complaint: Issue : My mortgage company is not reporting my payment history to any of the big 3 agencies. Two years ago I contacted my mortgage company via US Post Office : Select Portfolio Services XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX and asked them to please report my credit history to the 3 credit reporting agencies. Never received any response. In XXXX of XXXX I sent letters ( via US Post Office ) to XXXX XXXX, XXXX, and XXXX. I included in each communication a copy of my most recent monthly Mortgage Statement. I explained that Select Portfolio Services has been the company receiving my mortgage payments for over 10 years and has not ever provided any agencies with my payment history. ( Which has been perfect the entire time. ) After waiting about 3 weeks, I received one response from one of the three companies. I have received no other responses since then. Last week, I checked my credit reports ( hoping to see something positive ) and confirmed that no action has been taken by any of the three companies. What I want : I want Select Portfolio Services to report my perfect payment history to XXXX XXXX, XXXX, and XXXX. Also : Since XXXX of XXXX, I have had a perfect payment history with my Utility Company. ( XXXX XXXX XXXX ). Is it possible to have this perfect payment history reflected in my credit reports as well? Thank you for your attention. Thank you

Consumer Complaint: This letter is to support our CURRENT XX/XX/XXXX application for a loan XXXX modification plan that will help us to get our mortgage payments back on track with an affordable mortgage. We have lived in our home for over 17 years, and we want to work hard and keep it. We fell behind on our mortgage payments due to loss of employment because of a merger acquisition. We had a tough time dealing with our debts due to unexpected job loss. As of XX/XX/XXXX, my employer terminated my employment due to merger acquisition. My previous company was bought out, and my services were deemed unnecessary. The Spouse is employed and the wife is a XXXXr. The mortgage company requested her income tax after she consented to IRS pulling her employment tax data of XXXX income. The mortgage has insisted that I have an income and I do not. Subsequently, We began the process of Retention Mortgage Assistance modification in XX/XX/XXXX by spouse Select Portfolio Servicing denied that request in XX/XX/XXXX. We continued to communicate with SPS in XX/XX/XXXX, the spouse was told he did not qualify for XXXX programs, and he could agree to a repayment plan of {$4500.00} a month with a job loss. That repayment plan would be for six months and would require an additional XXXX per month for an approx total of XXXX per month until the outstanding amount repaid. the spouse denied this plan as I was unable to pay due to recent job loss. Being unemployed, I was forced to use all of my savings and 401k to keep up payments current. SPS did not offer a loan modification nor a reduced payment option. As of XX/XX/XXXX, I began to fall behind after using all personal funds to pay the current mortgage. Being denied XXXX mortgage modification in XXXX negatively impacted my household We requested another XXXX XX/XX/XXXX. We have submitted pay stubs, detailed letters of the hardship forbearance, YTD, Profit Loss Statements, contracts, and signed documents of job loss, income tax. The wife has no income and no XXXX income tax ), and a XXXX FORM COMPLETED XX/XX/XXXX, SPS requested a {$10.00} clarification of The HOA dues are {$100.00} a month. The HOA dues are current and PAID in full. The current XXXX has been in process since XX/XX/XXXX, before the account was referred to an attorney XXXX XXXX XXXX XXXX XXXX XXXX ) XXXX XXXX NC. When I questioned the {$1500.00} fee it was reduced to {$400.00} fee and attorney line detail added on XX/XX/XXXX. We have received confusing information from each representative about the XXXX process and one thing is consistent our home is in Foreclosure. We have submitted information and called since my husband lost his job and received no assistance on how to resolve the problem. We are requesting SPS to work with us to keep our home. On XX/XX/XXXX, SPS sent a city inspector to my home at the request of the law firm to begin the FORECLOSURE process during the CORONA VIRUS. We are confused about how our XXXX is being processed unbiased as it has been giving to an attorney with a {$1500.00} legal fee to begin the foreclosure process during the XXXX. XXXX ext XXXX stated that an attorney is handling all communication. XXXX was abrupt during the conversation and said I could call back as I discussed my home circumstance. The discussion was unilateral and biased. During the conversation with XXXX, My interpretation is that SPS has decided NOT to provide any valuable retention assistance for my home. SPS is stalling the XXXX submission as the attorney requests inspections and moves forward with a FORECLOSE during the pandemic. I would not want this to be the perception that SPS is trying to push my family in FORECLOSURE. I am requesting the outstanding amount be placed in the back of the loan as my income has increased. My goal is to avoid filing Bankruptcy and repayment the balance. We would like a forbearance as we work to get our finances back on track in XX/XX/XXXX. We are making an effort during the recent tornadoes and COVID 19 pandemic. T XX/XX/XXXX, SPS Select representative stated the spouse was missing W2 paystubs. the spouse is a XXXX non-employee wage earner and has submitted documents consistent with his independent contractor. Please see documents submitted on XX/XX/XXXX, the spouse has submitted non-employee ie Bank account deposits, income tax, XXXX Pay stubs, wages, and XXXX. the spouse is an independent XXXX. and has provided all required documentation by federal and state law. During my conversation on XXXX XXXX SPS per conversation via telephone cust service, SPS Mortgage requested Profit Loss Statements. Today a Foreclosure Letter was mailed to my address during the modification application. The application states that all foreclosure processes will discontinue however I have continued to receive letters of the foreclosure sale date. The Foreclosure sale date. I asked the customer service representative how the XXXX was being processed unbiased and I received a foreclosure sale date. The required documents have been submitted as required by SPS. It is unfortunate that SPS Select has made this egregious decision to proceed with foreclosure as my husband and I was trying to work out repayment terms. Avoid a breach contract claim. I am filing this with the State Attorney General office, HUD and Dept of Justice. This unethical and egregious behavior could have been eliminated by SPS during these unprecedented times. My husband is an essential medical provider during COVID 19. We have not received an answer to the modification request or ALL required document to be submitted required by law. I will not allow an SPS fraudulent company to sell my house like they have done other consumers. Consumer Complaint: Item 1 : SPS failed to provide all items requested in the First Qualified Written Request ( First QWR ) in particular any and all legal documents identifying SPSs Standing to collect my mortgage payments, as an alleged servicer, in view of the case XXXX v. XXXX XXXX XXXX ( ANx ) in the XXXX XXXX of California and further in view of California Supreme Court case XXXX XXXX XXXX XXXX XXXX Mortgage XXXX. Item 2 : Limited response provided by SPS regarding my mortgage balance is willfully and fraudulently misrepresented by mixing many other unrelated pages in double sided printing without any continuity of any page number. To date, I have incurred {$4500.00} attorneys fees to decipher what was in SPSs limited response. Simply it is NOT understandable, even to a skilled attorney and litigator with over 35 years of experience. Item 3 : Internet search revealed that SPS has negative reputation. SPSs owners/executive officers and SPSs primary business objectives are to fraudulently manufacture via illegal loop holes ( such as willful misplacement of payments and fraudulent purchase of forced placed expensive property insurance, in spite a customer having a property insurance already XXXX to foreclose customers home. Internet chat revealed that SPS is organized like a Racketeer Influenced and Corrupt Organization ( RICO ) .To this effect, it appears that SPS fraudulently tried to cancel my property insurance with XXXX XXXX and purchase a forced placed insurance ( subject to discovery and subpoena ) and this also breaches XX/XX/XXXX Written Settlement Agreement between XXXX and XXXX subsequently by SPS. I have my property insurance through XXXX XXXX since about XXXX, as it bundled with my auto insurance. XXXX XXXX got an email reply ( see below ) from SPS regarding my existing property insurance. SPS ( via chase ) conveniently cashed via ACH ( see below ) {$260.00} for alleged Escrow Deficit. SPS then increased my mortgage payment to $ XXXX month, while cashing {$260.00} for alleged Escrow Deficit ( see attached ). This is a Consumer Fraud and XXXX XXXX of escrow payment. Item 5 : Alleged servicer SPS willfully confused me in providing three ( 3 ) different addresses to send my monthly mortgage payment. This an effort by SPS to fraudulently claim that it did not get my monthly mortgage payment to fraudulently start the foreclosure in spite of the Loan Modification and XX/XX/XXXX Written Settlement Agreement with XXXX.

The loan servicing company Select Portfolio Servicing has told me that my Lender is only offering forbearance for 3 months with the 3 month lump sum due in full at the end of 90 days. It appears that the primary note holder is XXXX XXXX XXXX. My original loan was with XXXX XXXX which transferred to XXXX when XXXX failed in XX/XX/XXXX. The current note holder reads as follows : XXXX XXXX XXXXXXXX, successor trustee to XXXX XXXXXXXX XXXX, XXXX successor in interest to XXXX XXXX XXXX XXXX, as trustee on behalf of the XXXX XXXX XXXX XXXX, XXXX XXXX is the owner of the account. Since XXXX XXXXXXXX XXXX was purchased by XXXX XXXXXXXX XXXX in XXXX, XXXX XXXXXXXX XXXX appears to be in 1st position. It is my understanding that XXXX XXXXXXXX XXXX is helping homeowners during this COVID-19 pandemic by offering deferrals and adding the missed payments to the end of the loan. Why are they not offering the same to me? Not sure how many banks got bail outs on my loan after the XXXX crash, but it seems like a few did. It is time the banks do the right thing. I need help now, thank you.

Both tenant and other relative in other house refuse to help, very hostile. XX/XX/XXXX HUD agency, Transferred to XXXX XXXX XXXX, default/foreclosureXXXX granted modification, with sons signing to provide additional XXXX a month. XX/XX/XXXX transferred to Select Portfolio services, XX/XX/XXXX to date Pay all cost for property - Property Taxes, Hazard insurance, XXXX XXXX XXXX , XXXX XXXX XXXX XXXX XXXX ( water, sewage ) Now I continue to ask for help, yearly cost for owner expenses is average {$12000.00}. I would owe nothing if my parent grantor / co borror alive, instead unable to collect any help from tenant, relative in my parents house, XX/XX/XXXX started to evict, now cant evict and must try to sell now, i have not missed any payments, still XXXX, no probate but no help, proof of ownership, no voice, no inclusion and hopeless again. Always to truth, 15yrs yet no forbearance, I owe more now since not a dollar of help, can now prove brother collected XXXX rental income, not ok. I'm still XXXX, getting worse, what did XXXX and XXXX do for XXXX, no privacy, no dignty or help.

Consumer Complaint: Select Portfolio Servicing Inc just took over the mortgage on XXXX XXXX XXXX XXXX XXXX sent me a letter last year XXXX XXXX to start making payments to Select Portfolio Servicing Inc. I just received upon request a Satisfaction of Mortgage Dated XXXX XXXX Mortgagee hereby acknowledge full payment of the debt secured by the mortgage and direct the Clerk of the Circuit Court to cancel of record. This mortgage was paid off in full and I have not received my Mortgage Deed. Instead Im still making payments to someone Portfolio mortgage brokerage account. Its not closing on a mortgage I wanted to get a payoff because I knew this mortgage was paid off in full. They would never give me a answer concerning when I ask this mortgage should have been paid off no response from Select Portfolio Servicing Inc.

Consumer Complaint: This bank ( Select Portfolio Services , Inc. ) says on its website that it offers assistance programs for distressed borrowers. We have applied twice in 2 years since our income is down 40 % from the time we began the loan. After spending 2 months providing detailed and copious amounts of financial documentation, the bank says that our type of loan does not qualify for any home retention loan modification based on what is written in the service agreement. So it really doesn't matter how much distress we are in or that we are in distress at all. The decision was not based on ANY of our financial data that we most dutifully submitted in a timely manner. The decision was based on a boilerplate clause deep within the service agreement. That should be illegal. The other issue, is that we are not allowed to contact the lender directly as SPS XXXX Inc. is only a servicer with little or no authority. Our loan was at some point chopped up and blended in with other loans to be sold in a tranche as part of a CDO security. This basically means there is no company lender to talk to. What is left over is a pool of investors in the security that is overseen by some banker or attorney that works for the bank that can't really make any decisions on one particular loan in the portfolio. There needs to be much more transparency and consumer protection for the borrower regarding these CDO placements. We feel we were set up from the beginning to be offered no help no matter what our circumstances.
