Entered into ( UP ) Unemployment temporary forbearance beginning XXXX/XXXX/XXXX - XX/XX/XXXX with balloon payment due XX/XX/XXXX servicer assured me at time of entering that if unable to make balloon payment they would work with me. XX/XX/XXXX additional UP program approved with payments made XX/XX/XXXX and XX/XX/XXXX Again, I raised concern about ability to make balloon payment and was assured they would work it out with either loan modification or restate. Final UP program entered XX/XX/XXXX thru XX/XX/XXXX. Upon end of program reached out to mortgage servicer in early XXXX via Email, they were unresponsive. Contacted them via voice XX/XX/XXXX to apply for mortgage modification and applied wherein rep advised me to look into local support options. I found XXXX XXXX XXXXXXXX fund and applied. XXXX XXXX XXXX informed me my mortgage service provider not currently participating in program and advised sending letter encouraging to join. Letter sent XX/XX/XXXX. XX/XX/XXXX Received letter from Mortgage servicer for modification denial offering Short Sale or Foreclosure.

Consumer Complaint: My servicing company is Select Portfolio Servicing, inc, account number XXXX. I have requested that they setup an escrow account for my delinquent taxes that arose due to Covid-19 and my recent Chronic XXXX XXXX diagnosis. My request was denied with not concrete explanation. Other mortgage companies have made exceptions for individuals impacted by Covid-19 and these people are disrespecting the impact the virus is having on people. I am XXXX months ahead on my mortgage and my credit score is in the mid XXXX. So in my opinion a denial is unwarranted. I am requesting a full investigation into their unlawful practices since they dont do things right and this has been my experience throughout my tenure with them. For example when I overpaid they returned the money rather than applying it to my account. Now they refuse to provide assistance to those impacted by a pandemic. This is a horrible business practice and I beg you to investigate their uncooperative practices. Additionally, I will be contacting the Attorney Generals Office. Select portfolio servicing SPS is the servicer, and they have been so difficult during the entire repayment of months of my needing to repay due to Covid 19. I cant see the repayment plan online, nor through the app. XXXX month they took two payments out instead on one but I let them but then I got confused as to what month was due so I was about to make a payment for XXXX before the XXXX because I know it is due no later than the XXXX when I received a letter I am in default!!! Like I said they confused me taking two payments in one month and I can not view into regarding the repayment plan to ensure Im On track. Its hidden information. I have lived here since XXXX and bought it in XXXX XXXX fet begins during Covid now they are trying to take my home I was making the payments like I said I got confused. I receive no statements regarding the repayment plan etc... they want to take my home because they see it has equity I cant get to because my credit took a dive during Covid. They are backing me into a corner. This lurk comes to maturity in XXXX. Why didnt they just let me apply for a loan modification instead of this repayment plan given the situation? I was able to get a job XXXX XXXX XXXX this school year betting about XXXX a month plus planning to teach XXXX XXXX so making great money but SPS is trying to take my home and capitalizing on financial duress caused by Covid 19. What they are doing is not Only wrong ethically but possibly breaking laws. They are pretending to work with me but trying to trick and confuse me through the entire process. They sent me a form for short sale out of the blue, I guess hoping being confused might even sign it. Unsure but they are threatening if I dont have XXXX by thenXXXX they are basically taking my home. Please please help these bullies from taking my home

Consumer Complaint: On XX/XX/XXXX, I entered into a COVID-19 Forbearance plan with SPS to cover XXXX, XXXX, and XXXX, XXXX and a late payment for XXXX, XXXX for an amount totaling {$4400.00}. On XX/XX/XXXX, SPS sent a COVID-19 Forbearance agreement with a total amount of XXXX, reflecting a calculation error identified as a two-month late payment in the document. On XX/XX/XXXX, I wrote to SPS to inform them of this error and to have it corrected. I received a confirmation of receipt letter from SPS in response, but nothing that addressed the issue. On XX/XX/XXXX, SPS sent a letter informing me that my COVID forbearance was ending soon ( XX/XX/XXXX ) and that I needed to resume making mortgage payments. I resumed making on time mortgage payments in XX/XX/XXXX and have continued for XXXX and XX/XX/XXXX. In XX/XX/XXXX I completed a COVID-19 Forbearance Deferment form on the SPS website . The SPS deferment agreement was in the amount of {$5900.00}. I did not accept the agreement and again wrote to the XXXX XXXX at SPS on XX/XX/XXXX for help resolving the issue. SPS responded in writing On XX/XX/XXXX to state that {$5900.00} reflected mortgage payments from XXXX through XX/XX/XXXX. I wrote to the XXXX XXXX at SPS again on XX/XX/XXXX, providing detailed documentation of the error and asking for assistance to resolve the issue. SPS responded on XX/XX/XXXX stating that they had already addressed the issue and referred me to their letter of XX/XX/XXXX. I telephoned the XXXX on XX/XX/XXXX and explained the situation again to a live representative. I was told at that time I would have a resolution no later than XX/XX/XXXX. I received no communication from SPS and called the office again on XX/XX/XXXX. On XX/XX/XXXX I received a phone call from the same representative, informing me that my mortgage payments for XXXX, XXXX and XXXX had been applied to the COVID forbearance months, that the now {$1400.00} excess payment was an escrow shortfall adjustment, the COVID 19 Forbearance deferment was not being offered to me, that my account was now being referred for foreclosure and that my only choice was to pursue loss mitigation. My last two escrow statements do not reflect a shortfall. I have tried for months to resolve this with SPS. Instead of acknowledging the original calculation error, they have persistently tried to attribute it to different and factually inaccurate sources. It can be verified that I made the mortgage payments for XXXX, XXXX, XXXX, XXXX and XX/XX/XXXX. It can be verified that I did not have an " escrow shortfall '' in the amount of {$1400.00}. I can not ascertain whether my experience with SPS is a result of incompetence or criminal malevolence. I would like the matter resolved immediately.

Related to my XXXX XXXX Mortgage and unlawful monthly mortgage payments from XXXX til present. Also around the filing of my complaint to the Federal Housing Finance Agency. I was awaiting a response from Select Portfolio Servicing , Inc.. In regards to my Consumer Financial Protection Bureau complaint. Regarding their wrongful criminal participation as it related to my XXXX XXXX Mortgage from XXXX til present. In XX/XX/XXXX Select Portfolio Servicing, Inc, denied any wrongdoing and refused to make any corrective updates to my three credit reports. Shortly after on XX/XX/XXXX the Federal Housing Finance Agencyacknowledged receipt of my complaint. An Select Portfolio Servicing, Inc had a change of heart and made corrections to my credit history thats reported to all three credit reporting agencies. Now, on or about XX/XX/XXXX. Select Portfolio Servicing , Inc has started to demand payment for a mortgage account they know to be paid full as per XXXX XXXX Mortgage. And that they know is under investigation for mortgage fraud and other financial crimes. Select Portfolio Servicing , Inc also knows that there is not a creditor listed on the fraudulent mortgage account they have been servicing for my property. And they also know they unlawfully decided to raise my fictional monthly mortgage payment after I paid my escrow shortage in full earlier this year. Ive recently contacted the Federal Housing Finance Agency again regarding these new unlawful activities by Select Portfolio Servicing , Inc .

RESPA 1024.41 ( g ) require that : ( g ) Prohibition on foreclosure sale. If a borrower submits a complete loss mitigation application after a servicer has made the first notice or filing required by applicable law for any judicial or non-judicial foreclosure process but more than 37 days before a foreclosure sale, a servicer shall not move for foreclosure judgment or order of sale, or conduct a foreclosure sale, unless : ( 1 ) the borrower has not requested an appeal within the applicable time period for requesting an appeal, or the borrower 's appeal has been denied; On XX/XX/XXXX we timely appealed SPSs XX/XX/XXXX SPSs Loss Mitigation decision. SPS DID NOT answer our Appeal and DID NOT inform us about their appeal decision prior to scheduling and/or participating in scheduling and/or effecting the scheduling of the foreclosure sale of subject real estate property. Consumer Complaint: I have two mortgage loans from XXXX XXXXXXXX XXXX, XXXX being serviced by Select Portfolio Servicing , Inc, loan # XXXX & XXXX. The payment amount of {$820.00} for loan XXXX and {$810.00} for loan XXXX are incorrect and there is no plausible explanation why both is so high. The loan documents signed at closing for both say the payments should be {$480.00} for loan XXXX and {$470.00} for loan XXXX with no Escrow. As agreed on the loan documents they will be no escrow. The additional amount doesn't equal any prospective escrow payments ( taxes on both are $ 900 yearly and insurance is $ 1100 yearly ) and there is no explanation for the differences. I've called over 10 times since XX/XX/XXXX to get this fix. They told me to give it a few days it will fix itself, I was then told it was because of the escrow ( again which doesn't make sense ), I was asked to upload letters to remove the escrow which I did, I was then told it was because of a lien by the county, they didn't have any lien, my attorney had no records of the lien. I keep calling to get this resolve and I'm not getting anywhere with this company. I asked for management and my request was ignored. Every time I demand to pay only the principal and interest that was agreed upon they would say there's a service charge of {$15.00} dollars and would only waive after I demand it to be waived. I would like to have this issue resolved as soon as possible but I'm not getting any assistance from the loan servicer.
