Consumer Complaint: This bunch of crooks LVNV aka Resurgent Capital who have been sued by the government and others repeatedly have placed three listings for collections on my credit report with XXXX and XXXX am sure XXXX and XXXX as well that I was never even sent a letter to verify as my debt!!! They are breaking the FDCPA and I want all accounts removed immediately and they are to cease and desist all further contact with me or my family or anyone I know or XXXX will sue them!!! I disputed the accounts yesterday with XXXX and they did nothing but respond to them today and put a note that I dont agree!! I want all account documents for every charge ever incurred and the application with my signature on it provided to both your office and myself! They need to be SHUT DOWN!!! Enforce the FDCPA and FCRA!!!

Consumer Complaint: My son has tried to do the honest thing and notify Resurgent Cap through the CFPB system to let them know that he was the one who opened the credit card accounts in my name. However, they won't acknowledge his complaint since they don't recognize him. I'm attaching it to this complaint and they can do whatever they see fit. The corrective action would be to do the right thing and acknowledge that it wasn't me who opened these accounts and that it was my son. If they still want to say I own these accounts when I know for a fact that I don't, then I'm ready to take them to court. They will have to prove to the judge that it was me who opened this account and it was my hand that swiped these cards. But again my son has a written statement owning that he was the one that opened these accounts.

Not only does this legal action appear to be time-barred, surpassing the statute of limitations in Alabama, but the absence of proper and lawful service of documents is a matter of great concern. " A consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identify theft, no later than 4 business days after the date of receipt. The account in question violates my rights as a consumer and pursuant to the Fair Credit Reporting Act ( FCRA ) as a federally protected consumer, I am now opting out of any and all authorization I the consumer may have given you written, unwritten, verbal and non-verbal pursuant to 15 U.S. Code 6801 6805 effective immediately and indefinitely concerning the account in question below. In addition to said legal authority, this entity has failed to comply with 16 CFR 313.4 313.9 and is currently in violation of said legal authority. Ive attached a copy of the Privacy Act of 1974 to clarify any confusion as to my rights as a federally protected consumer concerning this matter. Consumer Complaint: This company continues to send notices of debt when I have disputed the validitity of the debt via the validation of debt letter upon first notice. The company has previously stated they will no longer contact me but they sent two dunning notices to my mailing address dated XX/XX/2023 after they had a cease and desist letter on file they posted in a response to you prior. ( See attached letters ) This company also put a collection account on my personal credit history after in fact they knew it was in dispute and they collection account does not state DISPUTE- which is a violation of the FDCPA. I called their office XXXX XX/XX/XXXX and spoke to a rep who said she was in management and she tried to tell me to pay for the debt after repeatedely telling her I want to speak to someone who can stop the billing notices after all this was in a cease and desist mode. They are clearly violating the law and I intend on filing harassment and illegal collection tactics against them.
