Consumer Complaint: Portfolio Recovery Association In accordance to the fair credit reporting Act XXXX has violated my rights. 15 USC Section 602 There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. 15 USC Section 604a In accordance with the written instructions of the consumer to whom it relates. 15 USC 1666b A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. This has to do with XXXX selling my account to collection company who is not the company I have account with.

Consumer Complaint: I am writing in regards to Portfolio Recovery Associates , LLC letter dated XX/XX/2023, in which you claim to have reviewed my dispute. However, I must express my dissatisfaction with your response and bring to your attention several violations of consumer protection laws and credit reporting regulations. Intimidating Language and Unauthorized Legal Threats : It has come to my attention that your agency is not licensed to sue in the state of California. Therefore, the use of intimidating language suggesting potential legal actions against me is both inappropriate and in violation of consumer protection laws. As a consumer, I have the right to be treated fairly and without threats or harassment. Request for New Information : Contrary to your assertion that my dispute alleges no new facts and includes no new information, I must bring to your attention that I have never previously requested the specific information contained in Schedules RC ( Balance Sheet ), RC-E ( Deposit Liabilities ), RC-C ( Loans & Leases ), RC-L ( Derivatives, and off-balance sheet items ), and RC-S ( Servicing, securitization, and asset sale activities ). This information is directly relevant to the validation of the alleged debt and my right to seek debt verification. Violation of Consumer Rights : I believe that your previous response, as well as the tone and content of your latest letter, may be in violation of my rights under the Fair Credit Reporting Act ( FCRA ) and other applicable consumer protection laws. The FCRA requires debt collectors to provide accurate and complete information upon request and to conduct a reasonable investigation when a consumer disputes the accuracy of information. Compliance with Securities and Exchange Commission ( SEC ) Regulations : Given your involvement in the acquisition and management of financial assets, I would like to remind you of the importance of adhering to the regulations set forth by the Securities and Exchange Commission ( SEC ). Compliance with these regulations is crucial in ensuring transparency and accountability in your business practices. In light of the aforementioned issues, I kindly request that you provide me with the following information : a ) Verification of the Original Creditor : Please provide documentation that substantiates the identity and contact information of the original creditor, including any account numbers or references associated with the alleged debt. b ) Detailed Account Information : Kindly furnish a detailed statement of the account, including a breakdown of the principal amount, interest, fees, and any other charges claimed to be owed. c ) Agreement and Contract : Please provide a copy of the signed agreement or contract that establishes my obligation to pay the alleged debt. d ) Proof of Assignment : If the debt has been sold or transferred to your agency, please provide documentation that confirms your agency 's legal authority to collect the debt on behalf of the original creditor. e ) Itemized Transaction History : I request a complete itemization of the debt, including all relevant transactions, payments, and adjustments related to the account. f ) Schedules RC-Balance Sheet, RC-E-Deposit Liabilities, RC-C-Loans & Leases, RC-L-Derivatives, and off-balance sheet items, RC-S-Servicing, securitization, and asset sale activities : Please provide relevant portions of these records as mentioned in the debt verification process. I must emphasize that credit card statements or incomplete documentation will not be considered as valid verification of the debt. I expect your agency to fulfill its legal obligations by providing the requested information in a comprehensive and timely manner. Please be aware that my rights as a consumer are protected by federal and state laws, and any violations of these rights may result in legal consequences. I strongly advise your agency to take this matter seriously and comply with the applicable laws and regulations. All communication from your agency must be in writing to maintain a clear record of our correspondence. Consumer Complaint: I made a settlement with portfolio recovery for an account that they illegally bought from XXXX XXXX. This company has been stalking me since XXXXby requesting unauthorized inquiries on my credit report through XXXX credit bureaus, in which XXXX deleted all inquiries in order to hide a paper trail but I have the screenshots. The only reason I settled with portfolio recovery was to move the process along with a potential mortgage lender. Portfolio recovery along with XXXX is trying to extort more money out of mean by putting comments on my credit report like potentially negative and they also reported false information that I owe a remaining balance of XXXX. The letter I received state that the debt was paid in full

Consumer Complaint: Portfolio Recovery is a debt collector trying to collect some kind of debt. All three of my credit reports show XXXX collection activity. I have never had collections and I have excellent top tier credit scores. I do not know why someone is bothering me like this. I want it to stop asap please. Every morning this company calls disguising there numbers every time with a different phone number. I have a right to not be harrassed. I want proof something I signed with my social security number showing I owe something! That is fair and legitimate

XXXX XXXX XXXX : # XXXX, XXXX XXXX XXXX : # XXXX, However, they stated everything was complete and accurate. I have not talked to them by phone or in person about the debt, or electronic communication about the debt, nor have I received a validation notice. I do not recognize these accounts are reporting on my credit report. I do not recognize the account numbers. I do not recognize the account statuses. I do not recognize the account high balances, nor do I recognize the late payments associated with it. everything reported does not meet the FCRA But that is not possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ) they are supposed to modify accounts that arent reporting correctly. 15 U.S.C 1681 section 602 A. Consumer Complaint: This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon, and I didn't sign an agreement on. A legal contract is signed by two parties, and I did not participate in any of it. More so they didn't follow the proper 5 step validation procedure which make these unfair practices. The balance on my credit report is not the same balance I have with the original creditor. Furthermore, I was never sent correspondence notifying me that this account was sold to PORTFOLIO RECOV ASSOC which is another violation. I received nothing in the mail leading up to this collection being reported. This account was added in XX/XX/2018. I am requesting a copy of the correspondence mailed to me during that time informing me that I had a debt with your company. If you can not provide this, then this is another violation. According to the FDCPA Im entitled to XXXX dollars per violation. I demand this company to delete this account from all 3 credit reporting agencies or I will have no choice but to forward this to my litigation attorney.
