Consumer Complaint: I am formally complaining against PORTFOLIO RECOVERY I for a number of consumer laws that they are in violation of. 15USC1681 ( A ) ( 2 ) dealing with exclusions and how I never gave them the right to report any of my transactions to any 3rd party ( XXXX, XXXX and XXXX ) along with 15USC6801 and 15 USC6802 ( A ) ( B ) ( C ). I have never done any business with PORTFOLIO RECOVERY nor can they provide any contracts that I owe then any money yet they continue to report this information on my credit files to all the 3 credit reporting agencies. I have contacted PORTFOLIO RECOVERY who has been totally non compliant through this entire process and has been adamant about breaking consumer laws. I asked the CFPB to step in and make sure that PORTFOLIO RECOVERY stand by and address the issues that I noted in consumer law and not to continue to disregard the rights of consumers.

Consumer Complaint: This situation began in XXXX when I was living in the XXXX XXXX. My parents in the United States received a call from XXXX XXXX XXXX claiming I owed a debt. I contacted them, and after a very frustrating call in which I explained I did not have an account with them and wasn't in the country- so could not legally have been given any US debt, I formally requested proof of the debt including signed contracts, original amount of debt, any payments made and interest and other charges. I never received any information from them. A year later my parents received a letter, I went through the same process, but no proof of debt was provided. The debt has moved from XXXX to various collectors, the most recent being XXXX XXXX XXXX XXXXXXXX XXXX and now Portfolio Recovery Associates LLC. Each time I request proof of the debt, I don't receive any. And usually the debt gets sold to another collector. What can be done about this? Can random companies continue to profit from selling fraudulent debt claims- when they realise they are uncollectible and can not result in profit to them? Is there any recourse for me, having to go through this situation over and over again?

Consumer Complaint: To Whom It XXXX Concern : This letter is in response to the validation previously sent. The partial documents sent are not sufficient proof that I owe a debt to you, Portfolio Recovery Associates LLC. In conformance to my rights under the Fair Debt Collection Practices Act ( FDCPA ). According to 15 USC 1692a, Congressional Findings or Declaration of Purpose, you are hereby informed that as a result of your fraudulent practices with the intention to cause harm, I have suffered mentally and well as financially. Your Company and its agents harassed me for an alleged debt that was not even validated. Your company shared statements as well as a Consumer Contract as evidence of the debt but as per the judgement in the case of XXXX XXXX XXXX v XXXX, a copy of the Consumer Contract or statements is NOT sufficient evidence of a debt. Furthermore, the original creditor reported this on my consumer report as a " charge off '' and they are no longer attempting to collect this alleged debt owed by them. I have contacted XXXX XXXX directly to confirm that they are making no further attempts to collect this debt. Through the response received from this creditor, I would like to inform you that you are in violation of 15USC192j ( a ), because your company furnished a deceptive form to create a false belief in me as the consumer that the " creditor '' was attempting to collect a debt, but XXXX XXXX has informed me that is not true. Pursuant to 15USC 1692j ( b ), any person violating the above mentioned section shall be liable to the extent mentioned under 15 USC 1692k i.e {$1000.00} ( XXXX XXXX dollars USD ) per violation. I have counted several thus far. At this time, I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureaus XXXX XXXX, XXXX or XXXX ) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing a CFPB complaint against you for the following : * Violation of the Fair Credit Reporting Act - reporting inaccurate information * Violation of the Fair Debt Collection Practices Act - continuing collection activity on a debt which has not been validated This includes any listing of information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is. I hereby grant your company the opportunity to amicably resolve the matter by way of doing the following : 1. Delete from all consumer reports 2. Clear away any alleged balance owed 3. Stop all attempts to collect on this alleged debt REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE And NEGATIVE REPORTING OF THIS DEBT You shall be granted 10 days to comply. Consumer Complaint: Portfolio Recovery Associates used Robo-dialing electronic devices to call my private phone number that is trust property. I have not contracted with this company nor do I have any debts nor have had any debts with this company, I have asked this company to stop calling me and that the person whom they are trying to reach is not this phone number, I was told by an agent that they can call a family member if they want to. That may be true in some states but not Georgia, and is also a misrepresentation of facts and its definitely not authorized by the telephone communications protections act. After I explained to the agent that I wanted no more further communication with the company they still call my phone, I have sent them an affidavit of truth that has gone unrebutted 14 days plus 2 for their violations and Trespass against my property and my rights. I have all the evidence to state a action for where remedy can be found. These calls are a gross violation of this companies standing Judgement order that they just received in XX/XX/2023. Civil action will be filed for unresponsive to the affidavit which shows prima facie evidence of their acknowledgement of their violations and negligence.

I contacted the original creditor, and they were not able to verify this account. I will attach the response from XXXXXXXX XXXX admitting that they have no record of the account or proof that I am the alleged debt owner. I have already submitted a FTC report and proof that my information was compromised in the XXXX data breach, and you still proceed to report this account. Under the provisions of the FDCPA, it is imperative that all reported information is accurate, verifiable, and substantiated by the creditor. Given that you are unable to furnish the original documents confirming my association with this debt, I must assert that you are in violation of the FDCPA.
