Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: I was contacted by Portfolio Recovery Associates LLC in XXXX regarding supposed debt, I requested proof of debt and did not receive it. It is now XXXX, and I'm being served with a writ of garnishment for a judgement in XXXX obtained by Portfolio Recovery Associates LLC ; I was never served with a court order or summons to respond and have no knowledge that this case even went to court, so to be served a writ for garnishment for a judgement I had no knowledge of is a complete blindside and shady practice on the part of Portfolio Recovery Associates. I was never served or given an opportunity to respond. When the judgement was obtained, it was done so illegally, as the statute for collection on said debt had expired and they had no legal right to even collect on the debt.

Consumer Complaint: I can receive several phone calls a day. The employee states, " You are not liable for this debt, and it is not on your credit report. Making a payment will make you liable again. Would like to make a {$39.00} payment on this debt? '' I do not know who is actually is actually calling me. It is a different phone number every occasion. I use the XXXX XXXX XXXX to report the harassing phone calls, but they continue. The caller ID states, " Portfolio Recovery, '' but I doub that name means anything at all. I don't ever want called several times a day on Sunday for a debt I am no longer liable for. It is offensive to my religious dignity to receive these calls while I worship God. The synagogue of XXXX loves contacting me repeatedly on Sunday and do not engage in this activity any other day of the week in such harassing way. My number is on the State of Florida of which I am a resident, and the Federal Do Not Call List. There is nothing I can do but be a victim of these harassing phone calls while I commune with God.

Consumer Complaint: I received an letter in the mail that I am being sued in court for a wage garnishment on a credit card that is over ten years old. My employer has also received a letter as well. This is very upsetting, and humiliating for me at work. I called Portfolio Recovery on XX/XX/23 and spoke with an XXXX and she said there is nothing anyone can do about this but to let the wage garnishment work it's course. I make {$15.00} dollars an hour and barely make it as it is. So I called again the next day XX/XX/23 and spoke with a XXXX not sure how to spell it but that is exactly how she pronounced her name. I explained to her I received this letter that I was being taken to court to sue for wage garnishment, and she also said the same thing that XXXX told me the day before, I have to let the wage garnishment take it's course? I am not sure what to do now, because I make barely enough to get by, and Portfolio Recovery after all these years is going to garnish my wages? Is there a way to halt this due to statue of limitations?

Consumer Complaint: Trying to buy a house. I found that I realized I had damages on my credit report. This is a defamation to my character. I have disputed this collection several times with the XXXX XXXX and XXXX credit agengies but it has came back as verified. That is not accurate. I've requested that the creditor send me the original contract to prove this debt to be mine. All of my request have gone unanswered. I have not been supplied the doctrine of estopper by silence, egnlehardt v graven ( mo ) 281 sw, 251, 719, 1 presume that no proof og the alleged debt, nor therefore any such debt, in fact exists. This is holding me back from moving forward in life. This debt is reporting in accurate and must be deleted. On XXXX this collection/charge off is reporting as an open debt with no history of payment. On XXXX this collection/charge off is reporting as open but in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX it is reporting as paid on time and then on XX/XX/XXXX it is reporting as 120 days behind. On XXXX this charge off/collection is reporting as closed and has no history other than XX/XX/XXXX and XX/XX/XXXX reporting as a collection/ charge off. You see this collection angency has reported different activity to all three credit reporting agencies and need to be removed for inaccuracies innediately. this is a Violation of 15 U.S.C. 1681i ( 5 ) removal of all inaccurate/invalid credit. Please remove immediately
