Consumer Complaint: On XX/XX/2022 I called PHH to request the removal of PMI, because the equity in my home has increased well over 20 % due to appreciation in the area. A customer service representative told me on a RECORDED line that I needed to order an appraisal to confirm that and that I could order the appraisal myself or do it through PHH. I decided to order it myself as it would be quicker, so I ordered an appraisal, paid XXXX $ for it, and then sent it to PHH for review. I sent the required documentation on XX/XX/2022, and just today, XX/XX/2022, I received an email saying that they are unable to use the appraisal report that I provided, because it has to be ordered by them. All of this after a PHH mortgage representative told me to order the appraisal myself.

Consumer Complaint: I am trying to do a short sale on my property but the lender did a drive by BPO and over valued the property. The property exterior and interior is falling apart. The lender refused to do an interior. since the property is over valued just from a drive by I am deemed not eligible for a short sale. If they come out and do a full appraisal of the property they will see the property is not worth the price tag they put on it. I have been in contact with the lender and they said that its not eligible for a short sale so they wont order an interior appraisal. These are all the things that needs to be addressed and taken into consideration regarding the value of the prop The drive by value is completely over valued as these are only some of the things listed here. But there is quite a bit of other problems that will have to be addressed : Major termite damage throughout the entire home, some of the floors are very thin and need major repairs. The basement has a mice infestation. Hot water heater needs to be replaced and is over 25 years old. Gutters are damaged and need to be replaced. The driveway and pavement need repairs and have concrete damage. Foundation cracks on the walls in the basement. Exterior wood has some termite damage. Shingles on the exterior need repairs, has some missing shingles. The enclosed front porch has collapsed and the exterior front of the home has vines that have grown and penetrated through the walls and as well has poison ivy. The floor in the attic is open and needs insulation repairs. House has plaster walls and may have termite damage. The third bedroom had a water leak from the roof, the ceiling is damaged and cracked open. The kitchen needs updating. Loose Tiles in the bathroom. The bathroom sink and bathroom as a whole need to be updated along with the toilet since it is leaking. Crack in the corner of the room in the living room. Parts of the cellar need repairs. The sump pump needs maintenance Electrical Panel needs to be repaired ; it has not been improved since the 1950s. Washer and Dryer Units to be removed. New Air Conditioning Unit Aluminum Sheds outside of the home need to be removed.

Consumer Complaint: I represent XXXX XXXX in a reverse mortgage foreclosure case based upon an alleged property charges default. XXXX XXXX sought a repayment agreement to repay the approximately {$6000.00} due. She submitted her repayment plan application to PHH Mortgage in XXXX, 2022. I have constantly and consistently asked for a status update on the application every week or two since XXXX, 2022. The only response I receive from PHH 's counsel is " I will check with my client. '' At one point they said they needed an occupancy certificate. They already had a signed copy of a current occupancy certificate. I have proof of delivery. We sent another one anyway. Still no response. I can not fathom that it would take them 6 months to make a decision. PHH has had and still has the documents requested from XXXX XXXX. If PHH does not have all of the documents needed, it should at least inform XXXX XXXX what it is missing. The complete lack of communication is troubling. I have escalated the case to HUD with no resolution after several months. We are now approaching trial for the second time, and PHH still has not responded to any of my inquiries about a repayment decision after having the application for 6 months. XXXX XXXX clearly has sufficient income and despite her age and physical difficulties took on a part time job at XXXX XXXX XXXX to repay any delinquency. She has also completed her application for XXXX funds. I fear for the second time that it is dragging this out past the trial date so it can cause XXXX XXXX the loss of her home without providing her with the repayment option. Alternatively, the closer we get to the trial date the more XXXX XXXX will feel obligated to take whatever PHH offers, even if problematic under the threat of the loss of her home with the impending foreclosure.

According to a communication received from said office of PHH Mortgage Company, I was to have had an opportunity to submit information regarding my Capital Home Improvements for deductions regarding the Pay-Off of my home. However that has not happened. I have been in communication with this mortgage company now over many different issues. I should have been given an opportunity to have my home appraised by a certified appraiser. I should have been able to submit a list of my Capital Home Improvements I was not, nor was it requested of me. I was just made aware that the opportunity existed from a communication sent from the Ombudsman Office via CFPB. The mortgage company, ( PHH ) has come up with a said amount for a Pay-Off that I totally DISAGREE with in the amount of {$57000.00} Ive requested a detailed breakdown of how the amount was arrived. No detail follow up of said concern has been offered as of XX/XX/2022. I am requesting your assistance and advice regarding help with this on-going complaint. Thanking you in advance for your help. Ive offered paper work for Capital Home Improvements and a home appraisal report has been submitted. Last payment ( balance on the account ) of {$6.00} for mortgage payment was attempted at least three times and each time it was declined with a returned check from said mortgage company. The mortgage company has now caused my credit ratings to become compromised, therefore placing me in a position to be denied credit approvals. My credit score dropped down greater than 100 points. P.S. I was told by a representative via phone about XXXX or 6 months ago that the pay-off should be about {$4000.00} to {$5000.00}. Not {$57000.00}. Still no financial breakdown of arrival amount. A recent appeal presented an issue of first impression before this XXXX as to whether a plaintiff in a foreclosure action may satisfy the requirements of XXXX XXXX by mailing a XXXX notice jointly addressed to two or more borrowers. In Wells Fargo Bank, N.A. v. Yapkowitz decided XX/XX/2021, the XXXX held that this practice was insufficient to satisfy the requirements of XXXX XXXX, and that the plaintiff is required to mail a 90-day notice addressed to each borrower in separate envelopes as a condition precedent to commencing the foreclosure action 2nd Lender failed to correctly serve my XXXX Attached is the Original Loan application and deed with the correct spelling of her name. The Mortgage & Note lack standing because the foreclosure if not against my ex-wife, they did not serve her a correct copy they served her a misspelled copy. I did not cause the issue I attached a my loan application with the correct spelling of my name. This was a bad name failure to serve the correct party. 3rd the mortgagor failed to comply with XXXX XXXX, XXXX & XXXX Finally, I would like a full copy of my mortgage records to be forwarded to me from the lender, which is to include all payments, mortgage notes & assignments, default notices, and all proof of compliance with the NYS and Federal Mortgage laws

Their letter is contradicting it states no foreclosure will be held but yet they never placed it on hold. I am suffering from anxiety and paranoid living in fear that I might end up in the streets. I've submitted an appeal and I also need the calculations that they are using to determine my eligibility which they have failed to provide me with. All I see is bad faith on there end. My income can definitely support my payment I make more than enough I can afford my mortgage. I feel that they are just targeting Hispanics and force them to loose our homes.

Consumer Complaint: My issue is my loan servicer Litton Loan Servicing LP, fraudulently serviced my account for years, from the XXXX 's up through XXXX when they were bought out by Ocwen Mortgage. This transaction took place in XX/XX/XXXX, I then noticed in XXXX of XXXX, 4 months later, that the amount of {$72000.00} had been added to my account as a " DEFERRED ACCOUNT BALANCE '', along with an inflated regular balance. As of right now, along with the deferred balance of {$72000.00}, my regular balance is at {$82000.00}, for a total of {$150000.00}. That's after paying on a {$110000.00} balance for XXXX YEARS XXXX months!!! So I have no been passed from Litton Loan servicing where the problem began, to Ocwen, to PHH Mortgage/NewRez who I have been making my payment s to now. Without a doubt, this property should be very close to being paid for by now!!! NOT A BALANCE OF {$150000.00}!!! Have even hired a couple of attorneys to look into this and all they did was take my money and did nothing. Been working on this issue with no help for over 10 years now. There has been more than one instance of signing on only to find the option to make a payment is not avaible. I did contact them once and they corrected the problem. The mortgage has now been sold to XXXX XXXX. PHH Mortgage sent me one letter and one email notifying me of the change. On the letter they provided the new servicing information for XXXX XXXX. The account number provided is nine digits. The problem is XXXX XXXX account numbers have ten digits. Now I am unable to access my account through XXXX XXXX or PHH Mortgage.
