Consumer Complaint: In XXXX I refinanced my three properties with XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX Primary XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX - Mother-in-law home XXXX XXXX XXXXXXXX XXXX XXXXXXXX XXXX, FL XXXXFathers home The Mortgage officer informed me the only way they would do the loan is if they bundle the three properties under one mortgage and that the loan would have to be under my company name. Because my wife had XXXX and we were needing the funds we took a {$630000.00} across the three properties which at the time were worth {$1.00} XXXX It was supposed to be a temporary loan for 2-years and then they said I could refinance with a conventional mortgage afterward, but if I needed it for my family I would have to do this. In XXXX of that year, XXXX XXXX sent notice they were servicing the loan. The pandemic hit us like so many people and I reached out to request a forbearance or assistance from XXXX XXXX. They told me I needed to go BACK to XXXX who originated the loan. I spoke to the individual and they said they would put through the forbearance. in XXXX of XXXX, I received notice XXXX XXXX was beginning Foreclosure on the properties. When I contacted them, they stated XXXX did not place the forbearance at all and because the loan is against the three properties I wouldn't be eligible. Unluckily the pandemic slowed everything down as I franticly looked for a solution. I was eligible at the time for refinance but was told that I couldn't because 1, The properties couldn't be separated 2. The Lis Pendant needed to be released by the lender to do so. I attempted to sell one of the properties but I couldn't separate the properties After speaking to XXXX again to assist me, they refused and said the case was transferred to XXXX XXXX. When I called XXXX XXXX they stated they said they couldn't help me because they were just servicing the loan and I needed to speak to XXXX I was nervous to lose my property so I contacted Loan Lawyers in XXXX XXXX to help. They began the process of giving me time to find a solution, but the issue with the list pendant is an issue. I also noticed the mortgage did not appear on my credit report which causes other issues with home lenders. I was finally able to attempt to secure a loan to pay off and start fresh with a private lender, but the gentlemen died of XXXX recently and I was unable to continue the issue Loan Lawyers had a few hearings and now there is a hearing on XX/XX/XXXX for judgment After the hearing there was a summary judgement for the plaintiff, but they gave me 90-days to get a Refinance ; I was supposed to close this week ; but due to the hurricane and one of the properties being in a disaster area ( XXXX XXXX XXXX XXXX I received notice they are exercising the disaster procedure requiring another appraisal to assess the damage ; which I haven't been able to because all bridges to the area are destroyed. The Law Office I now hired, sent notification at the beginning of XXXX to the Opposing Counsel and PHH, but they have yet to respond to our modification request. Now they are forcing my hand for Bankruptcy and I'm simply devastated by this! On top of this on a XXXX loan I am now indebted to these people XXXX

Consumer Complaint: We have been trying to get assistance with our payments for over 3 months and every time we talk to someone we get told to call back in two weeks for a decision and then we get a letter in the mail stating we received your request for mortgage assistance. Our monthly mortgage payment increased {$250.00}, since COVID hit we have been having financial hardship in making this payment, we can not get them to accept a payment plan or refinance the loan.

Consumer Complaint: I receive notice of foreclosure on my deceased Uncle 's estate. I am an heir to the estate but it has not been probated yet. The estate has made numerous attempts to pay the mortgage and I have personally called the Bank and the banks attorney but they refuse to talk to me until we have gone to probate court. Consumer Complaint: Reverse Mortgage Solutions/PHH has not been a good experience. The company has been difficult to work with from the beginning. There has been no one assigned to us as a case manager. Documents do not reach us in time, yet we are to expedite them in short time. When we entered this agreement we were to satisfy XXXX points : Our home is our major residence We are still alive ( XXXX and XXXX ) The property has not been sold. Back in XXXX we signed a repayment agreement for our XXXX tax bill. The agreement was signed and payments sent. XXXX weeks ago XXXX of the checks was returned without explanation. When we called they demanded {$6000.00} in full or the house is auctioned on XX/XX/XXXX. What happened to prior notification? We began payment to the county for our XXXX taxes ; they superseded our payment, breaching the contract in XXXX, claiming that the breach was our fault because they paid the bill. If there had been contact made to us, as to how we would handle our taxes for XXXX, there would have been no need for RMS/PHH to pay our tax bill. RMS/PHH is the mortgagor and the collection agency. How can that be?? We had less than 2 weeks notification. There must be a law against this action.

Consumer Complaint: When I refinanced years ago the broker stuck me with a bad deal of a variable rate at 9.25 % with Ocwen now PHHXXXX but I wasn't told any of this until closing at my house so too late to do anything else. I have inquired about refinancing to a lower fixed rate and have been told I don't make enough money even though I pay every month and they said they would charge thousands of dollars in fees so it wouldn't help. Now they are raising my interest rate to 10.25 % even though as far as I can tell interest rates are currently lower than when I closed on the mortgage. I asked about the increase and was given the attitude of they can do what they want and deal with it. I pay extra every month and now they will allocate that money to interest.

Consumer Complaint: My home mortgage was transferred to PHH lending after closing. Shortly after purchasing our home, we had major flooding that caused us to file insurance claims through XXXX. XXXX administered two checks that required endorsement by PHH. These checks were issued for two separate coverages. One was sent to our HVAC company and the other was written directly to XXXX preferred general contractors. We thoroughly followed all protocols when trying to get these checks endorsed and sent directly to the companies. It is important to note that the checks were made out to the companies for the repairs but needed PHH and myself to endorse. PHH continues to hold the general contracting check refusing to release the funds. We have provided thorough documentation and estimates that they have requested showing that the work has been approved by XXXX and itemized. We have been living out of her home for two months and this is delaying the process. Whenever we contact customer service, our questions are deflected and we never find resolution. When we ask questions about the legal process and contacting the proper channels, we are placed on hold and hung up on. Ive never experienced this level of incompetency by a mortgage company.

Consumer Complaint: A fuller explanation will be attached. In short, PHH Mortgage has denied our request that Private Mortgage Insurance ( PMI ) be removed from our mortgage. We appealed. They denied it again, stating that we do not meet their required Loan to Value requirement to remove the PMI. The appraisal they required as part of their process is incorrect, but they will not allow me to speak with anyone who will listen and understand the issue. We keep getting told that someone who makes these decisions will contact us to discuss this matter. No one EVER has called. Instead, we get an email that tells us they are reviewing the file ... and then they deny the request. The conversation never happens. Problem is they are completely ignoring the existence of and value of a second parcel of land that is financed by this mortgage we have on this property. The also ignore the existence and value of a significant sized outbuilding on property. They also ignore the estimated current market value of our property that they have posted on their own website. They also ignore what other reputable RE current market valuations say our property is worth. Lastly, the comparitor properties their appraisal used are not current, and are nowhere near the size of home or property as ours is.

This mortgage company purchased my commercial loan without my agreement from mycooper back in XX/XX/XXXX Since that time they screwing up my escrows and using insurance as an excuse. Prior complaint that I filled last month was about my current insurance that XXXX could not attached for number of reasons, despite the fact that we submitted proof number of times. They deliberately refused to do it and threatened me to purchase insurance for me. Mind you I have full coverage and my agent said he never seen anything like this. Ever. So finally it's attached after the last complaint. Now they demanding proof of coverage for prior period From XX/XX/XXXX through XX/XX/XXXX Mind you that this was around the time they purchased the mortgage. Mind you I have copies of the emails I sent and my agent sent to XXXX with certificate that I am attaching here.
