Consumer Complaint: My home financing at XXXX XXXX XXXX XXXX, XXXX, NY XXXX is owned by XXXX XXXX and Serviced by Ocwen Servicing. It then bought PHH Mortgage. The loan was serviced by Ocwen and agreed to modify the loan in XXXX. I paid the initial payments for one year until Ocwen, using clerks not in this country who did not know anything about the loan began misapplying payments, losing them, and sending me default notices until I finally gave up -- hoping that Ocwen would finally take notice and work out the problems. Instead they just started a foreclosure. So, in XXXX I again modified the loan. However, I agreed to make the trial payments with the understanding that they would adjust the loan amount and huge balloon ( {$800000.00} AFTER paying for 20 years ) once I obtain a NY Licensed appraisal. They simply charged me {>= $1,000,000} for a house worth {$800000.00} with an additional {$800000.00} balloon. They refused to correct what was owed as promised. So, they then sued me because I refused to pay 50 percent more than the house was worth. They have two sets of lawyers and a corrupt judge ( one who was appointed by a now XXXX XXXX. and have a Judgment of Forcclosure. Ocwen has been sued by you for {$200.00} million for consumer fraud and they are back at it again using PHH Mortgage which they bought to sheild themselves for doing exactly what they were doing before. Screwing homeowners. THIS is another XXXX XXXX. XXXX XXXX, written about in XXXX XXXX ( XXXX XXXX ) is at it again as it was with MortgageIt when it settle with the Justice Department. Please bring them to the table and sanction them as Rohit Chopra has for $ XXXX to stop them. While I transferred by title to my wife, and have agreed to simply transfer it back, they are trying to take out house and destroy our family. I contracted Multiple Myeloma from the XXXX XXXX attack as well as atrial fibrillation and was unable to work or find a job. This had no affact upon Ocwen, PHH or XXXX XXXX and the attorneys whom I asked, as pro se since I can not afford an attorney, to modify my loan.

Consumer Complaint: I paid my reverse mortgage in full on XXXX. The lien was released by the mortgage servicer quickly on XXXX and my copy of the letter indicating lien release was dated XXXX. As of XXXX the mortgage servicer ( PHH ) is holding {$260000.00} of my escrowed insurance claim funds ( from a fire loss ) and has informed me that they have up to 180 days to reimburse me. In the meantime, I am unable to purchase a new home using those funds, and I am essentially homeless. The CFPB website implies that such payment should have occurred within 20 days. Since the mortgage was paid in full and acknowledged, PHH should have no legal claim allowing it to withhold these funds.

Consumer Complaint: I filed a motion to compel the foreclosing purported claimant XXXX XXXX XXXX , XXXX XXXX, as Trustee for a securitized REMIC trust, " XXXX XXXX XXXX XXXX XXXX XXXX XXXX Mortgage Pass-Through Certificates, Series XXXX '' to produce the original " wet ink '' Note in my XXXX XXXX U.S. Bankruptcy Court proceeding, case XXXX XXXX XXXX, heard in XXXX, Massachusetts. The foreclosing corporate entity failed to produce anything. I have a right to verify whether said entity actually owned my Note when it purportedly foreclosed my property. I am hereby demanding the CFPB compel the purported foreclosing entity to produce a complete chain of custody of MY NOTE, that I issued, and that they claim they owned, not simply held, when they purportedly foreclosed the mortgage on my home located at XXXX XXXX XXXX in XXXX, Massachusetts, on XX/XX/XXXX. I demand evidence in the form of a sworn statement indicating with specificity the complete chain of custody of MY NOTE, from the moment I issued it to XXXX XXXX XXXX XXXX on XX/XX/XXXX, to the present time, including dates of transfer, owners of my Note in whole or in part, " holders '' of my Note that may not have owned it in whole or in part and identified as such, and if ownership was/is claimed in part, the exact amounts of ownership claimed, with supporting documentation.

Consumer Complaint: On XX/XX/2022, XXXX was sent to PHH Mortgage Services and was received on XX/XX/2022. No letter confirming receipt of XXXX was sent to Homeowner and no extension of the investigation was received or sent to Homeowner within 30 days. A XXXX XXXX letter is currently in transit to PHH Mortgage Services. Additionally, several calls have been made to PHH Mortgage Services to try and resolve this matter and many have gone unresolved, and several call-backs promised have also not been completed by PHH mortgage XXXX Payment Errors : An insurance claim was filed with our insurance company back on XX/XX/2022. A check was issued for damages in the amount of {$11000.00}. This check was made payable to the homeowner and PHH Mortgage Services. As common practice, the check was endorsed and sent to PHH Mortgage Service for an additional endorsement. PHH Mortgage Services received and negotiated that payment on behalf of the homeowner. PHH Mortgage Services, in return, split the payment into two separate checks and mailed the payment to Homeowner. Check # XXXX issued on XX/XX/2022 for the amount of {$7700.00} and Check # XXXX issued on XX/XX/2022 for the amount of {$3700.00}. Check # XXXX was received and negotiated on behalf of Homeowner in the amount of {$3700.00} Check # XXXX was never received by Homeowner. PHH Mortgage services has since informed us that it has been negotiated on her behalf. This has been disputed several times, repeatedly by Homeowner. PHH Mortgage Services has refused any sort of resolution. Homeowner has given statements to PHH Mortgage to try and respolve this issue. PHH Mortgage representatives have urged Homeowner to file a dispute with PHH Mortgage 's Bank. The homeowner does not live in an area with access to the mortgage servicers bank, and furthermore, this seems to be an unconventional way to dispute a fraudulent action.

Consumer Complaint: I was contacted by PHH mortgage in the XXXX of XXXX to inform me that I did not have an active insurance policy from XXXX of XXXX through XXXX. They planned to charge me approximately {$1400.00} for a back-dated insurance policy. Turns out my homeowners insurance, home site, had sent XXXX multiple invoices for payment in XXXX that were never paid and my policy was subsequently canceled unbeknownst to me. My policy that was cancelled was approximately {$650.00}, and I had to create a new policy this year. XXXX now expects me to pay more than twice as much for a policy because of a mistake that they made. The whole reason I have an escrow account is so that insurance payments are taken care of. I've called them multiple times throughout the XXXXXXXX XXXX XXXX XXXX I finally got a call back from someone saying that it was going to go to their investigation department and that she would follow up. Of course I never heard back from them, and they apparently expected the problem to go away. Now I get notifications that my escrow account has a negative balance and my mortgage is going up all of which are domino effects from the initial problem that they caused. I should not be responsible for this, I would like them to credit me the difference in the policy amounts.

Consumer Complaint: We have been told so many conflicting things regarding our mortgage loan. We have sent payments to only have them returned for no reason, but when we ask, we are told due to the status of our mortgage loan account. Then we are charged late fees and added interest on the returned payments. We have gotten letters stating we are current on our mortgage and no payment is due with a given date of two months later. We get loan modifications of ridiculous terms of 40 year term and balloon payments due after 5 years. We never speak with the same person, we get calls from weird phone numbers like +10 instead of a 10 digit phone number. We were told on Monday, XX/XX/2022, no worries on foreclosure. They said they would mail a packet out to us to fill out and return or we could go online to complete. We get a call on XX/XX/2022, stating we are in active foreclosure and gave me an attorney name and phone number. We very suspicious and concerned about our mortgage company as they don't seem to have it all together by not supplying our loan servicing needs. The amounts are constantly changing, we have a hard time receiving information we have requested. To be honest, we feel they are wanting us to sign a loan modification which we do not agree with the terms. We are concerned of loosing our home because communication is so poor and nothing is consistent. We want to pay our mortgage and pay it monthly. We just want to be treated fairly and things be consistent regarding information, charges & other important information about our mortgage loan. This situation has really taken a toll on our health by stressing not knowing what will happen next.

Consumer Complaint: This complaint stems from a " supposed '' unpaid property tax payment. Both payments were made within the due period. There was a mix-up of my first name on the 2nd payment. The correction was made with the XXXX XXXX Collector. When I received the 1st notification ( approximately XXXXXXXX XXXX ), I spoke with a representative of PHH Mortgage and explained both payments had been made in the allotted time. I then began receiving letters threatening foreclosure. I have spoken with many representatives from PHH many times regarding the situation. I even forwarded, by email, PHH on XX/XX/2022, a copy sent to me by the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I have continually received threating letters stating I am in foreclosure. The latest letter is from XX/XX/2022. This continual threat is causing me a lot of stress and anxiety. PHH is also charging me {$1000.00} for " paying my property taxes '', which were already paid!! I'm hoping that by issuing this complaint I will no longer receive these threatening letters. I only wish I could dissolve this reverse mortgage with this horrible, horrible company. It's been one thing after another with PHH Mortgage.

Consumer Complaint: I closed on my property in XX/XX/2022. The title company sent the check to PHH mortgage. Apparently the check was {$210.00} short. Instead of notifying the title company or anyone else for that matter, they have piled fees that continue accruing. Meanwhile, the new owners are in the home, etc. Im being charged for delinquent payments, home insurance, etc. The title company had to hire an attorney. I have no clue where this leaves me as the person on the mortgage. Not to mention my credit. They are evasive, dishonest, criminals. How are the new owners in the home since XXXX, and we both have insurance and mortgages on the same home??? They have their home owners. Im being charged home owners. Theyre paying on a VA mortgage for the house . Im being charged a mortgage on the house????????? Fraudulent. Blatant. Deceptive.
