Consumer Complaint: Deed was mis-recorded with just my name and not both my then husband and I. Home was declared and discharged in XXXX in 2009. I was told to move out and home was in foreclosure. My then husband joined the military shortly there after and was in XXXX. I moved out thinking it was being foreclosed on. Great, I could afford to live there and we did not want the house back. Years later I found out that I and I alone was sued by the hoa and bank had not foreclosed. I should have had SCRA protections but since my name was the only one on the deed I got sued. I have been defrauded over the last decaded, sued numerous times due to the deed being misrecorded. My now ex husband has been spared from any legal actions and this situation has caused no harm financially or emotionally to him. I have had to spend thousands in legal fees over the years. I had to file XXXX last in XXXX because I am now XXXX because of an injury.. I am essentially homeless, but I do get a whopping XXXX a month on ssi. My bankruptcy is still ongoing because Ocwen is still lingering and I had to claim it as an asset. Ocwen is doing nothing with the property dispite letters from me from my attorney over the last decade trying to get this off the books and do a deed in lieu of etc. I either get no response or re-fi paperwork and a copy of the original mortgage paperwork where my ex husband and I closed on the property. This situation is simply ridiculous and I believe that it has violated my rights in numerous ways as well as causing me irreparable financial damage. XX/XX/XXXX - Annual escrow statement [ Attachment 1 ] Reveal escrow shortage of {$230.00} with a new mortgage payment in XXXX of {$1400.00}. I utilized Option 1 ) Do Nothing and added 12 months of {$19.00} that began in XX/XX/XXXX. Document supported no evidence of adherence to Maryland Code ; interest on escrow account XX/XX/XXXX XXXX disbursed remaining balance of tax assessment - {$1600.00} [ A ] XX/XX/XXXX The taxes paid on XX/XX/XXXX were refunded in its entirety {$1600.00} [ B ] due to MD Maryland XXXX tax credit program. XX/XX/XXXX Called XXXX XXXX. to inquire of the refunded escrow dollars and was advised that an additional escrow analysis was required. See OFF-Scheduled Escrow statement dated XX/XX/XXXX. This document also does not include evidence of adherence to the Maryland code. However, a refund was issued to me in the amount of {$1400.00} [ C ]. However this refund was NOT received until XX/XX/XXXX. This was ( XXXX ) days are they received the refund. On numerous occasions I have inquired as to my escrow account and why this account was not eligible for the accrued interest along with supporting documented law that suggest this action. I then called my lender today, XX/XX/XXXX and I was told that I was not under review. I was told that in order to be reviewed I had to speak to my assigned representative. I was told I had to make an appointment to speak to him and could not be transferred today. The first appointment available to me was XX/XX/XXXX between XXXX XXXX. The court has set a non jury trial for my foreclosure case on XX/XX/XXXX. Due to having to wait until the day of my court date to begin a review makes me unable to try to resolve my issue before I XXXX be issued a sale date. Consumer Complaint: I tried to request a re-modification from PHH, I received a trail re-modification with no details of how this re-modification was created or what the terms would be once the trail was completed, which I think is extremely important. I submitted a letter of concern to PHH as well as CFPB, PHH responded to me with a letter dated XX/XX/2022, I received the letter XX/XX/2022. PHH response did not address my main concern. Consumer Complaint: We got my reverse mortgage with XXXX XXXXXXXX XXXX, they did a very good job. Everything was fine until our home was destroyed with hurricane Ian. We got our insurance check and called PHH Mortgage ( same as XXXX XXXXXXXX XXXX ) for a payoff on XX/XX/2022 after getting the run around and several calls on XX/XX/2022 we get a payoff. They received the check on XX/XX/2022 to pay off the mortgage and put the money in escrow until XX/XX/2022 when they paid off our loan. After calling and getting disconnected several time because every time you call you get a person in the XXXX and they know nothing and when they try to connect to the US you get disconnected. I finally was told on XX/XX/2022, after several phone calls to them, that it would take up to 90 days to get the overage money back to me. They are holding the money for almost 5 months and making money on the money ( over XXXX ) that belong to us. We can't start building a new home until I get my that money back. Please help.

Consumer Complaint: Back in XX/XX/2022 I applied for payment assistance through the Texas XXXX XXXX XXXX also known as TX XXXX. On XX/XX/2022 I was told by TX XXXX that they needed to speak with my lender PHH Mortgage Services to move forward with my application. From XX/XX/2022 until the first week of XX/XX/2022 I had to repeatedly contact PHH and following up with TX XXXX. I was told something different by each person I spoke with. I was initially told they had the application. Then I was told they didn't have it. I was later told they did not have authorization to speak with TX XXXX despite me saying repeatedly I give you authorization to do so. I would later find out what was missing was a 3rd party authorization one single document and PHH never made it clear what was required. I was also told my application had been denied by PHH MTG because I didn't qualify, which was a lie. Finally I got the ball moving after threatening legal action. And after thinking everything was going to be okay I discovered PHH MTG received a {$5800.00} payment from TX XXXX on my behalf on XX/XX/2022. However PHH MTG is denying receiving the payment even after being provided a document from TX XXXX that shows the check number, what day it cleared, the tracing number and who it was sent to. PLEASE HELP ME GET TO THE BOTTOM OF WHAT Phh Mortgage DID WITH THAT PAYMENT. I am uncertain if PHH understands to take gov't funds via wire and not allocate them to the proper account and even deny receiving them is wire fraud.

Consumer Complaint: We were impacted by XXXX and struggled to pay our mortgage. Within 30 days of default, we contacted the loan servicer to help with XXXX, maybe 2 months of forbearance. The company purposely delayed the process by more than 90 days by stating that they were missing documents, even though we had email and fax proof that those documents were sent and received timely. Furthermore, they were not willing to speak with us over the phone and insisted that the only way to resolve the issue was to schedule an appointment with the Relationship Manager. Those appointments were made out over 30 days, yet the relationship manager did not appear for those scheduled calls. Once we realized that they were circumventing the process to purposely delay the process, we began making payments, but they refused those payments- causing us to fall further behind. Finally, they submitted a modification denial letter stating that we were more than 90 days behind on making our payments, yet we were only behind because they failed to review the process in a timely manner. Furthermore, they used incorrect values in the net present value computation. Even though we provided certified appraisals that discredited their " drive-by '' valuation, they still refused to review documentation timely, if at all. They often kept us on hold for up to XXXX hours, then would disconnect the call, refused to speak with us over the phone, insisted on scheduled appointments that were more than 30 days out, and led us down a path of despair and a deliberate nightmare to refuse to negotiate in good faith.

Consumer Complaint: We have been applying for a short sale for our home in XXXX. We moved XXXX years ago and no longer live in the area. We could not sell the house for what we owed, so took advisement to get a short sale. We have submitted documents and our realtor has as well. Every month they give us another thing that is missing or a document list that we need to re-submit to them. We have had a very hard time getting their exact wording on contracts because it is language like XXXX obligation that our realtor and the title company didn't even know what was, and then found out it is not part of our title, so we amended that on the contract. Most recently they want me to resubmit the tax documents for 2 years, signed. For example, I sent the official IRS downloads, but they want them signed, so I am signing them as is. They wanted a pdf copy of our paystubs instead of jpg. I have resent it. They canceled it all at XXXX point, saying that we missed the deadline, when in fact, the realtor and I sent in duplicate copies and updated dates for the short sale application. Now it is under review again. The loan was with Ocwen, now with PHH. Every month they just make another appointment with the relationship manager person and say we aren't turning in all the documents. We feel that they are making a paper chase for us to fall through and just give up and they forclose. It was our family home and saddens me that they will not let us sell it for something rather than get nothing out of it. Here is my log of calls from them. XXXX XXXX : Permission for Realtor to speak on our behalf was given. XXXX XXXX- emailed to ask for a short sale form, XXXX spoke on the phone with ID XXXX haha. She informed me it was going well, but I needed to go on the Phh website to www.mortgagequestions.com and go to FAQ and fill out the mortgage assistance form for the short sale. She said after filling it out you can e-mail it back to them. Received an email that it was received. XXXX XXXX, XXXX ID XXXX - Asked if the short sale has been approved. Next steps : Review for short sale. 30 days from completion of packet. Documents accepted and all stars checked on document site. Appointment moved to XXXX XXXX at XXXX am XXXX XXXX - XXXX - Relationship XXXX. All docs are accepted. Under review. Will hear something soon, ( Still havent as of XX/XX/XXXX ) next appt. For XXXX XXXX at XXXX. XXXX XXXX - Sent updated purchase agreement and short sale form to PHH and realtor- per realtor. XXXX XXXX - call - waiting on paperwork from realtor to them.
