Consumer Complaint: I was shocked when I reviewed my credit report and found late payment on XX/XX/2018 I am not sure how this happened, I believe that I had made my payments to you when I received my statements. My only thought is that my monthly statement did not get to me, or the payment was not applied as fast as expected. I checked my bank account and noticed that you deducted the money out of my checking account that on the month that you marked me late on my credit report.

Consumer Complaint: XX/XX/XXXX is the original note date XX/XX/XXXX modification date XX/XX/XXXX maturity date Home Affordable Modification Agreement reads new principal balance {$490000.00}. Item C reads {$29000.00} of the principal balance shall be deferred and I will not pay interest or make monthly payments on this amount.The interest bearing principal balance is {$460000.00} at a 3.75 % fixed rate at 248 payments. Then a Balloon Payment Disclosure states a balloon payment of {$330000.00} will be due XXXX/XXXX/XXXX. I don't understand this loan and the payment doesn't make sense nor was it explained that way to us when we signed the papers that after paying almost $ XXXX we will need to then pay {$330000.00}. On XX/XX/XXXX my husband spoke to PHH customer service rep XXXX ID # XXXX and asked for clarification. He was told at the end of the 30 years we would have to pay about $ 30k and we are on track to pay this off in 17 years. XXXX said he didn't see anything about the {$330000.00} so he could explain that to us. Something isn't right and it looks like we are being defrauded. We attempted to refinance this loan recently but the loan officer ( XXXX XXXX XXXX ) said we needed to see a Real Estate Attorney to see if this loan was legal. She said it didnt make any sense to her and at this point couldn't help us. Something isn't right and the lien holder can't explain it to us. In addition to all of this chaos, PHH isn't applying our payments correctly. They took over servicing from Ocwen in XX/XX/XXXX and the nightmare continues just as it did when Ocwen was servicing the loan. Our payments are being put into suspense and applied to the principal balance when we are making a regular payment. That is triggering our account to reflect being past due and bogus late charges applied to our account. We need to know if this mortgage is legal, we need to understand it and hopefully get someone to refinance us so we don't have to deal with PHH anymore. I have sent them numerous emails about the payments not being processed correctly and it just continues to happen. They don't know how to service loans and can very well kill our credit/fico scores because of their inability to do their job correctly.

PHH refuses to call us back we have been promised a call-back no less than a dozen times and NEVER RECEIVED A CALL BACK!!! PHH IS REFUSING TO SEND DOCUMENTATION TO US THAT THE HOMEOWNER CAN SIGN TO REMOVE LIABILITY FOR PHH TO REMOVE SOMEONE THAT IS DEAD EVEN AFTER BEING PROMISED SEVERAL TIMES NOT ONLY FOR IT TO BE SENT, BUT FOR A CALL-BACK BECAUSE IT HAD NEVER BEEN SENT TO US. Consumer Complaint: OCwen loan Servicing LLC bought my loan from XXXX and I got 2 months behind and tried to catch up by sending 4 payment of {$100.00} extra and they never applied that money to my payments they said they put it in a extra account that just sat for no reason. They foreclosed on my home and I had to file Bankruptcy to stop the sale. That's when I paid XXXX and XXXX to {$4000.00} to help with filing a modification and this was after I was working with Ocwen myself for the loan modification and they keep telling me I was missing documents they needed for the approval. My loan modification was approved after XXXX. And I made the required payments8 then they sent my a package with the final agreement to be notarized and they sent it back 4 times saying there were errors made by the notary until they rejected them and I had to start all over. XXXX and dance XXXX told me they would refile for {$1000.00}, less. I thought I would try again on my own and Ocwen sold my loan to Phh loan servicing, LLC a company owned by Ocwen. In the meantime I'm acquiring interest out the yen Yamg while they are getting paid by there loan insurances. I now owe more on my home than I paid for it and I bought it in 2007 ,12 years. Doesn't this seem wrong. The money just doesn't add up and I went from a 15 year loan to a 30 year loan I don't understand. I have read a lot of stories about Ocwen and Phh loan servicing that sound a lot like mine. Go to Medium web pages and you'll find out about they are doing to home owner. Is their any thing I can do to find out if what their doing is right. I feel as a lot of others they are ripping us off

Consumer Complaint: I tried to set up a repayment plan with PHH. By stating that on XX/XX/XXXX I was going to pay {$1500.00} with a 5 day grace period and the rest to be divided by the rest of the loan. On XX/XX/XXXX I got an email from PHH stating that they could not set that up because my mortgage ends on XX/XX/XXXX which they should have known. So I emailed back stating that can we not do it for the remaining months so I can refinance and be done with each other. While I was waiting for a reply to my email I received the letter dated on XX/XX/XXXX that they handed my account to the lawyer to start foreclosure. So how is that possible? Why are you working on a plan with me yet not working on really? Please help me get it fixed so that I can get on a payment plan or get it modified. I did everything I can to get this back on track they turned me down. I want to keep my house. I want to stay in my house.

Consumer Complaint: I was behind two payments and asked for a loan modification. A modification plan was set in place and I met the agreement plan. I was told that after the period of the loan modification the new agreed payments would be my new mortgage payment for the 16 year term of the loan The modification was made with Ocwen Loan Service. In the interim my mortgage was passed on to a subsidiary PHH Loan Services. They disregarded the new modification and sent a new proposal amortized my principle to forty years and a balloon payment of XXXX at the end of my 16 year term. I told them that I would not accept those terms and that I rather keep the modification agreed upon with Ocwen. I have been making payments but the debt collectors said if I did not agree to sign the balloon agreement then they would reject my payments and then force us into foreclosure

Consumer Complaint: PHH mortgage purchased placed insurance on the property when my insurance expired. That was not a problem. I was notified to submit approximately {$2500.00} to cover the cost of the policy or PHH would place an escrow on my mortgage. I submitted the required money to reimburse PHH for the policy. They then refused to cancel the escrow account until I obtain a different policy even though I reimbursed the cost of a yearly policy. So I paid the {$2500.00}, and now I am paying an additional {$270.00} per month. I am trapped an trying to buy a policy but not getting cooperation from PHH. I have tried multiple times to contact their insurance department to obtain a copy of the policy, but keep getting cut off from the call for various reasons. I have tried to resolve this for the past 6 months and am frustrated by the lack of cooperation from PHH, and the multiple conflicting communications I received in the mail from them. I receive notices that the escrow is cancelled, then one saying it is not. Then another notifying me of the date my escrow is cancelled. When I call the customer service, its like the first time every time I call and I have to retrace my steps every call, this makes it nearly impossible to move forward. No body I talk to can help me. I am trapped into an escrow account while they continue to hold the money they asked me to send in to end the account.
