I XXXX XXXX XXXX is still just an authorized user on the account, Estate Of XXXX XXXX XXXX I can't ; refi and or find other options to avoid forclosure because the loan has not been fully finalized in PHH Mortgages Services and or with the XXXX County Assessor Clerk. PHH has me in default by 64 days, with monthly payment increase two different times, i have been paying what was on my loan modification {$880.00}, i have not been in my new Modified loan for 64 days, i am so confused, as a service connected XXXX Veteran with a family, my everyday life is a hardship, i would like to fix the problem by a mortgage deferral, forbearance without a down payment! please help me fix this situation

Consumer Complaint: Customers Concerns : Bank statements XXXX XXXX : Trial ACH payments started with Ocwen Loan Services on the Months of : XX/XX/2019 ( XXXX ) XX/XX/2019 ( XXXX ) XX/XX/2019 ( XXXX ) The Check for XX/XX/2019 {$750.00} and XXXX XXXX money order for XXXX, was cashed for XXXX The check for {$500.00} N.R.C.U and XXXX XXXX money order for {$200.00} and {$180.00} was not cashed yet for XXXX Errors of these Monies has not been deposited and or applied to the same Suspense account as PHH Mortgage Services current Suspense account. Due to Merger and blackout period ; or due to unkowledgeable data entry employees In which has me short on payments and missings payments causing monies to be applied wrong. Resulting as me reciveing a letter of ; Notice Of Default And Intnet To Accelerate 64 days in Default owing {$2900.00} Loan modification : My final loan Documents were signed by XXXX XXXX XXXX XX/XX/2019 and mailed out me. The account # XXXX, has not been properly updated finalized in your system with the correct information. Many Tasks and Notes of have been added to the account on what needed to corrected. I feel The Estate of XXXX XXXX XXXX has been descriminated against by multiple departments within PHH Mortgages Services family transfer/ Assumptions of loans. This matter/ and or loan Modification should have been completed and reflecting the correct borrower 's info. Within your company and with the XXXX County Assessor along with the Name Change and Title Transfer Request. As a Veteran I can not be assisted by other companies because the title and PHH Mortgages data is still referring to the late XXXX XXXX XXXX. PHH Mortgage Services Research Department # XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Can XXXX I am sending this letter, in regards of the Escrow shortage. I was told by customer service yesterday that a payment in XXXX was rejected, I would like to have this detailed info of the transaction that was declined. My concerns : Business that rejected transaction ( XXXX )? what type of transaction ( debit, credit Card )? The final Modification was done XX/XX/2019 and signed before escrow shortage was analyzed. then loan should be reflecting my name only as of XXXX, my grandmother the late XXXX XXXX XXXX, is still on the account as main borrower, and im still being addressed as C/O ( Care Of ). i am confused how PHH Mortgages family Assumptions and teansfers progress. Being a Veteran I can not get my taxes exemption because the process of the Loan Modification transferring to my name was postponed because of escrow shortage. The paper work at the XXXX County Assessor Clerk reflects XXXX XXXX XXXX. You have now faced me and my family with 54 days late payments wich caused default. and possible forclosure matters. How can we fix this problem, is what i presented to PHH Mortgages.

Consumer Complaint: Hi Im currently in litigation with XXXX XXXX XXXX for a second mortgage for a home foreclosure. The primary mortgage is responsible for paying the second and is refusing to even acknowledge it exists or that the first, Ocwen Mortgage, received an overage on the note due to them. XXXX will never get a dime from me. They are liars and are harassing me for money that is actually owed from Ocwen who took the property. Banks not paying each other is not my problem.

Consumer Complaint: My Mortgage company ocwen was bought out this past XXXX by PHH. I was one payment behind. I have made 10 payments this year, and bank statements to prove. They claim that I had arrearages and applied payments to that. I have nothing that states that. After several attempts, long holds, many customer service people whom told me something different each time, various departments, NOTHING but telling me that I haven't made a payment since XXXX. And that is absolutely NOT the case. I have a modified loan, for 9 years, owned the home for 25 years. I DO NOT WANT TO LOSE MY HOME!

Consumer Complaint: I have a mortgage loan with Ocwen Mortgage which in XX/XX/XXXX was taken over by PHH Mortgage XXXX XXXX XXXX, XXXX XXXX NJ XXXX. I had been going through a foreclosure since XXXX of XXXX. In XXXX through the attorney of mortgage company We came to an agreement that my loan modification would be accept and that we could settle out of court if I agreed to pay my mortgage from XX/XX/XXXX- through XX/XX/XXXX. My monthly payment is XXXX on XX/XX/XXXX I signed the modification loan had it notarized and sent a check for {$10000.00}. I couldn't not communicate with loan company because of the foreclosure so I communicated via through PHH attorneys to find out the status of Modification. It is now XX/XX/XXXX and I have not heard back from mortgage company regarding modification. I also conveyed through mortgage attorney to send me a balance as to how monies were applied. Attorney conveyed information but I never received status. In late XX/XX/XXXX. I received an email that a new foreclosure would commence. Not sure what that meant when I had sent money to settle the foreclosure. I sent the foreclosure intent to mortgage companies attorney why they were sending me such a letter when I had already sent money to settle out of court. Attorney said she would convey the information and get back to me, I also asked attorney to send me a breakdown as to how monies had been applied she said would. It is XX/XX/XXXX and I still have not received correspondence from mortgage company.

Ocwen claimed in numerous documents and recorded notices of default in land records in a beneficiary capacity claiming it held interest in real property address XXXX XXXX XXXX, XXXX, California XXXX. Ocwen claimed it held a Note in which was issued by a lender and was foreclosing on the real property XXXX XXXX XXXX, XXXX CA XXXX. Ocwen claimed I was the borrower of the loan and breached the loan contract document # XXXX XXXX. On or around XX/XX/2014 Ocwen 's trustee Law Offices of XXXX XXXX held a foreclosure sale of the " property '' to pay off the remaining balance of the loan. A third party named XXXX XXXX XXXX , XXXX purchased the " property. '' Question : What is the name of the lender that Ocwen or the Trustee paid off after receiving funds from XXXX XXXX XXXX, XXXX? and what was the amount that was paid off? I would like my complaint published as Ocwen and other third party debt collector 's have wrongfully evicted and taken possession of real property that they did not own. Ocwens actions have and continue to hurt the public.

Consumer Complaint: This property was being worked on by the former Servicer Ocwen Loan Servicing. The new Servicer PHH could not give us any information on this property, even though they told us that the loan number was going to remain the same.They could not find the property in their system. We received no correspondence from PHH. After continuously calling one representative took the time to research what we were telling them. He found the property but the Loan Number had changed from XXXX to XXXX We did not know that all of the work submitted on this home would not be recognized by the new servicer PHH. 1. We sent a loan modification package at their request. ( took over 3 months ) could not use it! 2.Ocwen requested XXXX A Family Transfer Package 3.Ocwen Requested - The Qualifying Assumption Package 4. Ocwen requested a new Deed All of this was submitted through XXXX XXXX @ XXXX optrion # 1 Ext. XXXX Fax : XXXX. We learned about the sale date on the property by a person inquiring about the property. We did not receive the 30 day notice informing us of the pending foreclosure sale. After months of submissions PHH, has no information on all that we submitted.

Consumer Complaint: This property was being worked on by Ocwen Loan servicing. We tried to get information on this property, we got no information and PHH couldn't find the property in their system. Why? because when we first spoke to PHH they told us that the Loan Number would remain the same, that was not true, they changed the loan number and did not notify or tell us. After 30 minutes waiting for a person to search they finally found the property under a new loan number. We did not know that all of the work that was submitted to Ocwen would not be recognized by PHH Mortgage. First we had to send a Modification package, after waiting 3 +months, Ocwen representative informed us that we had to file a Family Transfer Package, then we had to complete a Qualifying Assumptions Package. Now PHH is asking for a loan Modification Package. If Ocwen wanted the Family Transfer Package and The Qualifying Assumption Package, and a new Deed for the property. All of this was submitted to Ocwen : XXXX XXXX phone # XXXX option1 ext. XXXX.Fax # XXXX We only found out about the sale date through a person inquiring about the property. We received no correspondence from PHH with a sale date or any other information. We are asking for help with this property because we have done everything Ocwen asked us to do and now we must go through all of this again and have a sale date. Please help us with this situation. Consumer Complaint: In XXXX we experienced a catastrophic flood. Our first mortgage is with XXXX XXXX and second mortgage is with PHH ( formerly Ocwen ). We had to incur a third mortgage from the XXXX to complete the repairs while seeking a supplemental from XXXX. The repairs were completed in XXXX, passed inspection, and claims with both mortgage companies were closed. After a lengthy legal process we received a supplemental check for {$50000.00} from XXXX in XXXX. These funds are to be applied to our XXXX loan to avoid a duplication of benefits. XXXX XXXX endorsed the check as required but PHH is refusing to. Instead they incorrectly opened a NEW claim and are requiring the funds be placed in their own escrow account. My attorney and I both explained and provided documentation this is not a new claim and forwarded them additional documentation explaining how XXXX will handle the funds. PHH is still refusing to endorse the check. These funds belong to the XXXX, our attorney and us, in that order. XXXX XXXX seems to understand that as the first lien holder but PHH does not seem to grasp the concept. We have never been late on a payment with either mortgage company or the XXXX. We are simply trying to get this supplemental check applied to our XXXX loan as the XXXX legally requires us to do. Please advise.
