Consumer Complaint: We Filed Bankruptcy in XXXX of XXXX. Ocwen Delayed the release of the bankruptcy by 60 days because they would not reafrim the loan. To this day, they still have not reafirmed the loan. The paper work has been sent several times with no explanation other then they did not get the paper work. I have confirmation now that they have received it. We were released from Bankruptcy in XXXX of XXXX. They also took it upon themselves to change the way they pay our property taxes. We asked that they pay it at the end of each year and they have not changed that deciding to make it the 3 payment option after the XXXX of the year.

Consumer Complaint: This loan is called ocwean and they recently changed their name to phh loan. My home burnt down a year and a half ago my insurance company sent me 2 different checks For my contents and value of my home. I sent ocwean a check from XXXX that was the exact amount to pay this loan off and close the account for good. They kept insisting that I needed to have a Affidavit. So 3 different times we have mailed it back with the pay off signed and notarized and they kept saying it was sent back to late but we sent them out the day of or day after it came to our house we even had them fax it to my attorney and ocwean told us to fax take 24-48 hours and my attorney didnt receive it until a week and a half later and they notarized it that day we signed it and they faxed it back still, the check they have cashed which was from XXXX and my adjuster told me they cash it & they have it sitting in a escrow account and wont release the funds to pay the loan off, now they have charged me up to XXXX and are trying to foreclose on my property that my new home is being built. I have called them over 50 times and they cant answer my questions, or they hang up on me or just keep transferring me to different departments. Ive received letters in the mail to sue this company this is the kind of loan that I have paid on for 30 years and it never paid off the principal balance. I need help because this doesnt seem right when they was paid in full to close this account and never have to do business with them again.

Consumer Complaint: This started since XX/XX/2016. There was disaster in Louisiana. I signed up for foreberance. Two disaster back to back. Work was scarce and I had to ask for another. I try a pay payment plan. The keep starling. While I was going the foreberance they was reporting on my credit and they wasnt suppose to and they agree they were wrong. I ask them to remove it because, I try to get another car, I am an inspector and need transportation they never removed it in time I had to pay XXXX down payment. Which is what I owe them. It kept putting me behind. They assured me they round do a long Modification and they keep denying it. I talked to them. They kept telling me to do it. Misleading me to think I would get approved. Now it over two years and they still going the same thing.

My unique signature has been forged in two different forms. One on the Mortgage note and the other form on the Mortgage Documents. Given that the Bank has chosen to mail these fraudulent document, it is also mail fraud. I have fought this case Under Index # XXXX/XX/XX/XXXX Supreme Court / XXXX County/ New York This case could not move forward and the Bank sold this debt to Ocwen Loan Servicing and they indicated another action under Index # XXXX/XX/XX/XXXX. I have attached all of the documents that will back up the identity theft, forgery, mail fraud and misrepresented documents to the Court. The Bank and Subs willfully mislead the Bank with false and inaccurate documents. Please review the attached. There has been 3,072 cases of Mortgage Fraud reported against this Bank and or its subsidiaries.

Consumer Complaint: Hello, I refinanced my VA loan with PHH and closed XX/XX/XXXX. It has been over two months and I still have not received my escrow refund. They claim they sent a check out on XX/XX/XXXX after waiting for weeks, I contacted PHH in XX/XX/XXXX and they indicated they would send a replacement check on XX/XX/XXXX, after three weeks and still no check, I contacted PHH again and they blamed the USPS for me not receiving the check. On XX/XX/XXXX PPH told me to wait and see if the check arrived over the weekend and they would give me a call Monday, XX/XX/XXXX, to followup. I did not receive a followup call so I contacted PHH again and they informed me a request had been made to expedite the issue but it would take 7-10 business days before they knew anything. They told me to just wait and they will get back to me. It has been over two months since I refinanced my loan and still not receipt of my escrow refund. Every time I call PHH they tell me they are working to resolve the issue and it will be another 7-10 business days before they or I know anything. As a consumer, I have been taken for a ride and it appears I have no recourse nor any type of consumer advocacy to resolve the issue. I fear I may never receive my escrow refund after repeatedly being told to wait 7-10 business days.

Our property is XXXX XXXX inside the of the aforementioned trust. In XXXX, we refinanced and then settle this mortgage with XXXX XXXX XXXX. The debt was settled with lawful money but a security deed was created by XXXX XXXX XXXX. XXXX XXXX XXXX went out of business in XXXXXX. Our research indicates that a security deed remained on our property even after XXXX XXXX XXXX went of business. STATED BELOW IS OUR MAIN ISSUE : On or around XX/XX/XXXX, on behalf of XXXX XXXX, XXXX unlawfully executed an assignment from XXXX XXXX XXXX to XXXX XXXX XXXX XXXX XXXX AS TRUSTEE FOR XXXX XXXX XXXX , XXXX., MORTGAGE LOAN TRUST, SERIES XXXX. In our research, as detailed in the Pooling and Serving agreement ( On The SEC website and attached to this complaint ), the cut-off date for this Remic was XX/XX/XXXX with a closing date of XX/XX/XXXX. Adding this alleged loan roughly 9 years latter ( XXXX ) would have made the entire Remic defective ( ultimately collapsing this REMIC ). As the XXXX identifies that moving this loan into this REMIC 9 years latter is impossible and totally unlawful.. During unlawful foreclosure attempts, XXXX XXXX is specifying that they are acting on behalf of XXXX XXXX as attorneys In Fact for said Foreclosure. Prior to all unlawful attempted foreclosure actions, the XXXX XXXX & XXXX XXXX XXXX XXXX XXXX ( PRIVATE SPECIAL PRIORITY ) executed Revocation of power of attorneys for XXXX XXXX, XXXX, OCWEN, PHH, XXXX and all associated parties. They all received notification of these filings. XXXX XXXX has continued to proceed unlawfully. In contacting XXXX XXXX, ( employee identifier XXXX ) informed us that the investor ( Secured holder of mortgage ) was XXXX XXXX and NOT XXXX. While the documentation sent to us by XXXX ( identifying themselves as the servicer ) specifies that XXXX XXXX is the investor/Secured creditor. The information that we've received is all over the place. In Contacting XXXX customer service ( XXXX XXXX ), specifies no loans associated with our names, address or SS #, In Contacting XXXX XXXX ( XXXX at XXXX ) and XXXX XXXX, specifies no loans associated with our names, address or SS #. In Contacting XXXX XXXX ( Customer service XXXX ) specifies no loans associated with our names, address or SS #. CONCLUSION : Our original loan # XXXX XXXX/PHH/ OCWEN are attempting to assign us a new account number of XXXX XXXX XXXX , OCWEN FINANCIAL , XXXX , PHH , MERS are all colluding to defraud XXXX XXXX and XXXX XXXX XXXX.
