Consumer Complaint: Dear Consumer Financial Protection Bureau, The reason why I am contacting you is because my mortgage company PHH Mortgage Services has made a mistake and is forcing me into an escrow account. Due to the Pandemic situation, and for this first time, I got delay with my taxes. On XX/XX/2020, I received a letter from PHH attached, saying if I do not pay the taxes for the amount of {$6400.00} to them within 30 days they will set up an escrow account as part of my monthly payments. So in order to avoid that I called them on XX/XX/XXXX ( Ref # XXXX ) to place the payment over the phone and I was told that since I have a disbursement of {$800.00} in my account the amount that I had to pay was {$5600.00}, which is the amount I paid that day. Now, a month later I received my new monthly bill which increase from {$1500.00} to {$2200.00}. So I called right away and the reason for this increased, and they said that I did not paid the taxes which I did on XX/XX/XXXX ( see proof attached of the email received after payment ). After proving to them that I paid the taxes, they told me that by mistake they misplaced my payment and it went into my principal and told me to give them about 2 weeks to fix the problem. They called me again today XX/XX/2020 XXXX ( Ref : XXXX XXXX XXXX Escalator Manager XXXX ext. XXXX ) saying that the {$5600.00} was reapplied toward the taxes but the other {$800.00} they couldnt because it was not an actual disbursement, it was a late fee for my taxes. Then I asked him why was I told that I had a disbursement and I didnt need to pay the full amount just the {$5600.00} and he said that it was a wrong communication from them. So from that point I told him that I will send them the {$800.00} to clarify the account due to their mistake, and he told me No XXXX, I am sorry but you are already enrolled in escrow account and there is nothing we can do about that. At that point I got very upset, they made a mistake with the amount they told me to pay over the phone ( minus the disbursement ), and now theyre acting like they never told me that. Why would I pay {$5600.00} instead of the {$6400.00}? They misplaced my payment toward the principal, and told me to pay a wrong amount So basically they pushed me into an exaggerated escrow account impossible for me to pay, with lies and mistakes made on their behalf. Consumer Complaint: I just filed a complaint ( # XXXX ) against PPH Mortgage on XX/XX/XXXX regarding lost payments and here we go again. The complaint was closed on XX/XX/XXXX with the late fees being reversed. I just received my XX/XX/XXXX mortgage statement from PPH Mortgage Services ( PPH ) ( f/k/a Ocwen Loan Servicing ) and saw that there was a charge for a BPO in the amount of {$110.00}. I called PPH customer service ( XX/XX/XXXX ) to ask what was a BPO was and why this expense was being added to my account. Customer service explained that it was a Broker Price Opinion but could not explained what it was or why it was being applied to my account. ( BPO, means, a real estate professional looks at your house to give an opinion on the value of your home. ) There is no need to have a BPO done on my home. It is not in foreclosure or bankruptcy. Customer service, stated that it would take XXXX days before I could get an answer which was not good enough. I have an XX/XX/XXXX mortgage with PPH. The BPO fee was applied to the 2nd mortgage ( as if I would not see it XXXX, and not the main mortgage. I feel like this is harassment and retaliation for filing the complaint with the CFPB because PPH could not get the late fees for XXXX and XXXX, so now they are trying to add an unjustified illegal BPO fee. During this COVID-19 pandemic, homeowners can barely pay their mortgage and to add unnecessary fees is just highway robbery. I have paid my mortgage every month, and unfortunately, I need to take certain precautions in dealing with PPH. Apparently, PPH does take any complaints from CFPB serious because they turn around and try to gouge consumers with unjustified fee. Attached also is the delivery receipt of my XX/XX/XXXX payment in case PPH claim that they did not received it.

Consumer Complaint: I am requesting an investigation of fraud and predatory lending on XXXX XXXX Mortgage and PHH Mortgage. I recently had my mortgage documents reviewed by a mortgage professional because I believed my sister ( XXXX XXXX ) and I were victims of mortgage fraud and predatory lending. My loan originated in XX/XX/XXXX by XXXX XXXX XXXX. I was supposed to be a co-borrower to help my sister buy her first home. I am a veteran but during that time frame I was on XXXX XXXX and was on my way to XXXX. The loan officer had my sister and I fill-in two applications for the mortgage loan. I was advised that I would be the co-borrower for only a few months until they refinanced the loan with only my sister on the new loan. I recently discovered that only my name was on all the mortgage documents of XXXX XXXX Mortgage although during the closing both my sister and I was required to sign all the mortgage closing documents. We were advised because we was bother and sister we had to sign separate documents. However, on the 2nd mortgage both our names are on the mortgage closing documents together. The loan officer put us in a sub-prime loan product and recommended two mortgages as an 80/20 loan product. The first mortgage was 80 % and a second loan 20 %. We had asked for a normal conventional loan but we was advised that we would have a regular conventional loan when they refinanced my sister in 3 months by herself. We was also put in a interest only loan for the first 5 years on the first mortgage and an interest only loan on the 2nd mortgage with a balloon payment. The balloon is now coming due in XX/XX/XXXX. I have attached an article regarding XXXX XXXX being held responsible for loans that they purchased from Mortgage Brokers in the XXXX area due to illegal actions with sub-prime lending. I believe XXXX XXXX Mortgage and PHH Mortgage as my 1st and 2nd mortgage lien holders should be held responsible for the fraud and predatory lending on my loan. I also believe XXXX XXXX has continued to take advantage of me as a veteran, when they modified my loan in XXXX. My loan was modified to a 40 year loan. My sister has made every payment and the balance reflects very little paid to the principal balance of the first mortgage and nothing on the 2nd mortgage. We are also questioning the value and sell price when we purchased the home for my sister. It appeared the seller and the loan officer at XXXX XXXX XXXX knew each other. We are upside down on our mortgage and refinancing will be impossible. I have requested my original mortgage documents from my lenders but I have not received our original applications, HUD 1 and Closing documents to send to your office. I am also requesting a full investigation and I am asking that your review the attached documents of the government investigation of XXXX XXXX and require similar actions against XXXX XXXX and PHH Mortgage on my behalf. Consumer Complaint: In a letter datedXX/XX/2020 and received by me on XX/XX/2020 : PHH Mortgage informed me they had received notice from " our tax service '', that property taxes were past due on my property at XXXX XXXX XXXX, XXXX, TX XXXX. The letter had no postmark or any way to verify when they mailed it. Since I pay my taxes myself, I know they have been paid. So I immediately requested a copy of whatever communication they had that indicated the taxes were overdue. I immediately got a thorough run-a-round. First they had the letter, they when I wanted a copy, they thought maybe they saw it on a web site. When I asked what web site, no one could tell me. When I asked how they verified the taxes were past due, no one had an answer. PHH Morgage has been trying for years to get me to set up an escrow account, which I have refused. Since I pay the taxes myself on a timely basis, PHH Mortgage has no need for an escrow account! Unless PHH Mortgage makes money using the escrow money before it is needed, why are they so adamant about having an escrow account? I am XXXX and consider this constant harassment a threat to my health. Maybe you can do something about it? Thanks for all your help.

Consumer Complaint: On XX/XX/XXXX PHH Mortgage sent me a servicing transfer letter. It did not include an assignment of mortgage from my previous lender or servicer to PHH Mortgage. On XX/XX/XXXX in response to a qualified written request PHH Mortgage sent me the note, mortgage, loan application, settlement agreement, and Truth in Lending. It did not include an assignment of mortgage from my previous lender or servicer to PHH. They sent me the mortgage from XXXX XXXX XXXX XXXX and XXXX XXXX. I've asked them for the assignment of mortgage on several occasions, and on XX/XX/XXXX they sent me a letter indicating then XXXX tracking number XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX can be used in lieu of the assignment of mortgage. On XX/XX/XXXX XXXX tracking number showed XXXX XXXX XXXX XXXX was inactive. PHH Mortgage on XX/XX/XXXX they told me the XXXX tracking number has been changed to PHH Mortgage Corporation. I asked them to provide documentation that authorizes them to change the XXXX tracking number and they told me they do not have the assignment of mortgage. PHH does not own my mortgage and should not be servicing the loan.
