Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: I had applied for a loan modification with Ocwen in XXXX of XXXX, and I was approved for a loan modification with 3 trial payments, I was approved for a Principal reduction for {$150000.00} that was to be given in 3 parts over the next 3 years, I completed my trial payments in the month of XXXX as planned, and I was told by Ocwen that I would receive an agreement to sign and return, I waited for the agreement for the whole month of XXXX, and no agreement ever came, made repeated calls and asked them to send me the agreement and they just made me wait each time, I even tried making payments during this time but Ocwen would not accept my payments, they kept saying that they won't accept any payments until and unless they have received a signed agreement, and finally they sent me an agreement on XX/XX/XXXX of XXXX, I returned the signed agreement the same day and cleared all the missed payments as soon as they received the agreement. I have been fighting Ocwen and now PHH ( as they were taken over by PHH in XXXX ), but I have been turned down the {$150000.00} without any mistake of mine, I need PHH to correct their mistake and give me my {$150000.00} discount as I have never been late on my mortgage ever since.

Consumer Complaint: The following parties have each acted in the capacity of a debt collector for a refinance mortgage loan that my late husband ( XXXX XXXX ) and I executed on XX/XX/XXXX in favor of XXXX XXXX XXXX XXXX ( " XXXX XXXX XXXX '' ) as lender : ( 1 ) XXXX XXXX ( " XXXX XXXX '' ) ; ( 2 ) PHH Mortgage Corporation ( " PHH '' ) ; ( 3 ) Ocwen Loan Servicing LLC ( " Ocwen '' ) ; ( 4 ) XXXX XXXX XXXX ( " XXXX XXXX '' ) ; and ( 5 ) XXXX XXXX XXXX ( " XXXX '' ). By debt collection communication dated XX/XX/XXXX, a copy of which is enclosed hereto as Exhibit " A '', XXXX c/o PHH, declared that my mortgage loan has been in default since XX/XX/XXXX and the last full payment applied to my mortgage loan was for the installment due XX/XX/XXXX. By debt collection communication dated XX/XX/XXXX, a copy of which is enclosed hereto as Exhibit " B '', XXXX XXXX on behalf of PHH as the successor to Ocwen, declared that my mortgage loan has been in default since XX/XX/XXXX. By complaint filed in the Superior Court of New Jersey on XX/XX/XXXX by XXXX, prosecuted by XXXX XXXX, and maintained to present date by XXXX through XXXX, the foregoing debt collectors declared and continue to declare under penalty of perjury that I defaulted on my mortgage loan as of XX/XX/XXXX. A true and correct copy of the XX/XX/XXXX foreclosure complaint commenced, prosecuted and / or maintained in the Superior Court of New Jersey under Docket No. : XXXX is annexed hereto as Exhibit " C ''. The foregoing statements of default made by the aforementioned debt collectors are false and deceptive upon omitting and concealing : ( 1 ) ten checks, copies of which are enclosed here as Exhibit " D '', totaling {$15000.00} that were paid to and cashed by Ocwen 's predecessor and affiliate, XXXX XXXX XXXX XXXX ( " XXXX ), for XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; and XX/XX/XXXX without any credit to the subject account ; and ( 2 ) three checks totaling {$5100.00} that were paid for XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX and returned by XXXX without any legitimate reason and / or explanation, as displayed within the correspondences enclosed hereto as Exhibit " E ''. Furthermore, the statements and implications made within the XX/XX/XXXX and XX/XX/XXXX debt collection communications by Debt Collectors XXXX, PHH and XXXX that the last payment made towards and / or applied to the subject account was for XX/XX/XXXX, are false because I did not make any payments for the months starting XX/XX/XXXX through XX/XX/XXXX upon following the instructions given to my late husband and I by Debt Collector XXXX ( for whom Debt Collector Ocwen is the successor ) in order to qualify for a modification, and Debt Collector XXXX declared under penalty of perjury within its complaint filed on XX/XX/XXXX in the Superior Court of New Jersey under Docket No. : XXXX ( the same day my husband died ) that a default under the subject account number occurred as of XX/XX/XXXX upon my failure to pay on XX/XX/XXXX. A true and correct copy of the XX/XX/XXXX foreclosure debt collection complaint filed by Ocwen 's predecessor / affiliate XXXX in the Superior Court of New Jersey under Docket No. : XXXX, and voluntary dismissal by Ocwen on XX/XX/XXXX is enclosed hereto as Exhibit " F ''. Lastly, despite and in violation of 12 CFR 1026.41 et seq., PHH and XXXX XXXX refuse to provide me a monthly mortgage statement for the payment declared due as of XX/XX/XXXX.

Consumer Complaint: I am following up on my original complaint, # XXXX. The lender asked for some time to research the complaint and contact me with their findings. Consumer Complaint: I mailed my mortgage to PHH mortgage services for XXXX on XX/XX/XXXX. It was not posted until the day I called them to see what the matter was. They claimed that they hadn't received it so I paid online with the support person the amount of the mortgage plus a {$46.00} late fee. Today I noticed that they posted my original payment the same day I paid the mortgage and late fee.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: My credit rating for all three companies continuously shows delinquent charges even when XXXX XXXX & their Mortgage company PHH Mortgage has formally submitted a mortgage condemnation 1099 to the IRS. All three credit reporting companies have not updated my credit rating since XX/XX/XXXX even after being shown proof that the claims are fraudulent claims by XXXX XXXX & their Mortgage company PHH Mortgage. I have filed claims before that were investigated by lawyers at the law firm XXXX XXXX XXXX XXXX CO instead of directly by the company 's listed above. The mortgage in question was an illegal mortgage as was the primary cash purchase loan and the following second mortgage to begin with and the house needs to be condemned because it is not built to national or local building codes. Because of the incorrect reporting they are slandering my reputation, my creditability and my credit rating on a daily basis. This has been ongoing since XX/XX/XXXX when they forced the liquidation of investment holdings that were held as collateral for a line of credit that was used as a second mortgage on the same property. I was not in the Arrears with either loan. The XXXX XXXX XXXX took this action after I informed XXXX XXXX XXXX XXXX XXXX that the house was not built to national or local building codes. Here is a link to all the evidence. https : XXXX! XXXX? XXXX

Issue: Trouble during payment process

Subissue:

Consumer Complaint: PHH Mortgage acquired a mortgage on a second home from GMAC many years ago. The payments for the mortgage have been made on autopay for many years ( unfortunately, the autopay system I used was discontinued and the switch to a new system caused one payment in XXXX to be about 20 days late, but that's not directly relevant to this complaint ). My condo association has historically been very slow on sending PHH proof of flood insurance and that delay caused them to place a flood insurance policy. That caused them to create an escrow account for that amount, which, in turn, caused them to consider my payments too low, so the payments weren't credited to my account when received. This caused them to consider my payments late and much a report of that to the credit reporting agencies. It took a long time ( slowed down by COVID-19 issues ) to obtain the flood insurance info from the condo association, but this was fixed around XX/XX/2020 by their insurance department. They said it would take about 10 days to remove the charges for the placed insurance and eliminate the escrow and then Customer Service would properly apply the payments that were made and notify the credit agencies that this was done. However, despite exchanging numerous emails, none of the above has been done and as recently as today they claim that I owe several XXXX dollars in payments. However, those payments were received and in their " suspense '' accounts. Unfortunately, COVID-19 is making this situation harder since I'm not at my residence and only receive mail sent there with delays of a couple of months.
