Consumer Complaint: I have filed a complaint against XXXX to which they replied in a complete wrong. I have provided them with taxes, hardship letter, divorce, quick claim deed AND a new application. Just yesterday they sent me a letter asking for this information. They did not include a request for the quick claim deed ( Which I sent XX/XX/XXXX. ) They are asking for information over and over from my ex-husband who should have been taken off the loan/mortgage. IF they are behind in paperwork they can own that. BUT looking at dates and timelines. I sent them a divorce decree XXXX XXXX, XXXX. This process began in XXXX in my name. XXXX XXXX. I would aslo like to add a PS that this company did charge over {$5000.00} in past legal fees as well as attempted to foreclose on this house in XXXX. Although they claim to want to help people it is my experience that they bully and torment clients to the point of exhaustion and come in for the kill. At this point again XXXX they are ashing me for yet again a new stat on the paperwork.

Consumer Complaint: The mortgage company Forged documents in my Foreclosure Proceedings. The backdated assignements to a closed trust. They did not follow the guidelines of the National Mortgage Settlement act and over an option prior to foreclosure or have an interview prior to foreclosing. The Mortgage company never purchased the loan from the prior lender because the prior lender was out of business when they said they purchased the loan. The assignments of mortgages are not attached to the orginal mortgage. PHH/Ocwen sold and FHA loan without it going onto the Market which is in violation of HUD and sold the home as a non arms lenghts transaction. XXXX XXXX had a court order in which it told OCwen and PHH to stop using their name when foreclosing because it was fraud, however in my case PHH/OCwen continued this practice because would not allow OCwen to foreclose so they created PHH which is owned by OCwen and then acted as if XXXX XXXX was the lender -- when XXXX XXXX was never the lender. Owen created a fake assignment in XXXX and backdated it to XXXX to make it seem like XXXX XXXX owned the loan. This is the XXXX that I submitted to PHH/Ocwen and XXXX XXXX and they have not replied XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX, NJ XXXX Email XXXX XXXX : XXXX XXXX # XXXX FHA Case # XXXX XXXX : XXXX XXXX XXXX, XXXX, NJ XXXX XXXX : XXXX XXXX XXXX To Whom It May Concern In my title there are many discrepancies, like how can may loan be assigned to XXXX XXXX XXXXXXXX XXXX XXXX XXXX when the trust closed in XXXX. Because of that, I would like to have proof of all accounting records, including ledger statements and pooling agreements to show that XXXX XXXX actually purchased my loan. Please verify the IRS Tax Receipt showing the selling of my loan to XXXX XXXX in XXXX. Please provide proof of payment to show that XXXX XXXX purchased both the mortgage and note. Need Dates Purchased and the amounts Purchased. How can a defaulted loan be assigned to a XXXX which is in violation of IRS Code and The Trust agreement? In XXXX this loan which was in default was assigned as a XXXX and placed into the XXXX closed Trust which violates XXXX Laws. Please provide proof that this loan was transferred, assigned, or sold to the XXXX. If it was not, please state that it was not transferred, assigned or sold in XXXX to the XXXX. When did you sell or assign the loan to Ocwen? Please provide all authority or sales information. PHH sold this home after the home went to foreclosure in the name of XXXX XXXX in XX/XX/XXXX. Please provide proof that funds were forwarded to XXXX XXXX from PHH. Please provide your chain a title, and explain how this loan which was in default could be assigned in XXXX to a trust that was closed in XXXX. And if the loan was in default how you were able to circumvent and assign the loan to the Trust when the trust clearly states no defaulted loans could be assigned to the trust? The trust closed XX/XX/XXXX. Please advise why there are unattached stamps and undated stamps on assignments on blank sheets of people when all assignments must be attached to the original? Please explain how PHH was able to sell an FHA mortgage after a foreclosure without the home being listed on the market which means it was a non-arm 's length transaction. Please advise how PHH/Ocwen was able to Foreclosure in the name of XXXXXXXX XXXX when XXXX XXXX ordered PHH/Ocwen to stop using their name in Foreclosure proceedings. As of XX/XX/XXXX, Ocwen could no longer assign FROM Ocwen to another entity without first providing aa Assignment TO Ocwen. Please provide the assignment from Ocwen to Ocwen. Please explain these title issues A. The first Assignment does not appear to contain appropriate recording information for New Jersey. Mortgage in this Assignment is dated XX/XX/XXXX. It assigns to XXXX on XX/XX/XXXX, and is recorded on XX/XX/XXXX ( XXXX Pg. XXXX ) The original Mortgage was recorded on XX/XX/XXXX at XXXX at XXXX XXXX " XXXX ''. XXXX This is different than the info on the Mortgage itself, as it is dated XXXX ) B. The second Assignment, allegedly executed on XX/XX/XXXX, not allegedly notarized until XX/XX/XXXX, and not recorded until XX/XX/XXXX XXXX XXXX pg. XXXX ). Consumer Complaint: I have a mortgage loan that was transferred from XXXX XXXX XXXX to PHH Mortgage on XX/XX/XXXX. The final payment made to XXXX on XX/XX/XXXX included a principal only payment of {$3100.00}, bringing my mortgage balance down to {$280000.00}. That is also the balance due confirmed verbally by XXXX that was transferred to PHH. The balance due listed on my first statement from PHH is {$290000.00} -- exactly {$3100.00} more than the balance that PHH should have assumed. I contacted PHH Customer Service over a week ago and got no response. Meanwhile, my first payment has been processed by PHH and they are charging interest against the higher amount, not the correct amount. This is a blatant and unethical attempt by PHH to deceive the customer, and I doubt this is the first time this has occurred.

Consumer Complaint: I signed with PHH Mortgage Services to re-finance my VA mortgage in XX/XX/XXXX for a 2.5 % interest rate, PHH failed to complete actions to ensure the re-finance rate lock would expire. Once the rate lock expired PHH practiced a bait and switch tactic to lock me into 3.25 % interest rate, the same interest rate as my current mortgage loan. Throughout the 6 month re-finance process I was assured we would be closing with a week or two multiple times between XXXX and XX/XX/XXXX and was informed 4 days prior to the rate expiration there was still a month worth of closing actions PHH still needed to complete. PHH told me I needed to re-apply for the re-finance at a 3.75 % ( half a percentage above my current mortgage ), but their manager would lower the rate to 2.5 % after I re-applied. After I signed in good faith at 3.75 %, they told me they could only honor 3.25 %. I then realized this was a bait and switch tactic where PHH willfully expired the re-finance interest rate lock to perform an unfair predatory lending tactic. Members of the PHH team I was working with even nullified each reason why PHH stated they were unable to close with in the required time. Upon submitting a formal complaint to the PHH Research Department ( who confirmed they received the fax on XXXX XX/XX/XXXX XXXX no response was received with in the allotted 10 business days.

Consumer Complaint: On XX/XX/2021 wife tried to pay Escrow shortage on line with PHH Mortgage and was unable to do so. Wife called and was told we need to sign a document to be able to pay online and they would email it to us. Rep told us there would be a {$19.00} charge to do it over the phone, rep said they would waive fee. Wife tried to pay mortgage online thru PHH web site and is unable to. I called on XX/XX/2021 after she printed the document and document states this is " A signed amendment to the original note is required " I asked the Rep Agent ID XXXX if there is a fee and she stated there would be no fee for a AutoPay program or Reg US Mail XXXX which is stated on page 1 of the form ), I also asked if this was an amendment to our Mortgage and she stated no but, it says " A signed amendment to the original note is required ''. On note amendment # 2 states can charge up to {$19.00} per payment for payment methods not specifically provided for by the note, such fees are not limited to cost of processing or making payments methods available. On note amendment # 3 fees may include payments over the phone with a rep, automated phone system, online, or other methods not expressly provided by note.

Consumer Complaint: Hello, I currently went through a divorce and needed to refiance my house to take my ex off the loan/house. I went with current morgage compnay ( PHH ) because they offered a steamline and I thought that would be quick and easy, that was XX/XX/XXXX in XXXX they informed me that there wasnt enough history that I was paying the morgage myself after writing a letter and proving that it was I that had always paid the mortgage. So then they offered another route so we did that and I was denied. PHH Mortgage called me In XX/XX/XXXX offering me a FHA Loan that pretty much was a sure thing and after numerious request of info ( that was provided multiple times, but always requested cause it was always changing hands ) it is now XX/XX/XXXX and my refiancing is still up in limbo and now they are requesting more info that was answered and provided previously. I purchase a few houses and refianced in my time and even in todays world with COVID everyone tells me 30days to close but 45days worse case.I can go on and on with Apprasal XXXX up to Supervsor not calling after requesting to speak to one numerious times All I can say is Im not sure what they are doing but I never expeianced anything like this before

I sold my home on XX/XX/XXXX XXXX the mortgage is paid in full ) and at closing I had to pay Real Estate Taxes in the amount of {$3900.00}. NewRez had also paid the same amount to XXXX XXXX in XXXX NC, and as such, the payment was duplicated. I had contacted the XXXX XXXX XXXX XXXX and they had informed me that they had returned {$3900.00} in XXXX of XXXX to New Rez. Therefore, NewRez owes me {$3900.00} as a refund of my duplicate escrow tax payment. I had initiated the inquiry to NewRez on XX/XX/XXXX and the matter never got resolved. I then wrote a letter to their CEO, Mr. XXXX XXXX on XX/XX/XXXX complaining about the lack of response on my refund. They send me a letter on XX/XX/XXXX acknowledging that I was due my refund but to date my refund has not been received.I am tired of waiting on them for my refund. To me this should have been resolved a long time ago. Why should I have to wait 6 months for this to be resolved?
