Then XXXX transferred the servicing of our account to XXXX Mortgage and just here recently XXXX Mortgage transferred the servicing of our account to NewRez. We just told recently that we did a 50 year loan with XXXX XXXX and did a modification for XXXX which in year XXXX then we are to pay the XXXX no interest. None of this is true and we need help.

Consumer Complaint: I was approved for a loan modification in XXXX of XXXX. Due to COVID 19, the company extended three trial payment through XX/XX/XXXX. The trial modification was to include removing my former wife from the loan documents. Now after they have taken my money once again they still say they can not remove my former wife from the loan. I have asked and have been told numerous times how it must work to remove my former wife any number of times. I have written documentation from the Ombudsmen from XX/XX/XXXX that reads they in fact will remove my former wife name from the account, I have been going through this for 5 Years now, in addition I have offered to deal with this situation through a mediator. The loan was discharge through a bankruptcy, I was not told in could not be assumed.I have been trying to settle this for ages, how do I get some help here XXXX XXXX

Consumer Complaint: XXXX is missing from our payments. We have asked for the statements and they refuse to give them to us. We have ALLLLLLL the proof you need. We have sent certified letters, emails, and a dozen of phone calls. They will not respond. 14 years of statements all of a sudden come up missing. They stole XXXX from our payments over 14 years. Their attorney a month ago said he would send the missing statements. They never sent anything. I emailed them 9 times and no response. If I try to call them it just goes to voicemail. I have left about 10 messages so far and no return call. It is pathetic. They need to be closed the f down or be in jail. I will send all the proof you need from bank accounts, emails, and phone records. We are sick of them and their greed. I want the deed to our home or the right to sue them. We are beyond XXXX off. They illegally charged us XXXX dollars to make payments when it was XXXX. They refuse to respond to us. We have paid in advance over XXXX. We are not behind but I did not know what to check on the complaint. We need help with them stealing from us. I promise you they are thieves. I want the deed asap or I am going to sue the sh -- of them. Thou shall not steal!

Consumer Complaint: I refinanced my mortgage, and PHH Mortgage purchased the servicing agreement, in XX/XX/XXXX. My previous service company originally indicated that they would pay the 1st installment of my XXXX taxes, however, when the payment came due, they failed to do so. I contacted my previous service company but also noticed that the money for my taxes had been escrowed with PHH Mortgage Services. At the beginning of XXXX, I contacted PHH mortgage and spoke to someone in their customer service department. I didnt her her name, however, she reassured me that my taxes would be paid, and that PHH would be responsible for any late fees. On XX/XX/XXXX, when my taxes still had not been paid, I telephone PHH Mortgage again and this time was requested to email a copy of my unpaid tax bill to customer care, which I did. By midXXXX, my taxes still had not been paid so I telephoned PHH Mortgage again, to find out when my taxes would be paid, only to be told that I should email customer care and the tax department, which I did. On XX/XX/XXXX, my taxes were showing as delinquent on the XXXX County Treasures website and I was livid. I telephoned PHH Mortgage again and was forwarded to an escalator named XXXX, who reassured me that this matter would be rectified immediately. Please see enclosed, a copy of my tax bill for the 1st installment of XXXX. To this day, my taxes remain unpaid and show as being delinquent. I am an Illinois XXXX XXXX XXXX. I cant have my taxes being shown as delinquent. The money is sitting in my escrow account. Each time I call PHH Mortgage they say the tax department is investigating the matter. After 5months of my mortgage loan account having a XXXX Balance, XXXX XXXX, XXXX XXXX, and PHH reported a Negative Remark which impacted my credit Report XXXX on XXXX XXXX causing me harm. XXXX XXXX, XXXX XXXX, nor PHH had the right to Report any information pertaining to me to XXXX In XXXX XXXX, XXXX XXXX and PHH previous replies I disputed XXXX in XXXX of 2021, in which they replied that same month. Can XXXX XXXX, XXXX XXXX, and PHH provide the Law which states that as a Lender they had the right to Report a Negative Remark to XXXX during the Month of XXXX, when my intial complaint/dispute was in XXXX? This is two months later, which clearly means XXXX XXXX, XXXX XXXX, and PHH has violated my rights. How and why would XXXX XXXX, XXXX XXXX or PHH sworn that what they Report was true, when I clearly don't owe this company any MONEY. Can XXXX XXXX, XXXX XXXX, and PHH explain why there Continued, Abusive, Malicious Practices, Unethical, Unjust and Unlawful Acts CONTINUE to Retaliate against me after my Loan was Paid in Full, Closed, and With a XXXX Balance. Consumer Complaint: The last time I submitted this complaint on XX/XX/XXXX to the CFPB, I had to watch while this group or person employed by PHH Mortgage Services or someone on the side they hired, intercept my 2 complaints, take them and filter out all reference to the fraud I caught PHH in, and then let the complaints go through to the CFPB completely changed/altered. I come to find this is nothing new. They have been doing this sort of thing to homeowners for some time now. Hiring or employing hackers to come out to your residence to establish an access point ( no diff from when sign up for wifi and tech comes out to establish ) so that they can control your communication outflow, like they did here with my last complaints. They also capture and filter out any communication inflow you receive that could be detrimental to their goal of committing fraud and stealing homes undetected. What I caught PHH in is a Homeowner 's Insurance Kickback Fraud Scheme, but until now, my words have not been able to get out. So we are going to try this again. This time, I am at a public computer. Not at any one of my many phones they remoted into already and hacked where I can't get them to stay out. Not submitting this on my laptop either which you can see from the previous complaint I made back in XXXX of last year, it specifically addresses PHH being in my electronics and how I want them out. They are violating my civil rights by keeping me from seeking legal litigation against them. They stated they were not monitoring me. They lied and are still in there. I have to deal with this every single day. They also delete emails not just pertaining to fraud but anything that could help the fight against them to expose their fraud, such as getting a job. They keep you down in a hole and are purposely playing a heavy hand in bleeding you out. Getting a job goes aganist this very concept so you can rest assure they don't intend for you to obtain gainful employment. Now the last time I submitted complaints here to the CFPB, it not only got intercepted by PHH, but the complaints generated automatic responses from PHH and 2 other mortgage servicers. How can these mortgage servicers have it set up to automatically detect here on the CFPB website when a complaint is submitted on them? They should not be able to do that, yet they did. That's what worries me, especially when you consider I once already had a lawsuit filed in court on PHH, but they manipulated the situation to make it go away. Back then at that point I had only began to piece the whole fraud scheme they put me in together but as can read from attached, it still starts to show their fraud they are committing. I need to find out the truth though on why these mortgage servicers appear to have control here on this site where they shouldn't. So below is the same exact complaint, word for word, submitted back in XXXX, only this time I am at a public computer submitting it where they should not be able to intercept it before it gets there. Also, I am positing this very same complaint to social media and created an online version with a link that I can share and spread all around for all to see. In other words, there should no way what it is I say and make complaint about, get intercepted beforehand and changed at all. what comes out at the CFPB needs to match, word for word, what's posted elsewhere or we have a huge problem on our hands and not just the fraud I caught PHH in. Especially if more system generated responses get triggered once I submit this complaint as well. Also, I checked off to let this complaint get published on the CFPB website for all to see. I want to make sure that's understood as well. _____________________________________________________________________ In XX/XX/XXXX, PHH Mortgage Services committed fraud on me and staged a default that that would lead to an illegal foreclosure and auctioning off my house on XXXX XXXX XXXX. This was 100 % through no fault of my own. I had not missed any payments, was not late in payments once in the whole entire 10 years I had my mortgage, was not subprime, did not have a variable rate, bought a home within my means, even put 10 % of the note down when purchasing the home in XXXX. Apparently that wasn't good enough for PHH, so they took it upon themselves to stage a default of my home loan by fabricating a missed payment that they then converted to a fabricated escrow deficiency when running escrow analysis for the year on the same date as the statement date. They are basically using dual default dates in a method that has a staged default date in the back that can never get satisfied so always defaults the homeowner no matter what effort he puts in to fix or get his mortgage current, and a fabricated default date that the homeowner is led to believe is the default date and reason for him in foreclosure and his house going up for auction. Its all smoke and mirrors though and 100 % fraud that they have been using this to steal peoples homes and destroy their lived for over 10 years now from what I can trace from past examples in court proceedings, articles, blog entries by homeowners, etc. They just never realized it wasnt their fault and all due to fraud that they were losing their home. All the effort they were putting in researching about foreclosures, reaching out to others for advice, creating blogs to document what is happening to them as they go through it, trying effortlessly to hire a lawyer when it seems like none will take up your case, is basically all done for nothing. The fate of their home was pre determined the minute they got put into this scheme. Once in, the process can basically be considered automated at that point in that the staged default date in the back that cant be satisfied but the homeowner is unaware of as the problem to begin with, overrides everything. Pay to get current? It overrides and are still in foreclosure status. In a trial period of a loan modification? It overrides and is reason the trial period payments are misapplied. Do anything at all to save your home and you are wasting your time because it overrides, it overrides, it overrides. I went through the whole process and should know. The worst part is, as you can see from the attached evidence of NTS of auction on XXXX XXXX XXXX, PHH illegally stole my house and sold it at auction as if it was a legitimate foreclosure while I had to stand by and watch all the while knowing and screaming to others that it was fraud. They used a fabricated escrow deficiency that 100 % did not even exist in the 1st place as the basis to commit fraud and take my home. They broke federal law as you can see straight from my demolished Transunion report that they refuse to fix, every time they charged me {$1500.00} because this amount includes an additional {$460.00} of escrow charged to me in every charge that they did since XXXX XXXX on forward. And then colluded with my own bank, who has been caught doing this fraud before, XXXX XXXX XXXX, to overdraft and charge my account by this amount 13 times in XXXX of XXXX. I attached statement snapshots from XX/XX/XXXX when PHH did this XXXX overdraft as well as subsequent month statements when the overdraft was reversed and came back but was used as basis to strip my equity. PHH has my original default date in XXXX XXXXXXXX XXXX report is straight from pulling off their website. They have confirmed it is system generated meaning what's reported and shows on the XX/XX/XXXX report came straight from the system at PHH unaltered or changed. PHH 's own system shows me as satisfied or {$0.00} charged, {$0.00} paid, {$0.00} overdue, so therefore I'm green for the month on XXXX report. You know where I'm not green for this month? Over at PHH which has me as red for the month or delinquent and used this as basis to default me. This all really really happened to me. Why? This was all fabricated and PHH used a payment/escrow deficiency that never even existed in the 1st place to default me and auction off my home. I will be forwarding this to HUD homes, getting the attorney general involved, as well as the FBI, and my lawyer. They should not be able to do this and destroy the lives of homeowners let alone ones with XXXX. I have a hard enough time making it in the world without having to worry about my own mortgage company committing fraud on me and stealing my home for no reason of my own whatsoever. But thats what they did and thats what they are continuing to do to homeowners today.

Consumer Complaint: I, XXXX XXXX, mortgage holder of loan # XXXX with Phh Mortgage am filing an additional complaint to case # XXXX assigned by FTC. I had filed a previous complaint with above case # on Phh mortgage regarding why a re-issuance has not yet been sent to me of {$6200.00} which was from overage in escrow account when loan was paid in full the second time around. XX/XX/2021 i received a escrow account letter from Phh Mortgage showing the accounting of the escrow account which does not make sense to me why they are sending me this letter and not refund again which should still be available since the second payoff of loan is same. I tried to contact bank but was sent an e-mail by their attorney XXXX XXXX to cease and decease contact with the bank since the account has been paid in full. At this point my first complaint has not been addressed accordingly. This escrow letter sent to me by Phh Mortgage is not sufficient response. From the reading of the letter it appears the bank is trying to state there is all of a sudden no overage in escrow account as prior which is not adding up because there was an overage the first pay-off. I am once again requesting my refund be reissued of {$6200.00} and payoff letter and want reason why it has not yet been resent.

Consumer Complaint: I contacted PHH Mortgage on XXXX informing them about acc number change for my automatic payment withdrawal.. Gave all information of new account number including account number and routing number .. Fully knowing it would take a while to input new information into their system I NEVER ever told the employee not to withdraw XXXX s payment from old account .. Someone at that bank made that decision for me .. When I noticed payment was not withdrawn I contacted them wanting to know who made that decision for me .. They are looking into that but I did not still receive an answer two months later.. That decision sent my account into downhill spiral.. They are instead of providing me an answer sending me a bill for XXXX XXXX late charges and threatening to report me to credit rating company.. I have since send in 3 payments one of which they deposited on XX/XX/21 ... I wrote to them ... called them numerous times .. as they are still working on it .. Only response from them is late charge and threatening.. I do hope you can help me ..and thank you in advance.
