Consumer Complaint: I satisfied two mortgages ( see attached letter ) in XXXX, XXXX to form a single line of credit with PHH Mortgage ( or someone on its behalf ). The consolidated mortgages ' satisfaction was improperly drafted/defective, and recorded in this manner. Upon my attempt to sell this property, I have been unable to fully clear title and {$27000.00} of sale funds are being held in escrow and not made available to me. My attorneys : XXXX, XXXX XXXX XXXX XXXX XXXX reached out to PHH Mortgage Services Corp. on XX/XX/XXXX. Since this date, they have faxed, re-faxed, and followed up by phone numerous times ( see additional, attached documentation ) to request the satisfaction be corrected. Now, a month following closing on the property, my attorneys still have not received the corrected mortgages satisfaction. PHH Mortgage initially responded to my attorneys ' calls and provided updates, but now, for over two weeks, no response and no corrected document, as promised. Please assist me, and see attached, additional information.

Consumer Complaint: In XXXX I took out a 2nd mortgage, ( GMAC ), for {$71000.00}. In XXXX They sold the loan to XXXX XXXX XXXX XXXX XXXX ( sold and closed ). In XXXX of XXXX I became delinquent, due to loosing my job. In XXXX of XXXX SLS charged off the loan, after telling me they were going to foreclose. They could not foreclose, because GMAC didn't assign the deed of trust to them. They turned the debt over the their collections dept, XXXX XXXX XXXX. In XXXX XXXX XXXX XXXX sold the debt to XXXX XXXX XXXX. In XXXX of XXXX XXXX assigned the deed of trust to XXXX XXXX XXXX, even though they did not own the loan, because they sold it. In XXXX of XXXX XXXX substituted trustee to a law firm, who filed a note of default. They placed my home on a foreclosure websight for {$71000.00}, and for a fee they can get my address and drive by. I think it's illegal for the original loan agency to sell the assignment of deed of trust, 12 years after they have sold the loan. I admit I owe the money, but they don't have the right to my home of 30 years, since they obtained the deed of trust from someone who had already sold the loan. Legally they have a right to attempt to collect a debt NOT secured by my home. I want to keep my home.

Issue: Trouble during payment process

Consumer Complaint: In XXXX of XXXX I was on a modification and I unsuccessfully was able to pay online I called and never received a phone call because all companies at that time were shutting down and scrambling to put people in place to work from home, so I was cheated out of my first modification and had to reapply. I reapplied and was approved for a new modification that was substantially higher and supposed to start in XXXX but because I was unable to secure my unemployment benefits I was given a 90 day extension which made my start date XX/XX/XXXX. I was told it would be the three payments they same as any other XXXX, XXXX, and XXXX so I started making payments, they call would call me twice a month and at no time was I told that I would be required to make two payments in XXXX Until I called in on XX/XX/XXXX to make my last modification payment and was told that I had to mail the last payment in and that I was to wait until I received the final modification papers, which was odd because I always pay over the phone. I was told I couldn't pay online until the modification was complete but that they wouldn't except it over the phone, then I was told that they sent me a letter in XXXX of XXXX. Someone shows up last wk said the lender sent them because it was reported the house was unoccupied, how ironic. Friday the XXXX I received a phone call from a representative who informed me that they had cancelled the modification for none payment and that I would have to reapplying and that they had no other information for me. Saturday XX/XX/XXXX I received a statement saying that they were requiring a payment in the amount of XXXX towards my loan. This is the second time they have done this to me, I have suffered the loss of a job, I have been sick with the virus and Im still struggling financially but I have managed to make the payments, PHH which is formally Ocwen has really been unprofessional and unresponsive when needing assistance, Im asking for assistance in this matter because this seems to be the way they cheat people out of there somewhat reasonable payments, then they take forever to respond and when they do you owe all this money because you haven't paid waiting on a response from them. Times are hard and people are struggling and im one of those people. If they take my house I will have no place to go, I know that Mortgage companies along with other business have received grants and other forms of monetary assistance in a effort to help people stay in there homes. I also know that all calls are supposed to be recorded for quality assurance and Im asking just that to pull the recordings as proof that know one mentioned anything about double payments. Your assistance would be greatly appreciated, I have been in this house for over 20 years and would hate to loose it because of miscommunication and unprofessionalism. Also the late fees and price gouging is terrible. Thank you XXXX XXXX XXXX

Consumer Complaint: I had loan modification done about 10 years ago with Ocwen/PHH. The loan modification which was supposed to account for the equity already built in from my previous lender was never accounted for in my new loan, and my daughter is just now bringing it to my attention. Ocwen/PHH instead is attempting to say that I still owe the entire original purchase principal, which will become due at the end of my mortgage as a balloon payment. I originally purchased the house for {$150000.00} in 1998, and yet to this day they say I still owe {$150000.00} dollars on my mortgage. My interest rate is at 3.5 % ... .and yet I was told that my mortgage payments over the past decade have been going to pay the home insurance they picked. Out of the {$1200.00} month payments I pay only {$75.00} go towards the mortgage .... This would have continued going unnoticed if my daughter had not flagged the fact that my mortgage balance on my credit report never changes and reflects that I have paid 0 % of the balance. Ive lived in and paid my mortgage for this home since 1998. I have never borrowed against my equity. This is fraudulent misconduct, and this company in no way shape or form is interested in fixing the problem unless they are forced to through legal action. I will have to find an attorney to help me with this. I would warn anyone to not take a mortgage with this company. All their customer support is based in XXXX, which adds to the feeling that this company has no interest in providing quality customer service. I highly recommend that this company be audited. Anyway with all the issues going on with Covid, I fell behind and my lenders were kind enough to give me a forebearance but they were legally suppose to because of monies they received from the government. They are not allowing me to get a deferment and have been denied that to put the past due at the end. They say the protection s will last untilXX/XX/2021 but I want this resolved now pls help us!!

Its a week later and we still have not gotten it. We called and they basically said it would take as long as they wanted and they didn't care who was waiting for it. PHH is holding up being able to close this transaction due to their refusal to provide a payoff demand in a timely manner!!!! This is NOT acceptable!!!!!!!!!!! -- -- -- When is the Federal government going to put a stop to this????

Consumer Complaint: In the last 8 years we have tried to get help with OCWEN and now PHH. Always denied, so we filed Bankruptcy but constantly having to refile due to them refusing to help. We paid in through Bankruptcy and brought down outstanding balance to {$290000.00}. But in reduced payments by bankruptcy, we owed XXXX, but they increased the amount due to {$210000.00} making it over XXXX owed. I have tried to talk to them and file to reduce the XXXX interest rate. I have sent them letters to take back fees and payments off so we can get a mortgage. They assessed over XXXX in expenses and payments when PHH took over last year. I begged them to help due to my husband XXXX of XXXX. He died last year in XXXX. He had a lot of health issues in the last eight years that put us so behind and because of medical bills we had to file bankruptcy. And this is the second time I filed bankruptcy to try to save the house. I am a XXXX veteran sr. Citizen and having a time understanding why these people can not help me. The amount that they want every month is way too much. They want me to pay $ XXXX monthly for a mortgage payment. I just need help trying to save my house. Thank you very much.

In the previous year of 2020 my mortgage payments were reporting late on my credit report, negatively affecting my credit and lowering my score. The credit bureaus are operating out of compliance. Due to the fact stated in the Consumer Financial Billing Act. I should be contacted before anything is placed on my credit report that has the potential to adversely affect my report. Also, I'm given A certain amount of days to respond to offer an explanation. In this case I was never called, emailed or received A letter. Thank you

Consumer Complaint: I received a mortgage statement from XXXX XXXX d/b/a PHH showing a fee of {$550.00} was due. In XX/XX/XXXX I paid {$650.00} for attorney fees ; I was told by PHH Rep the payment went into a suspense account. Each mortgage statement requested a payment of the fee of {$550.00}. In XX/XX/XXXX, I paid the fee again, this time writing on my check specifically the payment intent to pay attorney fees. The check was cashed. In XX/XX/XXXX, my statement still showed a line item that I owed {$550.00} ( fees ) and requested that I was due to pay {$1800.00} ; although it included my current mortgage amount of {$1200.00}. In XX/XX/XXXX, I contacted PHH and was told the fee was credited to the suspense account and a reversal was being sought to apply the payment accurately. The resolve will correct the mortgage statement. This went on for an additional 5 months ; statements from the mortgage company requesting I pay {$1800.00} including a {$550.00} fee and my current mortgage amount of {$1200.00} although I was told the issue had been corrected. Also in XX/XX/XXXX, I received a letter from XXXX XXXX/PHH stating as of XX/XX/XXXX the funds ( {$550.00} ) were applied to the fees, and the mortgage statement would be corrected beginning XX/XX/XXXX. In XX/XX/XXXX, I contacted PHH 's escalation department without resolve. The mortgage statement still representing a payment of {$550.00} was due to XXXX XXXX/PHH. To date, each month I receive a mortgage statement requesting an additional {$550.00} for fees that I have paid twice already. The mortgage statement each month is inaccurate and I have exhausted any possible remedy within PHH. Hence, my complaint..

Consumer Complaint: PHH Mortgage is refusing to speak to heirs of estate that are listed on title. Note holder died in 2013 and PHH has consistently refused to speak to heirs of the estate specifically note holders wife who is listed on title on signed the original mortgage against the property. After multiple phone calls company is still denying the right to speak about the account stating that the heirs are not authorized to speak on behalf of the deceased. We spoke to the attorney who is representing PHH Mortgage in Hawaii suing the estate and attempting to foreclose on the property but that communication has also resulting in no progress of preventing the foreclosure from proceeding against the property. I've ask the PHH representatives to explain what regulation X states and how as heirs of the estate we are not allowed to speak about the mortgage because we are not the deceased who signed the original note.
