Consumer Complaint: I originally had 2 mortgages on my home, under Option One. both were sold to Ocwen, while with Ocwen I did a modification. which consolidated them into one mortgage. Now I am with XXXX XXXX XXXX XXXX XXXX I am trying to refinance with XXXX XXXX XXXX, I can not do so because Ocwen still has a lend on the title for the second Mortgage. Each time when I call, they tell me they can see where it was modified into one, but they have the paperwork for clear tile. and this was all done in XXXX So now they are telling that it appears that the second Mortgage is still with Option One. I have been trying to clear the title along with the refinance company for over 2 months now without any progress. The bottom line is Ocwen is the mortgage is listed on the title with the lien.

As a result of this action, I was exposed to a trustee sale. It is a natural consequence of this failure to disclose the promissory note that I could lose my property interest. See : Truth in Lending Act ( TILA ), 15 USC. Sec 1601 et seq. The Real Estate Settlement Procedures Act ( RESPA ), 12 USC sec 2601 et seq. & the Home Ownership Equity Protection Act ( HOEPA ) 15 sec 1639 et seq. Between XX/XX/XXXX and XX/XX/XXXX the promissory note was assigned to HomEq Financial Network. Despite the alleged reassignment of the promissory note, I never received notification of the transfer and neither HomEq, XXXX XXXX nor XXXX XXXX Company can claim interest in the subject property. Consumer Complaint: I previously filed a complaint against PHH Mortgage pertaining to the fees on my account that never should have been on my account from the beginning because my home was not in foreclosure in XXXX. The company finally admitted that they lost my check. They sate, " our cashiering department has removed all foreclosure fees and expenses assessed during XX/XX/XXXX through XX/XX/XXXX... you are not responsible for paying '' they removed {$2200.00} in fees but state that the remaining miscellaneous fees of {$3100.00} are valid. I dispute the validity of these fees and I have noticed that they are also inaccurate because each month that I get my mortgage statement, the fees are showing as {$13000.00}!!!!! Past unpaid amount of {$8800.00} Assessed Expences {$3300.00}. These amounts are preposperous, and ever since this company has taken over my account they have been trying to defraud me in one way or another. I demand to have these fees removed! I need to refinance my house from a really bad modification during the XXXX XXXX and i can't do anything with these unsubstantiated amounts of monies claimed to be owed. I would like to know where these fees came from when the end of my last complaint, the company claimed that I owed about XXXX. This is causing me a great deal of stress and I can not communicate with this company. In fact, the most information that I ever had was when i filed a complaint.

The total amount that was owed on the statement XX/XX/XXXX was {$12000.00}. That was including all fees and expenses. The XXXX paid XXXX XXXX a total on {$14000.00}! That means they charged the XXXX an extra {$1500.00}!!! Ok fast forward to XXXX of XXXX, the monthly mortgage amount was {$380.00}, which I paid. I got the statement for XX/XX/XXXX and there was an amount of {$1200.00} in the category of assessed expenses, and additionally the regular monthly payment amount increased from XXXX $ to {$410.00}!!! There was no explanation anywhere on the statement as to the reason for either that assessed expense of {$1200.00}, or the increase of {$29.00} on the regular monthly payment amount! I called the company IMMEDIATELY to complain and they tried to tell me that was probably legal fees, and that can be paid over time. The mortgage is in my mothers name ( XXXX XXXX XXXX, deceased XX/XX/XXXX ) and this company has been an absolute nightmare to deal with and I really need help to get this matter straightened out! They are absolute XXXX! These charges are not valid and neither is their increase of my mortgage payment!!! Please help me!!! Thank you

Consumer Complaint: My very first payment to PHH Mortgage for XXXX 's payment was sent to them on XX/XX/2023. The payment was applied as a principal only payment instead of a regular payment with the surplus applied as a principal payment of ( {$54.00} ). I emailed this mistake, then called and spoke with a male rep who fixed the payment and assured it would not happen again. This same issue happened for XXXX 's payment, which was cashed on XX/XX/2023, but was applied again as a principal only payment. I then began receiving letters and statements toward the XXXX of each month, with false balance reportings and late fees. In XX/XX/2023, I again received a false statement, this time I emailed them a copy of the statment along with my bank info showing the payment made prior the XXXX, so the statements should not reflect that I'm past due, when I was not. I informed if this isn't rectified, I would be filing a fedeeral complaint. And it happened again in XXXX and XX/XX/2023. I am being financially harrassed and my credit is receiving false reportings from this company and it needs to stop.

Consumer Complaint: Situation : Our Florida Townhouse ( XXXX ) was put on sale in XXXX, so we could be with Family in XXXX, they didn't want us living in XXXX alone after my husband XXXX 's sudden passing away on XX/XX/2023. Lot of potential clients for XXXX kept asking if mortgage is assumable. Thus, I called my PHH mortgage. They said they will review and communicate back in writing. XX/XX/XXXX, XXXX weeks later, they sent a letter saying yes it is assumable based on .... see attached letter. I was pleased to hear assumable mortgage. In light of interest rates being so high, it eased the possibility to secure a sale. It had no mention of blood relatives, cousin, friend, family stranger etc..as long as financial obligations were met for party that wanted to assume the mortgage. We had family friends come in to buy, they went in escrow for XXXX. Purchase price XXXX. My mortgage owed is XXXX for 2.6 % for XXXX yrs. They got appraisal and home inspection all went OK. Financially strong family. On XX/XX/XXXX, we got on phone with new buyers and our real estate agent and spoke for an hour on phone that we want an application sent to us so paper work for assumable mortgage can begin. Teleconference all went ok. On XX/XX/XXXX, they sent a letter saying mortgage is NOT Assumable. Which shocked all of us for them to go back on XXXX letter that said mortgage is assumable. Last 3 days have been on multiple phone calls with PHH about it. They agree their letter was misleading. But as they are mortgage servicer and mortgage provider is XXXX XXXX and XXXX XXXX is saying it is not assumable. I said their assumable department review made a mistake. From the very begining should have not told me it's assumable. I would be ok with that. As very rarely they are. They led me down the wrong path. A rabbit hole, promising path. I could be sued for wrong false advertisement by clients advertising my property as assumable mortgages. As my agent went around saying it's assumable and said that in good faith. PHH has been misleading confusing to us now. The sellers were in for the deal as it was assumable. The sellers have backed out on sale now. So after all these months the sale is lost. Got to know this loss of sale today. House has been put on sale again today. Interest rates are worse. Property in good location. Thus still challenging. PHH erroneous stance and misleading wrongly issued letter has costed me the sale. Caused stress to the agent, to the buyers, to me at my time of grief I have this undue stress from PHH. I have repeatedly asked them to honor their first letter as they sent the assumable letter or I will seek legal recourse. And that is where we are at, they say they cant honor their first letter. Please review XXXX letter saying it is assumable. And XXXX letter it is not assumable. I am serous about pursuing legal actions. They keep saying sorry for the mistake but they can't honor their first letter approving it to be an assumable mortgage. Please let me know your thoughts. Thank you. XXXX
