Consumer Complaint: How is it fair business practice for a business to prolong an application process for their own financial gain and the consumer has no recourse? For the past four years I have been in the loan modification process with PHH Mortgage only to be forced into foreclosure or bankruptcy. During the past four years I have submitted every document requested ( approx 120-140 documents ) by PHH Mortgage during the loan modification process, all while being reassured by representatives that as long as the documents requested were submitted the loan would be reinstated. Only to be denied twice for reasons already known at the start of the loan modification process. Also, told by a representative that " We are not in the business of providing loan modifications '', but then told to resubmit a loan modification application for review. During this process I have incurred an additional {$25000.00} in fees/interest. I would understand if I did not submit the documents requested or cooperated with this process but I provided all documents requested in a timely manner. PHH Mortgage 's actions during this process was only for their financial gain with no intent of approving the loan modification. As a result of PHH mortgage prolonging this loan modification process, I can not secure a loan from any lender in order to satisfy the original loan that PHH Mortgage holds the note for. Which I believe was PHH Mortgage 's intentions in order to force me into foreclosure. Not only was i told by a representative that " We are not in the business of providing loan modifications '', the same representative also stated " He has enough equity in his hose why should we negotiate with him ''. How is that fair to me as the consumer who is trying everything possible to rectify this situation?

We applied for mortgage assistance last year and was granted a trial modification without any supporting information. After requesting not receiving supporting information PHH set an appointment for us to discuss the details with our escalations manager XXXX XXXX XXXX, which we were told upon scheduling the meeting XXXX would provide. We were left without the information we needed to move forward and we are still trying to receive the missing information. Although we scheduled time with XXXX she was not available and the representative that called instead of XXXX had absolutely no information to share with us. We have been fighting to maintain our property, we have carefully submitted the information requested by PHH in a timely manner. My hardship started during the banking collapse in XXXX I have struggled to gain adequate employment. My employment difficulties has place a huge burden on me and my family. I have secured my insurance license and agency with earn potential to meet my obligations as I once did prior to my misfortune. In closing, we are asking for mortgage assistance however that looks, after reading options from PHH we are 100 percent positive that given an opportunity we can meet our responsibilities moving forward, creating a winning solution for both parties. Consumer Complaint: Made timely payments. But PHH held onto payments each month after giving me a conformation number saying it was paid on the phone. Each month I pay by phone and the prompts never said anything about missed payments. Now I have negative reporting and must wait 2 yrs to refinance. When the problem was first discovered in XXXX, I went to my bank and wired the entire amount do as told to us by the manager handling my case. {$15000.00} XX/XX/XXXX. Everything owed. {$3700.00} XX/XX/XXXX, {$3700.00}. XX/XX/XXXX. Now I have a statement saying I owe {$10000.00} for XX/XX/XXXX. How? The {$15000.00} paid was supposed to have included XXXX 's payment. My XXXX and outer was me paying early, I thought. Also, when I pay by phone, it never let 's me in and I ha e to get assistance to be put in the system. The phone system never tells of any back pays owed.

Consumer Complaint: I reached out to PHH mortgage on multiple occasions since XXXX to have them correct an error in reporting late payments. I sent them copies of my credit reports and asked them to remove them. In there own response they said that 2 of the payments were during an agreed upon payment plan ( during COVID ) So not late. And the 3rd payment was when the account was in deferment during COVID. Again this would mean NOT LATE. When I talked to their reps during this time they assured me these agreements would have no negative impact. They lied! This account is now paid in full and reflects differently on every single report. XXXX shows correctly where there was no negative impact as they promised. XXXX shows 60 days late on all 3 payments and XXXX shows 30 days late on all 3 payments. If you look at the rest of my report I do not have a single late payment anywhere else. EVER. I would like this corrected.

Consumer Complaint: My parents have been paying for a fraudulent loan. Basically the house was paid off and then electronically sold. They are just the kind of folks who pay the bills as they come in. The house went default last year in XXXX through the XXXX XXXX PHH mortgage. After getting added to the loan as an authorized user, I was able to identify that payment were skipped. Im so even though subsequent payments were made skipped payments went XXXX XXXX default and subsequently the house was elected for sale. I was able to identify the one skipped payment and so after getting a quote for reinstatement and before wiring the money, the one skipped was addressed by our family, riding a check for that amount of the one payment, then in the for box of the check in that exact payment. They cashed that check before the wire was accepted so reinstatement of the house happened in XX/XX/XXXX or so of XXXX and it was done in the form of a rescission filed with the county so after saving the house, I intimately researched this loan, and I discovered all of it is illegal down to XXXX XXXX being alone, taking out my fathers initials, not even his name, and XXXX XXXX XXXX, which is a first mortgage company being the payment instrument in the form of a check recipient after studying the principal owners of the XXXX XXXX XXXX XXXX, which received a payment instrument of this mortgage I discovered that the principal owners were convicted of fraud at a later date are not convicted, but settled Fraud allegations at a later date with the SEC. The loan was apparently taken out in XXXX, but Ive discovered it all to be fraud so much that Ive also found a class action lawsuit on the matter. PHH giving out foreclosure notices illegally and basically they skipped a payment. Intentionally did an app apply one month so that the house would intentionally go into default so that they can dispose of the evidence of a fraud.

Consumer Complaint: I am on a repayment plan agreement and the company ( XXXXNewrez mortgage XXXX ) continues to report my account as negative to the credit bureau even though I have complied with the terms. When the company offered me the repayment plan after coming off of a special program that I qualified for due to XXXX, they reported my credit as 120 days late even though I complied with the terms and is continuing to report my credit as 30 days late each month even though I continue to comply with the terms of the signed agreement. This deceptive practice was not explained to me before I entered this agreement. Why would you say that youre trying to help me when youre trying to ruin me at the same time.
