Issue: Dealing with my lender or servicer
Subissue: Don't agree with fees charged
Consumer Complaint: I am filling a complaint about my private student loan. Not because of what the lender, XXXX did, but what the loan servicer, Firstmark Services, did not do. I am in such mental distress because of what they failed to do. A simple case of managing my private student loan is about to spiral uncontrollably and make it, even, extremely difficult for me to manage the minimum payment. I have XXXX separate student loans. XXXX is manage by Nelnet Inc., and the other is own by XXXX, which is service by Firstmark Services. With Nelnet, I have a fixed monthly payment. I make my payment regardless because I know how much to pay, unlike Firstmark Services, which does not send me a fixed monthly amount. Without the billing statement, I would n't be able to determine how much is due monthly. Firstmark Services claims I had called to change my mailing address, which I have never done. The same address they claim, I had called to change is the same address the debt collector used to communicate with me. I called XXXX ( loan owner ) to explain the circumstances surrounding the fact that Firstmark Services never sent me any billing statement after XX/XX/XXXX. They agreed to put the loan back to its previous status from the collection agency if I pay the amount of {$3000.00} to bring my account current. The monthly payment was averaging about {$130.00}. However, this is three times over how much I was supposed to pay since XX/XX/XXXX. This amount is almost about half of my gross up to date annual income. All for a mistake originated by Firstmark Services, which was not my fault. There are a couple of reasons why I did not send a check to Firstmark Services when I did not receive the billing statement : 1 ). I did not know how much to pay, since the monthly payment varied. 2 ). When XXXX transferred my loan to Firstmark services, there was a gap in receiving monthly statement. I did not receive my monthly statement for a while. So I thought the loan was being reshuffled to another servicer. When I called Firstmark Services as to why my loan had been sent to a collection agency, I was told I had defaulted on my loan and that I had called sometime in XX/XX/XXXX to change my address, which I never did. In fact, I will like to get a record of this specific call. I will also like Firstmark Services to provide any evidence of any return mail or any form of communication they initiated with me. The truth is that Firstmark Services never sent me any billing statement in the mail after XX/XX/XXXX which was the last payment sent or even a second warning mail. I want Firstmark to be held accountable for its inefficiencies. I also will like to bring attention to the fact that sometimes, the billing statement was received well after the payment due date. Even if I was having problems making the minimum payment, I do have a deferment period for this loan. So why would I intentionally remain passive and allowed my loan to be defaulted when I had all this at my disposal. I took the loan and I am wholly responsible for it repayment. I will honor my part of the deal even if it takes me my entire life. But I can not let external circumstance XXXX me as to how I pay back the loan. Please, I would like your agency to fairly intervene. As this may negatively impact my ability to fund future educational goals. In fact, I have worked very hard to avoid payment inconsistencies as my other loan with Nelnet ( Federal Loan ) shows. Thank you very much in advance for your time.

Consumer Complaint: I have spent 3 years getting XXXX excuse after another as to why my forgiveness has not been granted. I was told paper work had a problem, it takes a while to process, keep asking for deferment, it is forgiven but takes a few weeks to show. Now they have XXXX other social security numbers attached to my name and said I was denied in XXXX which was news to me. If they do n't know who I am why can they talk to me and if my loan was denied why am I getting to defer my payments still. I learned this XXXX XXXX XXXX. I am afraid if I reapply this will start all over and they will drag it on again saying it is a new application

Consumer Complaint: I was a student at XXXX XXXX in XXXX, Montana. During my time there I was enrolled in a special program called XXXX. The college, without warning, dropped the degree field overnight not allowing students to finish. The degree was not transferable. There is no means to my knowledge to have my loans relinquished which is of very poor taste. Please HELP!!

Consumer Complaint: When I was on a XXXX XXXX, I was on XXXX but not paid for XXXX months. I contacted whichever company was handling my student loan at that time ( I do n't know for sure that it was FirstMark as my student loan is continually sold to other companies ). I let them know that I was on unpaid leave and asked if they had any options to place my account in a deferred payment status or any options for someone that did not have income. At that time, my account was in good standing. The representative stated they did not have any options for someone with no income. She said I either have to pay it or it would go to collections. I asked again, what options they have for people with no income, as my account is in good standing. She said you either pay it or it goes to collections. This is negatively affecting my credit and has negatively affected my ability to gain employment. I would like this item removed from my credit report and the balance forgiven for my XXXX experienced from the negative reporting.

Consumer Complaint: I have asked three times for my loan payment option to be switched to the revised income based plan. They have told me every time that it will go into effect the next month but it never changes. I have all of the messages saved. This month the payment was even higher. It jumped to {$270.00}! I ca n't afford for them to keep doing this to me. If it is n't lowered like iced asked multiple times I am going to have to defiant on my loans and I do n't want to do that.

Consumer Complaint: In XXXX 2011 I requested a deferment of my loans due to being diagnosed with XXXX and not being able to make payments. The deferment was granted, but I made a mistake on paperwork which resulted in delinquencies being reported. When I realized this, I contacted Nelnet. Nelnet agreed that the months reported as late would be corrected and my deferment would be retroactive. I recently learned that this never happened. I filed a dispute with the credit agencies, but the dispute was denied by Nelnet.

Consumer Complaint: Make payments above minimum, supposed to apply to principal, as I write on the stub every time. Nelnet does not apply extra to principal and simply extends the due date.

Consumer Complaint: We 've had this loan for a while now and in it 's simplest terms the amount applied to the principal versus the amount to interest is silly. Out of XXXX applied in may 2016 applied to interest is XXXX and XXXX applied to principal and it 's been this way for the entire loan process and we are having a difficult time repaying the loan back at that mthly amount. We tried to get it lowered they say we make too much money which is a silly comment at best. This whole loan with Nelnet seems like it should be illegal.
