Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I have disputed this item with the credit reporting agency and they reported confirmed the account as valid. In a good faith effort to resolve the matter amicably, I demanded proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of the authority in this matter. They have failed to comply with investigations.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: The Department of Education/NELNET is showing that I have 6 late payments, not sure why it's showing that I have 6 late payments when I am in a repayment plan. I've called the Department of Education/NELNET and asked them about this issue and was told that they did not see any late payments that my loan was showing current. Please remove this immediately because it is causing negative marks on my credit report.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Was not notified of investigation status or results

Consumer Complaint: There is no way that these companies investigated this student loan. The same information continues to report on my credit. I honestly don't believe I was late and I don't agree with the total balance that they are reporting on my credit. It continues to report several inaccuracies among the 3 credit reporting agencies from the last student loan company. How is that possible? For example, Each bureau reports that I was late on a different date Also, Hows it possible that youve reported me 90 days late with no late payments prior to that?

Consumer Complaint: Nelnet representatives told me that because the delinquent payments were accurately reported inXX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX, that any subsequently initiated deferments would not allow for Nelnet to update reports to CRAs to show that the payments were not late and actually in deferment. However, Section 623 ( a ) ( 2 ) clearly shows that the reports must be updated/corrected regardless of whether they were accurate at one point. *

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: Hello my name is XXXX XXXX and in the past 5 years, I have been diagnosed with XXXX , had XXXX major XXXX, XXXX XXXX XXXX, a broken XXXX and endless physical therapy. I got in touch with my student loan lender Nelnet to have my loans forgiven seeing I can't complete the degree I was going for. This started on XX/XX/2018. I was assured by a representative named XXXX that this request was being taken care of since my XXXX dr. had sent in my XXXX paperwork to them and I'm on permanent XXXX. I called to see why the loans were still on my credit report and was told by a smart elic, XXXX that my loans were not in discharge status and I had to reapply. If this was so important then why are my loans just sitting in the forgiveness department not being noticed? I am tired of dealing with this bureaucrat system and want this taken care of as soon as possible. XXXX XXXX XXXX

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: Firstmark services are currently handling my private student loans from XXXX. I recently became concerned with their service when they began requesting payment while I was still attending XXXX school. Based on XXXX XXXX policy, All payments are deferred while in school. Firstmark claimed there was a time limit regarding deferment but could not provide a written document supporting this. It was clear that this policy could not be substantiated. XX/XX/2020, I requested to have my promissory notes from all three loans currently being handled by Firstmark services in order to verify if the deferment policy was listed on my signed documents. I only received two documents and was told that one was a mastery note ( that regarded three loan pay outs ) and the other was for only one. However, later I was informed in a phone call ( XX/XX/2020 ) that three promissory notes existed and would be sent immediately. This would prove to be false and I was sent only the two promissory notes again. Upon reviewing the notes, I found that I had checked a box that stated 'MAKE NO PAYMENT WHILE IN SCHOOL '. Also, I saw that there was a discrepancy between loan amounts on promissory note and what was being charged by XXXX based on Firstmark 's records. I believe I have been charged for an amount that I did not fully receive and therefore also charged interest based on a wrong principle amount ( original loan balance ). I will be attaching both promissory notes that I have a received and letter from Firstmark that shows what principle ( or what should be original loan amount ) and interest they have on file.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I attended XXXX which turned into XXXX XXXX college while I was attending. The school ended up getting shut down permanently I did attach the proper paper work needed to nelnet and proof of the schooling closing without my knowledge. I did graduate but the school shut down due to lack of accreditation which I was lied to about. When I tried to take my credits else where to other states they told me I was not accredited. When I tried to renew my licenses and take continuing education classes at the school they were shut down. My license is no longer valid and I am not accredited I did let my student loan lender know this submitted the proper papers and its been well over a year I have not heard anything back. Legal stand point states when a school is closed for reasons like this student loan is dismissed .when I graduated my certificate stated I graduated from XXXX XXXX college and so doesnt all my transcripts. Student loan lender has been giving more then enough time to respond & has yet to do so. They continue to just keep pushing things back on payments instead of investigating well over a year is unacceptable. Yeah

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I have federal student loans that started with Nelnet, changed to XXXX XXXX, then went back to Nelnet. During this time, I went into automatic forbearance starting XX/XX/XXXX when I filed for bankruptcy. During this time, my loan was to stay in forbearance even if I made payments. However, I was placed in and out of forbearance ( moved from forbearance status to " in repayment '' status at various times during this period ) ; thus causing interest to accrue and/or capitalize unfairly. Additionally, there are misreported unknown forbearances over time leading to outstanding interest that is not adding up. Something has been misreported and I would like this to be investigated further. When I asked about my exorbitant amount of interest and capitalized interest back in XXXX, Nelnet did not have any explanation. Once I pulled the attached document and had an expert review it, discrepancies were found as noted in the previous sentence. Please see the attachment showing payment history and disbursement form XXXX. Any assistance is greatly appreciated.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I got a phone call from a 3rd party Debt consolidation repayment company. They said they needed to consolidate my loans bc I work for a nonprofit business now and set up for a income based repayment plan and said my current servicer Nelnet, could not consolidate them for this purpose. I saw that my password was changed from student loans, but I have not heard and from them and it has been a week. I first spoke to a female on XXXX that evening is when I got an email from the Dept of Ed that my password changed and I had not done that. I am not getting an answer to know if my loans were indeed consolidated or not. If they were not, then I know this call was a scam and my personal information has been compromised.
