Consumer Complaint: On XX/XX/XXXX I mailed a certified letter to Navy Federal Credit Union. The letter explained the inaccurate reporting of XXXX accounts on my consumer report. According to my consumer reports from XXXX, XXXX and XXXX XXXX credit card accounts and one unsecured account was charged off ( XXXX, XXXX, and XX/XX/XXXX ). The IRS clearly defines a charge off as gross or ordinary income. According to IRS Publication 4681 a charge off or canceled debt must be reported as gross income on your tax return. The lender must file Form 1099-C and send the consumer a copy if the amount of debt canceled is {$600.00} or more and the lender is a financial institution, credit union , federal government agency or other applicable entity. I never received my copy of Form 1099-C for the three charged off accounts. Navy Federal is in violation of 15 USC 1681 s-2. I requested my copy of Form 1099-C and the deletion of the accounts from my consumer reports. Navy Federal Credit Union responded with a letter dated XX/XX/XXXX stating the information is being accurately reported to the consumer reporting agencies. Income does not get reported on consumer reports which in fact makes the reporting of these accounts inaccurate. By definition, the IRS clearly says a canceled debt or charge off is income. The reporting of these accounts as a debt is inaccurate.

As a result of this action any use of the application/ promissory note of value or SSN Estate and Trust to retrieve funds, credits, tender or FRNs other than to extend credit to the principal named would be considered securities fraud pursuant to the Security Exchange Commission rules and regulations and NFCU Indentured Agreement. This is also a violation of the Equal Credit Opportunity Act and Consumer Credit Protection Act. I would like to expressly withdraw my application immediately pursuant to the Consumer Financial Protection Bureau 1002.9 as Im aware that the application is a secured collateral of value.

Under 15 USC 1681 Section 602 states I have the right to privacy. 15 USC 1681 Section 604A Section 2 it also states a consumer reporting agency can not furnish an account without my written instructions. Under 15 USC 1666B a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose.

According to 15 USC 1666b it is a billing error I did not receive a statement 21 days before the late payment error. If finance charge included, there should be no late payments pursuant 15 USC 1605 ( a ) due to finance charge bring sum of all charges so I can not be penalized for something that is already paid in full.

On XXXX XXXX XXXX XXXX XXXX via telephone call with Navy Federal Credit Union fraud services XXXX XXXX XXXX a stop payment was requested in accordance with 4-403 CUSTOMERs RIGHT TO STOP PAYMNET ; BURDEN OF PROOF OF LOSS For the second time, Navy Federal Credit Union was made aware of several unauthorized fraudulent transactions and a stop payment was requested. These transactions consisted of the following at minimum transactions : -An unauthorized account was added for the purpose of internal transfers according to the fraud department representatives. - {$2400.00} dollars was removed from primary checking account ending in XXXX, and pending transfer to said unauthorized member to member account. - {$500.00} dollars was removed from my secondary account, ending in XXXX, and pending transfer to said unauthorized member to member account. -Several Cash advances were requested from my account credit cards with pending cash transfers to said unauthorized member to member accounts, XXXX XXXX XXXX XXXX XXXX XXXX XXXX On XXXX XXXX XXXX XXXX XXXX A report was filed with FDLE to document fraudulent charges. I was informed by the representative that the issue was under investigation. I spoke with XXXX, who gave me a form to fill out and printed all my statements from the last month for my accounts. She informed me that she would put in an urgent request for my money to be returned, but that it could take several months.

Consumer Complaint: On XXXX XXXX, I applied for a Navy Federal Checkings and Savings account and was immediately approved. A few days later, my account was flagged due to a XXXX XXXX XXXX report. Since then, I have filed the necessary disputes with XXXX XXXX XXXX and had the fraudulent activities removed. Navy Federal refuses to remove the lock on my account or take the new XXXX XXXX XXXX report seriously. Every time I call, I get told that I have to be transferred to the Security Department and the wait time is " over 3 hours '', that's insane! I've even called first thing in the morning and they still have me on hold for over two hours. I just want to be able to use my account. I think it's unfair that I was a victim of Identity Theft and have to be treated so horribly. I even believe that because of this, I am not approved for any other amazing products that they offer. Please have them correct this.
