Company does not have option online to update name information where there is an error on display. Company abbreviated name against English language rules. company is mailing denial letter to home address which is intimidating to XXXX I asked for online support and they referenced me to fill another non english rule form that is void by the states federal holiday XXXX XXXX given name. I request staff to follow english rule and enter name correct as written on ID. I keep getting XXXX forms or the staff keeps converting name into XXXX from XXXX. Than Staff also stealing US citizens creed units victory always and trying to apply from XXXX to XXXX to result in abbreviating name. It's every man for their self.

Consumer Complaint: I have sent in several registered securities to Navy Federal Credit Union dated XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX which was all confirmed received by thee UNITED STATES POSTAL SERVICES with instruction letter instructing the Chief Financial Officer XXXX XXXX to apply the principal positive credit balance to the principal 's Credit Card Account # XXXX for setoff. Those requests were dishonored/ignored and Navy Federal kept the securities. Navy Federal Credit Union then terminated my account, discharged said account and is making false, misleading, deceptive and defamation of character report to the consumer reporting agencies about me. This is a breach of Fiduciary Duty, Billing Error and Security Fraud. Pursuant to the Securities Act of 1933 SEC. 2. 77b ( a ) DEFINITIONS.When used in this title, unless the context otherwise requires ( 1 ) The term security means any note, stock, treasury stock, security future, security-based swap, bond, debenture, evidence of indebtedness, certificate of interest or participation in any profit-sharing agreement, collateral-trust certificate, preorganization certificate or subscription, transferable share, investment contract, voting-trust certificate, certificate of de- posit for a security, fractional undivided interest in oil, gas, or other mineral rights, any put, call, straddle, option, or privilege on any security, certificate of deposit, or group or index of securities ( including any interest therein or based on the value thereof ), or any put, call, straddle, option, or privilege entered into on a national securities exchange relating to foreign currency, or, in general, any interest or instrument commonly known as a security, or any certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase, any of the foregoing. Pursuant to Navy Federal 2022 Annual Report, they transfer the receivable assets from loans receivable through a securitization into mortgage-backed securities that are then sold to third-party investors. Navy Federal is profiting from my security, but denying me access to my credit account. This is Security Fraud. Note XXXX : Loan Sales and Continuing Involvement in Assets Transferred : In the normal course of business, Navy Federal originates and transfers qualifying residential mortgage loans in securitization or sales transactions in which it has continuing involvement. Loans are sold to XXXX XXXXXXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX, collectively the XXXX XXXX XXXX ( XXXX ), and XXXX XXXX XXXX XXXX ( XXXX ). The XXXX and XXXX generally securitize loans into mortgage-backed securities that are sold to third-party investors in the secondary market or retained by Navy Federal for investment purposes. Navy Federal may also sell loans that were previously retained for investment purposes to private third-party investors. Navy Federal sold/securitized {$6.00} XXXX and {$10.00} XXXX of XXXX XXXX loans during the years ended XX/XX/XXXX and XXXX, respectively. The following table provides a summary of the cash flows exchanged between Navy Federal and transferees on all loans transferred during the years ended XX/XX/XXXX. Furthermore, Pursuant to the Fair Credit Reporting Act " FCRA '' and the Privacy Act of 1974, A financial institution may not disclose any of their consumers non-public information to a third-party non-affiliate, unless they have provided clear and conspicuous disclosure to said consumer and an opportunity for that consumer to exercise his/her right to opt out of their information being shared. " Navy Federal did not provide me with this option or said notice '', but shared my information without full disclosure or my consent. This is a violation of the FCRA and Privacy Act of 1974 of the Consumer 's right to Privacy. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information : ( a ) Notice requirements Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. 16 CFR 313.7 - Form of opt out notice to consumers ; opt out methods. ( e ) Time to comply with opt out. You must comply with a consumer 's opt out direction as soon as reasonably practicable after you receive it. ( f ) Continuing right to opt out. A consumer may exercise the right to opt out at any time. ( g ) Duration of consumer 's opt out direction. ( 1 ) A consumer 's direction to opt out under this section is effective until the consumer revokes it in writing or, if the consumer agrees, electronically.

Consumer Complaint: I asked the company to provide a temporary forebearance for my auto loan due to a temporary financial XXXX hardship. The Company Representative initially said okay. Then the representative called back and said she would only grant me XXXX month and that if I needed it for longer, I would have to go through their Credit Counseling Department and give all of my creditors, the amount I owe, and their status. My response to the representative is that I made on time and early payments for over a year on my loan and that I needed a longer forebearance due to an unexpected financial hardship related to XXXX and how would credit counseling help me keep my vehicle and help with me getting a longer forebearance. The represenative again said that I would only be granted a month which I shared with her that a month is a set up for failure with my temporary situation and the representative pretty much said that is too bad with no empathy and offer to help me keep my vehicle. Since then, I have written several messages in the online portal asking for the maximum forebearance period ( meaning 360 days ) and when my financial hardship improves prior to the maximum days, I will gladly make monthly payments ; only to see that nothing has changed ; meaning the NFCU still has the number of payments I am behind and the interest continues to accrue daily and a message for me to get financial counseling through NFCU. While financial counseling is their option, it is not a solution to providing the assistance I need during my financial hardship to keep my vehicle and to help me during this challenging financial situation.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared, and this is supported by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' Navy Federal Credit Union, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX are all financial institutions by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Navy Federal Credit Union, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX financial institutions and the Consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish this information and they certainly do not have my written consent. Any and all consent to XXXX, XXXX, XXXX, Navy Federal Credit Union, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' Navy Federal Credit Union, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX never made me aware of my right to use my nondisclosure option. In addition, 15 USC 1681C ( a ) ( 5 ) states " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' They are reporting these adverse items without my consent, which is illegal. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. '' I have reached out to XXXX numerous times to let them know the information was inaccurate no where during these times did they stop reporting it. 15 U.S. Code 1681e states " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX, and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. Furthermore, this is also a violation of the Privacy Act of 1974, 5 U.S. Code 552a, as you do not have my written instruction.

Consumer Complaint: I have previously sent a letter directing NFCU to stop sharing and opt out of them sharing my information with non affiliated 3rd parties. Yet they are still sharing my Private information. I never received a disclosure or an opt out notice. Per 15 USC 6801 - 6805 requirements. I never gave NFCU permissions to share any of my private and transactional information to any non affiliated third parties! XXXX XXXX XXXX is the company that has my transactional and private information provided by NFCU. Youve denied my right to opt out! Ive been denied access to a new bank account because of your willful ignorance, lack of care and communication. I was humiliated learning that I could not open a new account. XXXX XXXX XXXX is NOT an affiliate of NFCU. The federal definition of non-affiliated is companies not related by common ownership or control. They can be financially or non financial companies. According to your privacy notice you dont share with companies such as XXXX XXXX XXXX and They are non-affiliate to your company. Youve been sharing my checking and savings account with this company without my written or verbal consent! This is a direct violation of my right to privacy and Violation of private policy. So unless youd rather settle this matter in court while I seek actual damages Id suggest you remove my information immediately and pay to my account {$1000.00} per violation of every MONTH you have shared my transactions and private non-public information! This complaint is my official invoice to you. Theres a total of 25 monthly reporting transactions as of : XX/XX/2023. 25 monthly reportings is a total of {$25000.00}.
