Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Why are you all allowing Navient to get away with ruining so many people 's financial futures? Have you not looked at the complaints, which basically tell the same story -- that this company has no business handling loans, or even being allowed to operate? I have complained before, to no avail, about how my loans were handled. Number one, they called my employer back when I worked for XXXX several years ago, something I had never told them was okay to do. Then, when I began paying them {$210.00} a month after being told for MONTHS that I HAD to pay {$1200.00} ( the first request for that ludicrous payment was made not even a MONTH after I graduated when I was only making {$11.00} ), I ASSUMED that my payments were being split up between my multiple accounts. I AM STILL WAITING for someone to explain to me how ANY of those loans went into default. The only conclusion I can draw is that my payments were NOT being applied as they were supposed to. Not only that, the balance NEVER WENT DOWN. Now I'm getting sued left and right after asking for HELP. I don't understand how this can continue to happen. I was NEVER offered IBR, I was told I had used up the ONE forbearance I was allowed, etc. This is crazy!

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: Last year I called to have the delinquent status removed from my credit report since my student loans were consolidated to another lender but Sallie Mae is still reporting it on my credit as being delinquent, and this was an account from 2005 that I have consolidated. Can you please help me to remove this delinquent status off of my credit because Im in the purchase of trying to purchase a house and different lender that check my credit for a home mortgage or credit increase are stating that I have serious delinquency on my credit but that was from then that is closed.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: A payment XX/XX/17 of {$480.00} is still not applied to my account which is causing late/interest fees to my account which would be paid in full by now. I have worked with XXXX which mailed the check on XX/XX/17 -it cleared on XX/XX/XXXX being cashed by Dept of Education . XX/XX/17 XXXX received ck # XXXX for {$480.00} cashed it on XX/XX/17 and sent the money back to Department of Education on XX/XX/17 in which no fees have been applied to my loan. With the transfer of accounts from Department of Education to Navient some fees were lost in the transfer -- XXXX & XXXX are checks shown as an example of this happening -- I have been working on fixing and paying off this account since XX/XX/2017 and have not been able to get a resolution. This affects my credit report, parent plus loans and fafsa applications.

So I sent in everything that needed XXXX XXXX of XXXX. Stating that my XXXX is permanent and if my XXXX was to have reviewed it would state it on my XXXX papers. I also stapled all papers again together. I have not heard anything from them. Try emailing and dont get answers. They keep adding interest to my account. My orginal loan XXXX now little over 17,000. I think they keep avoiding to add interest. My loan was in debreavince before and they keep adding interest.

Issue: Communication tactics

Subissue: You told them to stop contacting you, but they keep trying

Consumer Complaint: I'm resubmitting this complaint because you have not investigated but provided a canned answer 1 ) THE CALL I RECEIVED WAS NOT ABOUT MY LOAN 2 ) STOP CALLING ME ABOUT A LOAN THAT IS NOT MINE 2 ) STOP CALLING ME AT THE NUMBER YOU CALLED FOR ANY REASON. As you know, if a consumer says, " stopped calling me '' you have to stop, and again, you were not contacting me about my loan. In your response you said my loan ( yes I have a loan with you, but again, the call WAS NOT ABOUT MY LOAN ) is past due - IS NOT ACCURATE. Again, after using abusive language your representative determined that she called the wrong person. Investigate this and do not provide me with another canned answer. Here is the original complaint. -- -- -- On XX/XX/XXXX and XXXX I received calls from Navient to my business line. I returned the call on XX/XX/XXXX and realized It was Navient 's attempt to collect a debt. While I do have student loans with Navient they are being paid and not in default. I was previously contacted on my business line on XX/XX/XXXX about the debt. I went through the prompts and the woman realized that they had called the wrong person. I asked her to not call my business line again and she obliged. So when I got the call in XXXX I was surprised. When I spoke to the woman I immediately said, I asked you not to call this line. She immediately went on the attack and threatened to sue me ; I explained to her that I'm not even who she was looking for. Again, she used very abusive language but when she went through all the identifying information, she realized ( as I tried to tell her ) it wasn't me she was looking for and then she hung up. I called Navient customer service to complain and ask that my business line not be called. Apparently they have no real process for this and could not identify who to call. They said call the person who initially contacted you. It was a direct dial to that person so I'm supposed to complain directly to the person that's the issue? I was told to leave a message asking for a manager to call me back. I've been calling for a week with no answer and no response. I want them to 1 ) not call my business line 2 ) stop calling me about a debt that's not mine 2 ) be fined for continuing to call a number I asked them not to. The person at issue is XXXX XXXX or XXXX her direct dial is XXXX. I spoke to her the morning of XX/XX/XXXX around XXXX.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: XXXX XXXX XXXX in XXXX ny was closed down, due to law suits against them. Unfortunately anyone whom attended before XXXX had to continue to pay their school loans. Anyone currently attending at the time, loans were forgiven. I lost my job at the time and was married. I called navient to lower my payments enough where I could make minimum payments however they denied me a income driven repayment plan or any plan. Instead they offered loan forbearance. Letting me accure interest. Since I had no choice and they gave me no other options or alternatives, nothing to help me just forbearance. I started off with a {$32000.00} loan now {$37000.00} loan and I've been paying since XXXX now its XXXX. Im complaining about how the school has never given me options and continue to not give any other options til this day. Their exact words " you've exhausted all your options ''.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: First off, I want to state that this issue was eventually resolved by Navient. I have only just learned of the lawsuits pending against Navient, however, and wanted to submit this information in case it might be pertinent to the legal issues at hand. In XXXX, I applied for my income-based repayment planned to be renewed. When Navient responded, they sent a letter stating that my application was denied. I contacted Navient by phone because I felt I qualified for the renewal and wanted to know why they had chosen to deny it. The Customer Service Representative with whom I spoke put me on hold while she checked my account. She then informed me that my receiving the letter had been the result of " a glitch '' and that my repayment amount would stay the same ( {$0.00} ). She also assured me this payment amount ( {$0.00} ) would run for one year after my initial plan ended and the renewal began. Not long after speaking with the CSR, however, I received an email from Navient telling me that my monthly payment would increase to {$63.00} and the first such payment would be due on XX/XX/XXXX. I made by second contact to Navient through a form on their website. The representative who responded told me the same as the first -- my application had been received, processed, and approved. I was told that it would go into effect before the XXXX due date so there was nothing for me to worry about. I logged into my Navient account on XX/XX/XXXX to check to make sure the payment had been adjusted. What I found, however, was that my account then showed as " PAST DUE '' with a new payment amount of {$120.00}! On that date, I contacted Navient for the third time total, my second written communication ( again, through their website ), and demanded immediate action before my credit rating was effected and late fees accrued. After that third contact, my account payment balance was finally reset to {$0.00}. I have renewed that same plan in XXXX and again in XXXX without issue. Again, this matter was eventually addressed by Navient but it took my contacting the company 3 separate times over the course of 3-4 months for them to correct an issue which I was assured to be correct from the outset. It is my opinion that this was an attempt to strong-arm me into making a payment ( or multiple payments ) when I was not financial able to do so, and I found these tactics quite unethical. ( Because this happened more than two years ago, I have very little proof. The written communications through the website are no longer accessible on my end, as communications older than one year are routinely removed from the message system on site. These communications should be included in my account history. The one thing I still have and am including as an attached image is a copy of the third communication that I sent in this matter. By that time, I was concerned that I might have to pursue legal channels, so I made a point of keeping a copy. )

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I am needing to have someone investigate the interest on my student loans. I graduated in XX/XX/XXXX. My loans were consolidated with a principal amount of {$42000.00}. My loan was transferred to Navient in XXXX and had already accumulated over {$20000.00} in interest making the total for both subsidized and unsubsidized {$61000.00}. As of today in XXXX, I have an excess of over {$30000.00} in interest for my student loans. Never really explained the accumulation of interest when in forbearance. I am in an IBR repayment plan because I have never gotten a better paying job as of yet and it is very unfortunate for those of us who financially can not afford to pay the full payment to be hit with so much interest. My interest now is almost greater than the principle amount and this has burdened me mentally to know I owe so much and don't have a clue how to pay this any other way but to continue to gain interest. This makes me feel that getting this education is more of a burden to me than it has helped my life and I find myself in tears a many times wondering how I will ever rid this debt without continuously gaining interest at the same time. As a single mom, I was unable to attend previously and after finally being able to go, I was was hoping to improve my income having graduated. This is now a burden to me and prevents me from getting ahead. I need someone to investigate the interest I am being hit with on this student loan ; its ridiculous that we as American citizens pay so much for an education and my now XXXX yr. old daughter who also received her XXXX degree, tells me she think education is over rated. What a punch to learn after 50 years of life and never being able to complete my education until the age of XXXX but with so much burden behind it.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: For the last year my wife and I have made consistent payments on my student loan via direct payment from our bank account. Every month Navient has returned the payments back to our account without any explanation. When I have called, the agents state there is no record of the payments being made and that I am delinquent on the account. I am currently being reported as 90+ days past due. I have called and written the company providing the requested bank account information proving the payments and returns. I have provided and have never received a response to my complaint or concerns. I am turning to you for your assistance and providing the same information I have provided via the Navient website and USPS.
